PIN #: 22 -33- 200 -011 ORDINANCE NO. t AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT FROM R -1 SINGLE FAMILY RESIDENCE TO B -3 COMMERCIAL DISTRICT ON APPROXIMATELY 0.95 ACRES (PUBLIC WORKS BUILDING) WHEREAS, the Village of Lemont, hereinafter referred to as "the Petitioner ", is the owner of a 0.95 acre parcel, hereinafter referred to as "the subject property ", located at 14574 127th Street, near 127th Street and Archer Avenue and is legally described as follows: THE NORTH 276.69 FEET OF THE WEST 170.00 FEET OF LOT 3 IN COUNTY CLERK'S DIVISION IN THE NORTHEAST 1/4 OF SECTION 33, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT RECORDED APRIL 30, 1880 AS DOCUMENT 269446, IN COOK COUNTY, ILLINOIS. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426), as amended for an amendment to the Lemont Zoning Map; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois conducted a Public Hearing on August 10, 1993; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the proposed zoning district is generally consistent with the Village Comprehensive Plan; and WHEREAS, the Lemont Plan Commission has recommended the amendment of the Lemont Zoning Map from R -1 Single - family Residence to B -3 Commercial District; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interest of the Village will be served by the adoption of the Plan Commission recommendation regarding the subject property; and WHEREAS, the President and Board of Trustees of the Village approve the amendment of the Lemont Zoning Map for the subject property pursuant to I11.Rev.Stat.Ch.24, 11- 13 -14. There has been some residential development activity to the east (Athen Knolls) and north (Abbey Oaks) in recent years, though most of the adjacent land remains rural in character. A seasonal market occupies the 3 -acre parcel adjacent to the east. HISTORY The Lemont Public Works Building was built to replace the older downtown facility, which was razed last year to make way for a commuter parking lot expansion. Recently the Village selected the subject property to house a new salt storage building. Village staff advised that the present zoning is inappropriate for the use and that a map amendment should precede any new construction on the subject parcel. DEVELOPMENT PROPOSAL The Village proposes a B -3 Commercial District zoning classification for this site. The only development proposal to speak of is the planned 35 by 40 foot salt storage building, which is an accessory structure to the existing Public Works garage and offices. In the B -3 Commercial District, "Garages, storage, or off - street parking lots and structures, commercial or municipal" are uses permitted by right. PUBLIC RESPONSE Staff have not received any public comments or questions regarding this request. EVALUATION Though "Public land and buildings" are permitted by right in the R -1 Single - family District, the existing lot and structure cannot meet the minimum lot area (3 acres), lot width (250 feet), front yard (50 feet), and side yard (50 feet) requirements in the R -1. Staff recommends a B -3 Commercial classification to: a) Bring the existing structure into zoning compliance; b) Make allowance for the salt storage needs of the community; and c) Zone the land in a manner consistent with the proposed Comprehensive Plan, which recommends future commercial land use at the southwest corner of Archer and 127th Street. The meeting was called to order at 7:30 p.m. by the Chairman, Richard Diaz. The following members were present: Eileen Cattoni, Virginia Connelly, Terry Duffy, John Miller and Ellen Pearson. Also present were the following staff: Tim Teddy, Jeff Clark and Lisa Kean. PUBLIC HEARING A motion was made by Mrs. Cattoni and seconded by Mr. Duffy to open the Public Hearing. Motion carried 5 -0. A. Public Works Building Request for zoning map amendment from R -1, Single Family Residence to B -3 Commercial District Mr. Teddy stated that the property is located at 14574 127th Street, west of Archer. Avenue and 127th Street. The parcel is improved with the Village Public Works building that has been there for several years. It is still zoned R -1 Single- Family Residence. Mr. Teddy stated that this parcel was annexed but never rezoned. R -1 only allows lots of a minimum of 3 acres; a side yard minimum of 50 feet; lot width is a minimum of 250 feet; and front yards are 50 feet in depth minimum. The existing building and lot do not meet those standards. The Village is considering that site for an accessory building that would be used to store the road salt supply. The Planning Department was told that unless the parcel is rezoned, they would be reluctant to let the work go forward. Mr. Teddy stated that they are proposing to rezone the property to B -3 Commercial for the following reasons: 1. It would bring the existing building into compliance and would allow expansion of the existing facility such as the salt storage facility. Page 1 2. B -3 would be consistent with the draft Comprehensive Plan. The land -use map shows the 3 acre parcel immediately adjacent as Commercial. Government buildings and garages are a permitted use in the Commercial district. The lot size and setbacks would be in conformance. Mr. Miller noted that they have a parking problem now, and would this salt storage building take away more of the parking spaces. Mr. Miller also asked if there would be enough parking spaces to meet the the requirements of the new zoning. Mr. Teddy stated that he assumed that it would but would certainly check it out. With no other questions or comments, Chairman Diaz asked if there were any questions or comments from the audience: Pat Cronin, Abbey Oaks - Feels that the Village is already stuck for space where they are and that he gives them a place for some storage. He feels that they need a bigger site. Suggests that the Village purchase the 10 acres for sale from Fricker's farm. Felt that it would be a eyesore in the middle of the winter to have the salt truck loading up in front of Abbey Oaks. If they purchased the 10 acre site they could load up in the back of the site. He felt that they are putting good money into a small site that they will outgrow in two years. With no other questions or comments, a motion was made. -by, Mr. Miller and seconded by Ms. Pearson to recommendto -the Village Board that this property be rezoned from R -1 Single - Family Residence to B -3 Commercial District.
