RESOLUTION AMENDING PROVISIONS OF
EMPLOYEE PERSONNEL POLICY MANUAL
WHEREAS, the Personnel Policy Manual was adopted by the Village of Lemont
through the passage of Resolution #210 and later amended by Resolution #220; and
WHEREAS, it has been determined to be in the Village's best interest to revise the
Manual.
NOW, THEREFORE, BE IT RESOLVED that the following revisions shall be made
to the Personnel Policy Manual:
Section One.
Article 1.3, paragraph 3 shall be revised to read as follows:
On occasion, the Village Board may choose to enter into an employment agreement
with an employee, or a labor agreement with a class of employees. 11 any
provision(s) of such agreement shall conflict with this Personnel Policy Manual, the
provision(s) of the agreement shall govern.
Section Two.
Article 4.3 shall be revised to read as follows:
43 Meal Breaks.
Those employees working a full workday shall be entitled to an unpaid meal break.
Meal breaks are to be scheduled by the department head to insure a minimum
disruption of coverage and departmental work activities. If required by the
department head, some positions may be subject to remaining on the premises
during meal breaks. The break for administrative and clerical employees shall not
exceed one (1) hour duration. The meal break for shift personnel shall not exceed
forty -five (45) minutes, and the meal break for Public Works employees shall not
exceed one -half hour.
Section Three.
Article 4.4, paragraph 4 shall be revised to read as follows:
All overtime must be in accordance with standards established by the department
head. If approved by the department head, compensatory time may be given in lieu
of overtime pay. However, no employee shall accumulate more than one hundred
(100) hours of compensatory time.
Section Four.
Article 4.5 shall be revised to read as follows:
The following positions are exempt from receiving overtime compensation:
Village Administrator
Police Chief
Police Commander
Superintendent of Public Works
Coordinator of Public Works
Treasurer
Community Development Director
Planner
Engineer
Main Street Program Manager
Section Five.
Article 5.5, paragraph 2 shall be revised to read as follows:
New employees shall not be eligible for paid sick leave until thirty (30) days
from the date of hire. Sick leave will be paid in increments of one (1) hour.
Any use of sick leave which is less than one (1) hour will be rounded up to
the nearest whole hour. Unused sick leave as of December 31 of each year
shall be allowed to accrue into a sick leave bank for each employee. The sick
leave bank may be used by the employee should the need for sick leave usage
exceed the annual allocation. The maximum accrual of sick days within the
sick leave bank shall be one hundred eighty (180) days.
Section Six.
Article 5.7, paragraphs 1 -4 shall be revised to read as follows:
5.7 Short-Term Disability/Medical Leave.
If an employee shall require a leave of absence for disability or medical reasons as
defined in the Family & Medical Leave Act of 1993, and such leave extends beyond
any accrued sick leave, vacation, personal days or compensatory time due, the
employee may request to be placed on short -term disability /medical leave status.
During such unpaid leave, the employee may be eligible for disability earnings
subject to the pension and/or insurance policy in force. Any short -term
disability /medical leave shall be documented with a written medical statement.
Approval of short -term disability /medical leave status shall be the role of the Village
Administrator.
Sick leave, vacation, holiday benefits and seniority will not accrue during the short -
term disability /medical leave and the employee's anniversary date shall be adjusted
according to the length of absence. Health and life insurance benefits will be
maintained during the disability leave, according to the provisions of the policy in
effect, and shall be paid by the Village provided that the employee has been
employed for a period of not less than one (1) year, and has worked over one
thousand two hundred fifty (1,250) hours during the previous year. If the employee
receives paid health insurance and does not return to work following the expiration
of the leave, the Village may recover the cost of premiums paid.
11 a short -term disability /medical leave is granted for a period of ninety (90) days
or less, the employee's position will remain vacant until expiration of the leave.
Reinstatement shall only occur if the position has not been eliminated due to
reorganization or budgetary constraints. Unpaid leaves in excess of three (3)
months provide no guarantee of reinstatement to the former position, unless
approved by the Village Administrator.
Upon expiration of a leave of absence in excess of ninety (90) days, the Village
Administrator shall attempt to reinstate the employee to his/her former position or
one that is similar, depending upon qualifications.
The Village will provide written notice of termination to an employee who has not
returned to work within five (5) days after the disability period.
Section Seven.
Article 6.14 shall be revised to read as follows:
6.24 Dress Code.
All employees shall wear appropriate clothing necessary to perform their duties
including interaction with the public. Public Works and Water employees shall wear
shirts and any necessary protective clothing. The Village may provide clothing which
identifies the employee as a representative of the Village.
Sworn Police personnel, and civilian personnel as authorized by the Police Chief,
shall be subject to a uniform voucher system with an annual amount of $400.
