. RESOLUTION AUTHORIZING ADOPTION OF AN ENGINEERING AGREEMENT
WITH MIDWEST CONSULTING ENGINEERS FOR
PHASE I DESIGN ENGINEERING ON
MAIN STREET (ILLINOIS TO STATE STREET OVERPASS)
WHEREAS, the Village of Lemont has committed resources to perform a Phase I
design study for a section of Main Street; and
WHEREAS, the Villag of Lemont has selected Midwest Consulting Engineers to
perform design engineering on this project; and
WHEREAS, the Village will seek FAU funding on the construction of this project;
and
WHEREAS, Midwest Consulting Engineers will submit the necessary request to the
Southwest Council of Mayors,
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
that the attached engineering Agreement be approved.

A Resolution and contract is attached for Village Board approval of the phase I design
engineering of Main Street. You will recall the Village Board previously approved the
selection of Midwest Consulting Engineers subject to working out a contract.
As part of their scope of service Midwest will prepare the necessary paperwork requesting
the Southwest Council funding of the construction and phase II/III engineering of the
project as authorized by the Board as a State Street trade -off. It is anticipated that the
completion of the phase I design report will occur by February 1994.
I should note that the firm of Teska Associates will be utilized by Midwest for all streetscape
and landscape architecture components of the report. Concurrence on this selection was
received from the DLI Design Committee.

THIS AGREEMENT, entered into this _ day of August, 1993 by and between the
VILLAGE OF LEMONT, hereinafter referred to as the VILLAGE, and MIDWEST
CONSULTING ENGINEERS/DAMES & MOORE, INC., a firm of consulting engineers
whose address is 1701 Golf Road, Suite 404, Rolling Meadows, Illinois 60008, hereinafter
referred to as the CONSULTANT.
WHEREAS, the VILLAGE proposes to engage the CONSULTANT to render
professional Phase I engineering services in connection with the proposed improvement:
Main Street from State Street overpass to Illinois Street.
This AGREEMENT contains all the terms and conditions of the agreement between
the VILLAGE and the CONSULTANT and any changes in this AGREEMENT shall have
no effect unless they are made in writing, signed by both parties, and incorporated as an
amendment to this AGREEMENT. No other written or oral understandings,
representations or agreements, other than those herein, have been made by and between the
parties hereto.
In consideration of these premises, the parties hereto agree as set forth in the
following pages number 1 thru 16 inclusive.

DELETION AND AMENDMENTS TO THE ILLINOIS DEPARTMENT OF
TRANSPORTATION'S STANDARD AGREEMENT PROVISIONS FOR CONSULTANT
SERVICES, DATED 1990
1. Incorporation by Reference
The Illinois Department of Transportation's "Standard Agreement Provisions for
Consultant Services ", dated 1990 hereinafter referred to as the "STANDARD
PROVISIONS ", are incorporated and made a part of the AGREEMENT except as
deleted or amended hereinafter. (STANDARD PROVISIONS' section references
are shown in parenthesis):
1.1 (SP 1) Definitions, as they pertain to the PROJECT, shall be set forth in Section 1
of the STANDARD PROVISIONS, amended to add the following:
1.1.2 Chief of Environmental Science - The Chief of Environmental Science of
IDOT
1.1.3 Environmental Statement - A written statement containing an assessment
of the anticipated significant, beneficial and detrimental effects which the
PROJECT may have upon the human environment.
1.1.4 Categorical Exclusion - A written document in support of a determination
that, should the proposed highway section improvement be constructed, the
action will not induce significant, foreseeable alterations in land use,
planned growth, development patterns, traffic volumes, travel patterns, or
natural or cultural resources.
1.1.5 Section 4(f) Land - Any land from a public park, recreation area, wildlife
and water fowl refuge or historic site which a transportation plan or project
proposes to use.
1.1.6 Environmental Assessment - Any action that is not classified as a
Categorical Exclusion and for which the environmental studies and early
coordination indicate that the proposed action will not have a significant
impact on the quality of the human environment.
1.1.7 Combined Report - Report that contains both the corridor location studies
and the design location studies. A combined report is prepared for projects
in which only the existing corridor is feasible.
1.2 (SP 1.17) Wherever the work DEPARTMENT is used, it shall be construed
to mean the VILLAGE, except that in the STANDARD PROVISIONS, the
word DEPARTMENT shall also include IDOT in Subsections 2.12, 2.24,
2.31, 2.32 and Section 6, in its entirety.
1.3 (SP 2.32) The CONSULTANT shall obtain insurance of the types and in
the amounts described below:

1.3.1 Commercial General Liability Insurance. The Consultant shall secure and
maintain such insurance as will protect him from claims under the
Workmen's Compensation Acts and from claims for bodily injury, death, or
property damage which may arise from the performance of his services
under this Agreement. The Engineer shall file Certificates of Insurance
with the Village for the Project. The Certificates of Insurance shall contain
an endorsement stipulating that the Village will be notified, by registered
mail, 30 days prior to cancellation of any insurance coverage.
1.4 (SP 2.41) The CONSULTANT shall invoice the VILLAGE in a format
acceptable to the VILLAGE.
2. SCOPE OF WORK
The PROJECT is anticipated to be a Categorical Exclusion Type II Action. Phase I
Engineering will involve the preparation of a Project Development Report. No right -
of -way acquisition, Section 106 Report or 4(f) Report is anticipated for this project.
Roadway and /or intersection re- alignments are not part of this study.
The CONSULTANT will perform or be responsible for the performance of the
services outlined below. The engineering studies will be performed in accordance
with IDOT's Bureau of Local Roads requirements for Local Agency Federal Aid
Projects.
a) Early Coordination:
Prepare State and N.I.P.C. Clearinghouse notifications.
Prepare the environmental survey request.
Attend one (1) FHWA/IDOT coordination meeting.
Investigate possible funding scenarios.
Submit FAU application to S.W. Council of Mayors.
b) Data Collection: The VILLAGE will provide accident records for the current
three year period to the CONSULTANT, and all available project related as-
built plans, right -of -way documents, and traffic data. The CONSULTANT
will:
Obtain aerial mapping at 1" = 50'.
Obtain available project related information from the outside agencies
and utility companies.
- Prepare a project photolog of existing conditions.
Traffic counts preformed by subconsultant.
c) Field Survey: A conventional ground survey will be performed to obtain
topographic information suitable for the design of the PROJECT. For Phase
I, the survey will begin at 300' west of the State Street Overpass and end 300

feet east of Illinois Street. The ground survey work will be performed in
accordance with Section 6.21 of the STANDARD PROVISIONS, except that
State Plan Coordinates will not be established. The CONSULTANT will
take specific action to locate existing vaulted sidewalks and the VILLAGE will
provide to the CONSULTANT access to said structures for purposes of
inspection.
d) Traffic Analysis:
Obtain 2010 traffic projections from CATS.
Perform existing conditions capacity analysis at the Main Street /Stephen
Street intersection.
Perform warrant analysis at the signalized intersection, Main
Street/Stephen Street intersection, and 4 way stop sign controlled
intersections. The stop sign controlled intersections along Main Street
are at Lemont Street and at Holmes Street.
Analyze three years of accident data and prepare a summary table.
Perform one (1) intersection capacity analyses for 2010 traffic projections.
The location is the Main Street/Stephen Street intersection.
Perform one intersection design study (IDS). The location is the Main
Street /Stephen Street intersection.
Analyze existing street parking.
e) Preliminary Design Studies:
Perform concept review for two (2) alternative roadway typical sections.
Perform detailed analysis of the preferred alternate roadway typical
section.
Analyze cross section impacts.
Prepare concept sketches for two (2) alternative urban landscaping plans.
Work will be performed by a subconsultant. See Exhibit H.
Perform warrant and need analysis for roadway lighting.
Perform analysis of stage construction alternatives.
Analyze potential watermain replacement.
Analyze design options for barrier wall construction along north right -of-
way line on Main Street.
Inspect and make recommendations as to the disposition of vaulted
sidewalks.
Soils Investigations: Provide design soils survey in accordance with IDOT
requirements. Work will be performed by a subconsultant; refer to Exhibit G.
The Phase I engineering work will be limited to Stage I Soils Investigations.
Drainage Studies: Perform location design drainage studies including:
- Identifying storm sewer locations, system outfalls, pipe sizes, and pipe
slopes for the existing drainage system.

Evaluating the capacity of the existing system according to methods
prescribed by the DEPARTMENT.
Evaluate sewer separation.
Evaluating the need to provide storm water detention.
Performing preliminary design for the proposed storm sewer system,
including evaluating alternatives for providing detention.
Summarizing the drainage studies for inclusion in the Project
Development Report, including exhibit preparation.
h) Environmental Studies: Perform the following analyses and review of
environmental issues:
Traffic Noise Analysis
Construction Noise
Archaeological /Historical/Cultural Resource Impacts
- Water Quality Impacts (Road Salt Dilution & Storm Water Runoff)
- Land Use/Impacts
Wetland Identification (permits are not included)
- Floodplains
i) Quantity and Cost Estimates: Perform detailed quantity calculations and
construction cost estimates for the preferred alternative.
j) Exhibits: Prepare report and public involvement exhibits.
The following exhibits are anticipated:

Existing and Proposed Traffic
Public Hearing Brochures (50 copies)
k) Draft PDR: Prepare a draft of the Project Development Report in the format
suited to the requirements of IDOT. Provide six (6) copies of the report for
review.
1) Draft PDR Review: Meet with the VILLAGE and IDOT to resolve report
review comments, prior to public release of the report.
m) Public Involvement: Prepare and present one (1) public meeting before the
Village Board. The meeting will be in a public hearing format. The work will
include disposition of comments received at the meeting. Hold three (3)
coordination meetings with representatives of Downtown Lemont, Inc. In
addition, CONSULTANT will meet with the utility companies and railroad as
needed for the project.

n) Final Project Report: Incorporate all comments and complete the PDR for
obtaining Design Approval. Provide ten (10) copies.
o) Project Administration: Perform project administration activities, including
scheduling, budget control, manpower planning, meetings, correspondence and
client coordination.
2.1 The CONSULTANT shall exclusively furnish to the VILLAGE, all reports,
data or other information prepared, obtained or assembled by him under this
AGREEMENT, unless otherwise directed by the VILLAGE.
3. The VILLAGE agrees to furnish the following items:
3.1 All presently available survey data and information including standard details
and standard specifications adopted by the VILLAGE and other available
data, including accident data and traffic counts, useful to the work being done
by the CONSULTANT. The VILLAGE also agrees to publish project design
legal notices and notices for public meetings.
4. PROJECT SCHEDULE
The CONSULTANT shall commence work on Phase I within five (5) calendar days
after the date of Authority to Proceed. It is anticipated that the work will be
completed and according to the schedule presented on Exhibit E, subject to the
variability of time requirements for agency reviews that is beyond the control of the
CONSULTANT and the VILLAGE.
5. PRIME COMPENSATION
5.1 Phase I - Subject to an Upper Limit of Compensation of $65,035, the
CONSULTANT shall receive as full payment for completing the Phase I work
required of him under this AGREEMENT, reimbursement of his eligible
actual costs in accordance with Section 2.45 of the STANDARD
PROVISIONS, plus a Fixed Amount of $6,669. The Upper Limit of
Compensation and Fixed Amount are a result of the attached Exhibit D, Cost
Estimate of Consultant's Services for Phase I. For services rendered by any
subconsultant retained by the CONSULTANT, the CONSULTANT will be
reimbursed for the actual amount invoiced to the CONSULTANT. Any such
subcontracted fees are included in the Upper Limit of Compensation
5.2 The Prime Compensation may be increased or decreased by subsequent
agreement between the contractual and approving parties if there is a major
change in the scope, character or complexity of the Work. Prime
Compensation and Specific Rates for Extra Work may be adjusted in

accordance with Section 2.21 of the STANDARD PROVISIONS, if the
duration of the work in any phase extends more than six months beyond the
date of completion stated in Section 4 of this AGREEMENT, due to no fault
of the CONSULTANT.
5.3 In all instances where the VILLAGE shall request specific services of the
CONSULTANT, the CONSULTANT shall indicate to the VILLAGE whether
or not the work shall be considered Extra Work. When requested by the
VILLAGE, the CONSULTANT shall prepare and submit a cost estimate for
such Extra Work. In the event the CONSULTANT, upon written order from
the VILLAGE, is required to perform Extra Work, he shall, in addition to the
Prime Compensation, receive payment for such Extra Work on the following
basis:
Subject to a pre - agreed Upper Limit of Compensation for each item of Extra
Work, the CONSULTANT shall be paid at the specified hourly rate of pay
for each class of employee as listed in Exhibit "A" for the actual time the
CONSULTANT directly utilizes each such employee on the Extra Work, plus
the CONSULTANT's payroll burden and overhead costs as listed in Exhibits
B and C, plus actual expenses for transportation, subsistence, and electronic
computer service incidental to the Extra Work. Any other expenses incurred
incidental to the Extra Work shall be considered to be overhead costs.
5.4 Retainage - Delete Section 2.42(b) of the STANDARD PROVISIONS. No
retainage will be required for the Phase I work.
5.5 The CONSULTANT certifies that he /she and his/her principals have not been
barred from signing this agreement as a result of violation of section 33 E -3
and 33 E -4 of the Criminal Code of 1961 (Chapter 38 of the Illinois Revised
Statutes).

Dear Mr. Jedrzejak:
We are pleased to have the opportunity to submit the following proposal for
performance of a soil survey for the proposed improvements on the referenced
project.
Project Description and Scope of Work
The proposed project from a soils exploration standpoint, will require the scope of
work outlined:
a) Repair and Reconstruction along approximately 3200 L.F. of Lemont
Road from the State Street overpass, east to Illinois Street.
Method of Performance - Field Work
The typical subgrade soil survey exploration will be accomplished by performing
auger borings spaced at approximately 300 foot intervals on alternate sides of the
roadway, and at other points where significant problem areas are observed:
a) Pavement cores will be made to determine the existing pavement section at
each boring location.
b) Soil survey borings will be extended to the depths indicated above with
sampling at 30 inch intervals or more frequently if required to sample all soil
strata.
c
Laboratory testing will include moisture content determinations, consistency
(penetrometer value), determination on cohesive soil samples and
classification tests as required to identify major subgrade soil types.

The soil survey and structure borings will be performed in compliance with the
current State of Illinois, Specification for Soil Survey; and the Soils Manual.
Method of Performance - Analysis and Report
The boring information will be used to develop soils profile drawings which will be
prepared showing the soil types and test data in accordance with applicable
specifications. We understand that mylar sepia copies of the plan and profile
showing existing and proposed grade will be provided by the the Design Engineer for
our plotting of the soil profile.
The results of this field exploration and laboratory testing would be used in an
analysis and formulation of our recommendations. Major subject areas for our
analysis, recommendations and report would include:
1. Existing pavement conditions.
2. General earthwork recommendations.
3. Identification of soil treatment areas.
4. Soils criteria for input to the pavement design being done by the Design
Engineer
A written report summarizing and presenting the data and recommendations will be
prepared by a Professional Engineer, registered in the State of Illinois.
Timing
We will begin on work after notice to proceed. We plan on mobilizing and doing all
the borings concurrently. Final reports and profiles will be coordinated with
Midwest Consulting Engineers as their base plan and profile drawings and other
designs are completed.
Fees
We propose to provide this work at the unit rates quoted on the attached Schedule of
Services and Fees, Attachments 1.1 through 1.2. These estimated quantities and unit
rates are based on information as outlined in this proposal and experience on past
projects.
On the basis of the above information, we estimate that these services can be
provided for a fee of: $ 4,658.00

Teska Associates, Inc. is pleased to be considered for participation as consulting
planners and landscape architects for Phase One of the Downtown Streetscape.
We are especially enthusiastic about downtown Lemont's potential to express its
distinctive personality in a creative and effective design.
As participants in this team effort, we shall approach our evaluation design of the main
street district as a component within the greater context of downtown as a whole.
A general estimate of services and input anticipated in Phase One includes the
following efforts:
1. Attend a meeting with the consultant team, Village staff and main street
representatives to establish an approach and planning strategy. Establish
design considerations, project schedule and responsibilities of individual team
members.
2. Prepare two conceptual streetscape design alternative design sketch plans.
Plans shall illustrate proposed streetscape theme options, including identity of
paving, street- furnishings, lighting street trees, amenities, etc. Consideration
win be given toward location of underground utilities, parking spaces,
surface vaults and basement access doors.
3. Provide presentations of alternatives to downtown streetscape committees to
review, discuss and incorporate comments and suggestions.
4. Refine preferred alternative options and suggestions into a preliminary design
plan.
5. Present draft of the preliminary design plan (P.D.P.) to Village staff and
streetscape committee; incorporate any suggestions or make minor
modifications.
6. Provide final rendered illustrations of the P.D. P. and make public presentation
to the Village Board.
7. Conclude Phase One services with a memo indicating Village responses to the
presentation exhibit.

Optional continuing services available separately upon conclusion of Phase One are as
follows:
8. Prepare design development documents and preliminary construction bid
documents.
9. Prepare construction implementation /working drawing, details and
specifications.
10. Assist with bid and selection of installing contractor(s).
11. Provide construction progress observation, punch list, inspection, guarantees,
etc.
An estimate of our fees and compensation to provide Phase One services would not
exceed $4,800.00. This amount is a "not -to- exceed" figure based on actual hours of
service applied to the job.
