R-292-93 To support the vacation of Parker Road from Main Street to Archer AvenueITEM VI.B.2 RESOLUTION 292 RESOLUTION TO SUPPORT THE VACATION OF PARKER ROAD FROM MAIN STREET TO ARCHER AVENUE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, counties of Cook, Will and DuPage, Illinois that the Village of Lemont hereby supports the Petition of Cog Hill Properties to vacate a portion of Parker Road from Main Street to Archer Avenue and in support thereof, the Village of Lemont requests Cook County to vacate said roadway conditioned upon the following: 1. Unrestricted access to all fire, police, emergency, utility and other governmental vehicles will be provided. 2. Complete and unrestricted access will be available to all vehicles along said roadway except during the week of the Western Open or other national golf tournaments, except when winter weather conditions require closing of Parker Road for safety reasons. 3. That the Vacation Ordinance from Cook County will indicate that a covenant running with the land shall insure unrestricted and permanent access along Parker Road in perpetuity subject to the provisions in Paragraph 2 above. 4. Cog Hill, its successors and /or assigns, will maintain said roadway and adjacent drainage ditches substantially in the same or better condition as they currently exist. 5. Cog Hill will cooperate with the Village of Lemont and the County of Cook to enforce proper traffic signage along said roadway. Village of Lemont 418 Main Street Lemont,'Illinois 60439 Dear Mr. Mayor: This letter is written to formalize the presentation made to you, Dana Jenkins, Steve Jones and Tim Teddy this morning at the Village Hall. Cog Hill Properties (Cog Hill) has made a request of Cook County to vacate the perpetual easement which was granted to the county in 1928 for highway purposes for the construction and maintenance of Parker Road from Main Street on the North to Archer Avenue on the South. Cog Hill desires that Parker Road become a private road for the following reasons: 1) Provide safer conditions for the 75,000 golfers and other visitors who cross Parker Road each year in golf carts or as pedestrians by installing proper signage and reconfiguration of the road as well as parking. 2) Provide landscaping along Parker Road to beautify the area. 3) Have the right to construct underpasses for safer access for our customers and over 100,000 spectators during the Western Open. Cog Hill will make the following commitments to the Village of Lemont and the County of Cook at the time the 1928 easement is vacated: 1) Provide complete and unrestricted access to all Fire, Police, Emergency, Utility and other Governmental Vehicles on and along Parker Road. 2) Provide complete and unrestricted access to all other vehicles on and along Parker Road except during the week of the Western Open or other National Golf Tournaments, and except when winter weather condition require closing of Parker Road for reasons of safety. (312) 242 -1717 4 - 18 HOLE GOLF COURSES • COMPLETE BANQUET FACILITIES 3) Enter into a convenant running with the land and such other agreements as will ensure unrestricted and permanent access on and along Parker Road even if Cog Hill is sold, in the far distant future, subject of course to paragraph 2 above. 4) Cog Hill will maintain Parker Road and the adjacent drainage ditches in substantially the same or better condition as they have been by Cook County. 5) Cog Hill will agree to annex that portion of the Randquist Property which is situated within the 1928 easement. 6) Cog Hill will work with the Village of Lemont and Cook County to enforce proper traffic signage along Parker Road.
