AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS HARPER'S GROVE WHEREAS, First United Bank, as Trustee under Agreement dated October 12, 1993, known as Trust No. 1654, hereinafter referred to as "the Petitioner ", is the owner of a 27.5 -acre parcel, hereinafter referred to as "the subject property ", located on the west side of State Street, approximately 1,400 feet south of 127th Street in Lemont, Illinois and legally described as follows: LOT 16 OF COUNTY CLERK'S DIVISION OF SECTION 32, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED IN RECORDER'S OFFICE OF COOK COUNTY, ILLINOIS ON APRIL 30, 1880 AS DOCUMENT 269447 IN BOOK 15 OF PLATS, PAGE 49, IN COOK COUNTY, ILLINOIS. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential Planned Unit Development to be known as HARPER'S GROVE; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on August 3, 1993 for approval of a Residential Planned Development known as HARPER'S GROVE; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Village of Lemont Board of Trustees, after a public hearing as required by law, approved an annexation agreement between the Village and the owner of the subject property, which agreement requires the Village of Lemont to adopt a Planned Unit Development Ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of a Planned Unit Development ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village approve the development of the subject property as a Planned Unit Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1. w • - ca U Q yy++ cD C ) n t i . 5 0_ o a� o n E c o ▪ as a▪ > o N al It NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Planned Unit Development Approval. That a Planned Unit Development be and is hereby approved and granted to allow the Owner or successors or assigns, (collectively referred to as the "Owner ") to construct a Planned Unit Development upon the subject property legally described above pursuant to Owners Preliminary Plans attached hereto as Exhibit A and subject to the following Planning Stipulations: 1. That the zoning classification of the subject property shall be amended from Cook County R -4 Single - family Residence to a Special Use - Planned Unit Development with an underlying zoning of R -4 Single- family Residence. a 0 2. That the property be developed in accordance with the m 0 preliminary plans for no more than 70 single- family , , attached dwelling units (townhomes) and 25 single - family o dwelling units on individual lots. ._ a '> 0 3. That all final engineering plans be approved by the a Village Engineer. .o SECTION 2: Zoning District Change and Variation. The subject property described above be and the same is hereby rezoned from its present Cook County R -4 Single - family Residence Zoning Classification to Planned Unit Development with an underlying zoning of R -4 Single - family Residence District to allow the construction of single- family attached residences (townhomes) in accordance with the Preliminary Plans attached hereto as Exhibit A and the Planning Stipulations identified above. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. Under the Planned Development provisions of the Lemont Zoning Ordinance, a variance is hereby granted to allow a cul -de -sac street in excess of the maximum length of 500 feet required by Section VIII -B -8 of the Lemont Subdivision Regulations Ordinance, as shown on the preliminary plans. THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
