Forzley are the contract purchasers of certain property legally described in Exhibit "A ", which is attached hereto and made part hereof; and WHEREAS, the petitioners have prepared a Plat of Consolidation for 2 parcels known as Lot 79 in Alpine Estates and Lot 2 in A.S.C. The Commission recommends approval of the consolidation. In addition, the Commission does not agree with the Staff request that the petitioner provide a cross access easement to the property to the West. The Commission believes that this easement could be used as a shortcut from Walter Street to the West, to bypass the 127th Street intersection. This situation could create an unsafe condition for patients coming to the facility for treatment, particularly those with mobility problems. The recommendation passed; 5 yes, 0 no, 1 absent. The meeting was called to order by the Chairman, Richard Diaz. The following members were present: Eileen Cattoni, Virginia Connelly, John Miller, Ellen Pearson and Frank Viero. Also present were the following staff: Dana Jenkins, Tim Teddy, Tony McNamara, Chris Giazzon and Lisa Kean. A motion was made by Mr. Viero and seconded by Ms. Connelly to approve the minutes of the September 7, 1993 meeting. Motion carried 5 -0. A motion was made by Mrs. Cattoni and seconded by Ms. Pearson to approve the minutes of the Workshop held August 2, 1993. Motion carried 5 -0. DRAFT PLAN COMMISSION MINUTES NEW BUSINESS A. Approval of Plat of Consolidation, 1.7 acres located on the northwest corner of 127th & Walter Streets The petitioners were Dr. Samuel J. Forzley and Dr. Jeffrey E. Forzley. Dr. Sam Forzley was the representative for the petitioners. He stated that the property is located on the northwest corner of Walter Street and 127th Street and is approximately 1.7 acres in size. He stated they would like to combine the two separate lots into one lot to construct a medical center. The facility is over 20,000 SF and is two stories. They are planning entrances off of both 127th Street and Walter. Dr. Forzley stated that the goal is for the facility to have the capabilities of urgent care and have specialty physicians ranging from cardiac care, pediatrics, obstetrics and some specialization for women. Page 1 Chairman Diaz asked the petitioners what their comments were on the future cross access shown on the drawing. Dr. Forzley stated that they would not like to have access to the property for the following reason: 1. Maintenance throughout the years of having cars cross both lots. 2 Liability - The facility is going to have children and senior citizens. Being that this property is on a corner, they can forsee the problem of having a frontage road from west on 127th Street going east with cars able to cross each lot and get onto Walter Street instead of getting on to 127th Street.' They would like to limit the traffic at this corner. Dr. Forzley also stated that there will be an access on 127th Street and also one on Walter Street and they would like to limit the traffic. 3. There will be emergency care ambulances entering and exiting and they would like to limit the use as much as possible from cars and other traffic. Chairman Diaz asked Ms. Jenkins what the reason was behind the staff request for cross access easement. Ms. Jenkins stated that whenever we have a number of curb commercial uses that are going to be adjacent, they try to get cross access easements. In this instance it was not done with the original plat of subdivision. Even if they grant the access at this location, there is no guarantee that they will have it from the property to the west. Staff believes it is in the community's best interest to provide good circulation in commercial developments and would recommend that the cross access easement condition be added. Mr. Miller stated that due to the nature of this particular facility with emergency vehicles going in and out and also the children and senior citizens, he would be inciine4 not to have the access go through the parking lot. Being a corner lot, there will probably be people using the parking lot to get onto Walter Street. Mrs. Cattoni asked Mr. Teddy what his feelings were on this subject. Mr. Teddy stated that the idea of using cross access to reduce curb cuts is not something we can compel\ the developer to do unless we are annexing a parcel. He stated that it is something they recommend as a way of anticipating future commercial growth on 127th Street. By providic nuczcross access you have an opportunity, but no guarantee, of ___ _ -= __= the interval between the driveways on 127th Street, which makes traffic flow a little better. It is an ideal that the staff aims for. Mrs. Cattoni feels that the consideration for the safety of the people using this facilitiy should be a prime consideration and agrees with Mr. Miller. Page 2 With no other questions or comments, Ms. Conner made a motion to recommend to the Village Board that these two lots be combined for the purpose of constructing a medical center. The motion was seconded by Mrs. Cattoni. Mr. Miller wanted clarification as to whether they were accepting the staff recommendation or not. Chairman Diaz stated that there was no motion to accept the staff's recommendation. Motion carried 5 -0. PUBLIC HEARING A motion was made by Ms. Pearson and seconded by Mr. Viero to open »the Public Hearing. Motion carried 5 -0. A. Meadowland Development - Request for annexation, rezoning from Cook County R -4 District to Village of Lemont B -3 Commercial District and R -4 Single - family Residence District, with Special Use Permit for a PUD on 34 acres, located south of 127th Street and west of Centennial Park. Mr. John Griffin from the law firm of Griffin & Gallagher was representing the petitioner, William Brennan and Brian Kelley, dba Meadowland Development, Inc. Also present for the petitioner was Liam Brennan, Pat Sullivan (Grubb & Ellis) and Kevin Chaffin from Landeirkse4 Engineering. A Mr. Griffin stated that the property is located west of Centennial Park directly across from Timberline Drive. He stated that it is approximatelff.,5314 acres. The petitioner is proposing 9 acres commercial and 181-/-Taeres residential. They are proposing 30 buildings with 4 townhomes each, with a total of 120 townhomes. Mr. Griffin stated that there are wetlands located at two locations on the property. The nature of 127th Street would only allow one access point. WHHwtated that there would be a stub street for future access e and the potential to stub in another street to the south. Chairman Diaz asked how they planned to mitigate the wetlands. Mr. Griffin stated that the present plan would be that the wetlands would remain where they are and would stay there in their natural state. The 50 foot buffer would have to be worked into the plan but there may be a couple of small areas that would need to be mitigated. Chairman Diaz stated that the drawing shows dwellings built on the wetlands. Mr. Kevin Chaffin from ''Landiti5ks'?f. The "L- shaped" parcel lies to the west and south of the Dunbar Engineering office on Walter Street. There is adjacent single family residential use to the north. DEVELOPMENT PROPOSAL The petitioners are planning to construct a 10,800 s.f. medical clinic on the subject property, which includes Lot 79 of Alpine Estates and the south half of Alpine Estates Lot 80 (which Commissioners may recall was subdivided in 1992). Although the petitioners could simply construct the facility on two lots in accordance with applicable zoning and building regulations, they have elected to consolidate the parcels into one lot of record. GENERAL DEVELOPMENT POLICY To encourage office development along appropriately- designated corridors. To screen commercial development from adjacent residential neighbors. To provide for adequate vehicular and pedestrian circulation in all new developments. EVALUATION The petitioners have revised their site plan to include sidewalks along 127th Street, Walter Street, and the front and back of the proposed building. They have also incorporated landscape islands in the parking lot, and hedgerow screening at the northerly property line adjacent to residential properties. The hedgerow plantings should be 5 -6' in height and should create a solid "natural fence" in accordance with the Fence Ordinance. Also, trees should be planted at least every 50' along 127th and Walter Streets in accordance with Village Landscape, Ordinance No. 660. Parking provided exceeds the minimum required under the zoning ordinance (based on one space per each 250 s.f. of floor area). Staff also has recommended that an access easement be provided for the property to the west. (Recall that a similar approach was used for the Glenys Park Planned Development.) The petitioners have indicated their concern over this recommendation as the specific land use for the adjacent property is not known. Please note that, although not shown on the actual plat of consolidation, future cross access provisions are referred to on the site plan. Commissioners should also be aware that securing an access easement for this lot will not guarantee the Village the opportunity to secure a cross access easement from the adjacent property owner to the west. PUBLIC RESPONSE To date, there has been no public response to this request.
