SMOLLEN, Village Clerk INTERGOVERNMENTAL EMERGENCY WARNING SIREN AGREEMENT The Village of Lemont (the "Village ") hereinafter referred to as "Village "), and Lemont Township (the "Township" hereinafter referred to as "Township," through their respective governing bodies under the intergovernmental cooperation provisions of the Illinois Constitution and Chapter 127, Sec. 741 et seq., commonly known as Intergovernmental Cooperation Act, make the following Emergency Warning Siren Agreement and pursuant to that agreement state as follows: WHEREAS, the parties are desirous of entering into an agreement to jointly fund the purchase and relocation of emergency warning sirens; and WHEREAS, it is agreed that there is a mutual benefit to the parties and that cooperation is in the best interest of the taxpayers served by the parties; and WHEREAS, this mutually funded effort will significantly improve the emergency siren coverage within the Village of Lemont and unincorporated areas of Lemont Township. NOW, THEREFORE, both parties mutually agree as follows: L SCOPE OF PROJECT. The project scope and equipment specifications are outlined in Exhibit A. H. LOCATION OF SIRENS. The installation location of new and relocated sirens shall be in general conformance with the sites identified in Exhibit A. If any change is made to the site location for a new or relocated siren, approval by the Village and Township shall be required. III. FUNDING. The funding of 4 emergency sirens will be shared between the Village and Township. The Township share of the purchase and relocation will be $ 40,390 with the Village share being $ 16,179 . If the Village and Township agree to purchase monitoring equipment in the amount of $24,450, the Township share will be $ 17,457 and the Village share will be $ 6,993 . If less than $70,000 is expended on the project, the funding percentage will be as follows: Township 71.4 %; Village 28.6 %. IV. EFFECT OF GRANT AWARD. The Township and Village have submitted a joint grant application for the funding of the siren purchase and installation. If the grant is successful, the award shall be distributed to each governmental agency according to the funding percentages as stated above. V. MAINTENANCE RESPONSIBILITY. The Township shall be responsible for the routine maintenance and operation expenses related to the sirens. This shall include insurance on all units. The Village and Township shall equally fund any major repairs or replacement costs which are not construed to fall within the scope of routine maintenance. VI. ELECTRICAL COST. The Village shall be responsible for initiating electrical service accounts to provide electricity to each of the sirens. The Village shall be responsible for adding the sirens to the Village's free electrical service account as allowed under the franchise agreement with Commonwealth Edison. VIL OWNERSHIP OF SIRENS. The emergency sirens shall be jointly owned by the Township and the Village. VIII. TERM OF AGREEMENT. This agreement shall become effective and be deemed dated when the last of the parties' duly authorized representatives signs as set forth below, and shall expire August 30, 2023.
