O R D I N A N C E WHEREAS, an application has been filed by Joseph Bellattiere in connection with a Special Use Permit for the property located at 1100 State Street, Suite #19, in the Lemont Plaza, Lemont, Illinois; WHEREAS, the applicant has requested said Special Use Permit for the purpose of establishing a billiard parlor; WHEREAS, at the March 9, 1993 meeting of the Zoning Board of Appeals, the matter was discussed and approval was given for the Special Use Permit subject to certain conditions. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, that Joseph Bellattiere be granted a Special Use Permit so that the property commonly known as 1100 State Street, Suite #19, Lemont, Illinois, and legally described as follows: THAT PART OF THE NORTH ONE -HALF OF THE SOUTH ONE -HALF OF THE EAST ONE -HALF OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN BEING DESCRIBED BY COMMENCING AT THE NORTHEAST CORNER OF THE SOUTH ONE -HALF OF THE SOUTHWEST QUARTER OF SAID SECTION 29; THENCE WESTERLY ALONG THE NORTH LINE OF SAID SOUTH ONE -HALF, 33.00 FEET TO THE WESTERLY RIGHT -OF- WAY LINE OF STATE STREET; THENCE CONTINUING WESTERLY ALONG LAST DESCRIBED COURSE, FOR A DISTANCE OF 213.00 FEET FOR THE POINT OF BEGINNING; THENCE SOUTHERLY PARALLEL WITH THE EASTERLY LINE OF SAID SOUTHWEST QUARTER, 409.01 FEET; THENCE EASTERLY PARALLEL WITH THE SAID NORTH LINE, 213.00 FEET TO A POINT ON THE WESTERLY RIGHT -OF -WAY LINE OF STATE STREET; THENCE SOUTHERLY ALONG SAID RIGHT -OF -WAY LINE, 190.79 FEET MORE OR LESS TO THE NORTHERLY RIGHT -OF -WAY LINE OF WEND STREET DEDICATED AND RECORDED AS DOCUMENT #24899513; THENCE WESTERLY ALONG SAID RIGHT -OF -WAY LINE, 429.34 FEET MORE OR LESS TO THE POINT OF CURVATURE OF A CURVE BEING CONCAVE TO THE SOUTH AND HAVING A RADIUS OF 367.00 FEET; THENCE WESTERLY ALONG SAID CURVE FOR AN ARC LENGTH DISTANCE OF 77.12 FEET MORE OR LESS TO THE POINT OF TANGENCY; THENCE NORTHWESTERLY ALONG SAID TANGENT, FOR A DISTANCE OF 109.49 FEET MORE OR LESS TO A POINT ON THE EASTERLY RIGHT -OF -WAY LINE OF WARNER STREET DEDICATED AND RECORDED AS DOCUMENT #24899513; THENCE NORTHEASTERLY ALONG SAID RIGHT -OF -WAY LINE, 42.17 FEET MORE OR LESS TO THE POINT OF CURVATURE OF A CURVE BEING CONCAVE TO THE EAST AND HAVING A RADIUS OF 433.00 FEET; THENCE NORTHERLY ALONG SAID CURVE, FOR AN ARC LENGTH DISTANCE OF 90.63 FEET MORE OR LESS TO THE POINT OF TANGENCY; THENCE NORTHERLY ALONG SAID TANGENT 436.92 FEET MORE OR LESS TO THE NORTH LINE OF SAID SOUTH ONE -HALF; THENCE EASTERLY ALONG SAID NORTH LINE, 381.30 FEET MORE OR LESS TO THE POINT OF BEGINNING CONTAINING 6.163 ACRES MORE OR LESS IN LEMONT TOWNSHIP, COOK COUNTY, ILLINOIS can be used as a billiard parlor subject to the following conditions: 1) No liquor or sales of liquor will be allowed on the premises. 2) No liquor permit will be granted at this time or at any time in the future. 3) Minors under age 18 would be permitted to use the facility with the exception of the stipulation of no. 4 hereinbelow. 4) Curfew would be enforced in accordance with Village Code for all children under age 16, with the exception of those children under age 16 accompanied by a parent only. 5 That the closing time of 2:00 a.m. is acceptable for this billiard parlor. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form.
