RESOLUTION AUTHORIZING ADOPTION OF AN AGREEMENT
WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION
FOR CONSTRUCTION OF IMPROVEMENTS TO STATE STREET
BETWEEN 127TH STREET AND PUFFER AVENUE
WHEREAS, the Illinois Department of Transportation has committed resources to
undertake improvements to State Street; and
WHEREAS, the Illinois Department of Transportation has provided the plans and
specifications of the project to the Village of Lemont; and
WHEREAS, the Village concurs with the terms of the agreement and roadway plans.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
that the attached Agreement be approved.
BE IT FURTHER RESOLVED that the Village of Lemont approves the plans and
specifications of State Street (FAU Route 2632 - State Section C -N -1).

AGREEMENT
THIS AGREEMENT entered into this 24th day of January A.D. 199i
by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF
TRANSPORTATION, hereinafter called the STATE, and the Village of Lemont,
County of Cook, of the State of Illinois, hereinafter called the VILLAGE.
W I T N E S S E T H:
WHEREAS, the STATE, in order to facilitate the free flow of traffic and
ensure safety to the motoring public, is desirous of improving approximately
3900 lineal feet of State Street (FAU Route 2632, State Section: C -N -1,
Village Section: 93- 00023- 00 -WR) by making the following improvements:
State Street at 127th Street
Channelization of the intersection, providing for one 12 ft through traffic
lane in each direction on State Street, a 12 ft thermoplastic painted median
with 12 ft and variable width left turn lanes, a 12 ft and variable right turn
lane on State Street for the southbound to westbound movement and also on
127th Street for westbound to northbound movement and installing traffic
signals at the intersection.
State Street north of 127th Street to north of Peiffer Avenue
Widening and resurfacing, providing for one 12 ft through traffic lane in each
direction, a 12 ft center lane for separate left turn movements at dedicated
streets as shown on the plans, installing traffic signals at the State Street
intersection with Keepotaw Drive /Lemont Shopping Plaza, channelizing this
intersection, installing a highway lighting system between 127th Street to
Keepotaw Drive and upgrading the lighting system from Feehauf Street to
Keepotaw Drive, constructing new 5 ft PCC sidewalks along the north side of
127th Street, and the east and west side of State Street, constructing curb
and gutter, and a storm sewer system for highway drainage, and by performing
all other work necessary to complete the improvement in accordance with the
approved plans and specifications; and
WHEREAS, the VILLAGE is desirous of said improvement in that same will be
of immediate benefit to the VILLAGE residents and permanent in nature;
NOW, THEREFORE, in consideration of the mutual covenants contained herein,
the parties hereto agree as follows:
1. The STATE agrees to make the surveys, obtain all necessary rights of way,
prepare plans and specifications, receive bids and award the contract,
furnish engineering inspection during construction and cause the
improvement to be built in accordance with the plans, specifications and
contract.
2. The STATE agrees to pay all right -of -way, construction and engineering
costs, subject to reimbursement by the VILLAGE as hereinafter stipulated,
and except as may be provided in other Agreements between the STATE and
third parties.
3. It is mutually agreed by and between the parties hereto that the estimated
cost of the improvement and cost proration is as shown on Page 2A.
4. The VILLAGE has passed a resolution appropriating sufficient funds to pay
its share of the cost of this improvement, a copy of which is attached
hereto as Exhibit A and made a part hereof.
Upon award of the contract for this improvement, the VILLAGE will pay to
the Department of Transportation of the State of Illinois in a lump sum,
from any funds allotted to the VILLAGE, an amount equal to 95% of its
obligation incurred under this Agreement and will pay to said Department
the remainder of its obligation (including any nonparticipating costs for
FA projects) in a lump sum upon completion of the project, based upon
final costs.
The VILLAGE agrees to pass a supplemental resolution to provide necessary
funds for its share of the cost of this improvement if the amount
appropriated herein proves to be insufficient to cover said cost.

Local participation shall be predicated on the percentages shown above for the
specified work. The local cost shall be determined by multiplying the final quantities
times contract unit prices plus 15% for construction and preliminary engineering.
The Village of Lemont's participation toward traffic signals and highway lighting
relocation shall not exceed $71,375.00 which represents 125% of the estimated
construction and engineering costs for the aforedescribed signals, and highway lighting
relocation.
5. The VILLAGE has adopted, and will put into effect, prior to the STATE
advertising for the work to be performed hereunder, an ordinance requiring
that parking be prohibited, along State Street within the limits of this
improvement, within the VILLAGE limits, a copy of which is attached hereto
as Exhibit B and made a part hereof, and will in the future prohibit
parking at such locations within or immediately adjacent to this
improvement as may be determined by the STATE or be necessary from traffic
capacity studies.
6. The VILLAGE has adopted and will put into effect, prior to the STATE
advertising for the work to be performed hereunder, an appropriate
ordinance prohibiting the discharge of sanitary sewage and industrial
waste water into any storm sewers or drainage facilities constructed as
part of this improvement, a copy of which is attached hereto as Exhibit C
and made a part hereof.
7. Prior to the STATE advertising for the work to be performed hereunder, the
disposition of encroachments will be cooperatively determined by
representatives from the VILLAGE and the STATE.
The VILLAGE has adopted and will put into effect, prior to the STATE
advertising for the work to be performed hereunder, an appropriate
ordinance relative to the disposition of encroachments and prohibiting in
the future any new encroachments within the limits of the improvement, a
copy of which is attached as Exhibit D and made a part hereof.
8. The VILLAGE agrees to adopt a resolution or send a letter, prior to the
STATE advertising for the work to be performed hereunder, approving the
plans and specifications as prepared.
9. The VILLAGE agrees not to permit driveway entrance openings to be made in
the curb as constructed, without the consent of the STATE.
10. The STATE shall cause private utilities to be relocated at no expense to
the STATE or VILLAGE. Where a municipal utility has been installed 1. on
right of way acquired by the STATE or 2. within defined limits of a route

the STATE has accepted for maintenance responsibilities, subsequent to the
date of such acceptance the municipality will bear all utility relocation
or adjustment costs made necessary by the construction of this improvement.
11. Upon completion of the improvement, and final field inspection by the
STATE, and so long as State Street is used as a STATE highway, the STATE
agrees to maintain, or cause to be maintained, the median, the through
traffic lanes, the left turn and right turn lanes, and the curb and gutter
or stabilized shoulders and ditches adjacent to those lanes. The STATE
will be responsible for the maintenance of lane line and median line
markings.
12. Upon final field inspection of the improvement, the VILLAGE agrees to
maintain, or cause to be maintained, those portions of the improvement
which are not maintained by the STATE, including parking lanes and their
adjacent curb and gutter, sidewalks, parkways, guardrails, crosswalk,
stopline marking, and maintenance of the mast arm cross street signing
facing VILLAGE maintained streets, VILLAGE owned utilities, including
appurtenances thereto, highway lighting, including furnishing the
electrical energy therefore, and shall maintain the storm sewers and
appurtenances by:
Performing those functions necessary to keep the sewer in a serviceable
condition, including cleaning sewer lines, inlets, manholes, and catch
basins, along with the repair or replacement of inlet, manhole and catch
basins' frames, grates or lids, plus structural failures to a maximum of
12 feet between adjacent manholes. The maintenance, repair, and /or
reconstruction of storm sewers constructed as part of this improvement
beyond the aforedescribed responsibilities shall be that of the STATE.
13. Upon acceptance by the STATE of the traffic signal work included herein,
the financial responsibility for the maintenance and electrical energy
charges for the operation of the signal(s) shall be proportioned as
follows:

it is mutually agreed that the actual signal maintenance will be performed
by the STATE either with its own forces or through an ongoing contractual
agreement.
It is further agreed that the signals shall be maintained to at least the
Level of Maintenance shown above.
It is understood that Level of Maintenance I meets the minimum
requirements of the Illinois Manual on Uniform Traffic Control Devices for
Streets and Highways and Level of Maintenance II exceeds the manual
requirements and is prescribed for those signals that the District Engineer,
with the concurrence of the Engineer of Operations, determines to require a
higher level of service for adequate operations of the highway system at those
locations.
The STATE agrees to make arrangements with the local power company to
furnish the electrical energy for the operation of the traffic signals. The
VILLAGE agrees to pay its proportionate share of this cost as billed by the
local power company.
The STATE retains the right to control the sequence and timing of the traffic
signals.

If, in the future, the STATE adopts a roadway or traffic signal improvement on
State Street passing through the traffic signal installation included herein
which requires modernization or reconstruction to said traffic signal
installation, then the VILLAGE agrees to be financially responsible, in
accordance with STATE policy for its proportionate share of the costs to
modernize or reconstruct the traffic signal installation in conjunction with
the STATE's proposed improvement.
14. Upon acceptance by the STATE of the new traffic signal installation(s)
included herein, the responsibility for maintenance and energy outlined
above shall become a part of the Master Agreement executed by the State
and the VILLAGE on December 8, 1980.
THIS AGREEMENT and the covenants contained herein shall become null and
void in the event the contract covering the construction work contemplated
herein is not awarded within 3 years subsequent to execution of this Agreement.
THIS AGREEMENT shall be binding upon and inure to the benefit of the
parties hereto, their successors and assigns.
