AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW A
NURSING AND REHABILITATION CENTER AS A UNIQUE USE
(Health Care Center of Lemont)
WHEREAS, Century Care Management, Inc., an Illinois
corporation, is the contract purchaser and West Suburban Bank, as
Trustee under Trust Agreement dated May 6, 1985, and known as Trust
No. 8147 is the owner of approximately 10 acres, hereinafter
referred to as "the subject property," generally located southeast
of the intersection of McCarthy Road and Walker Road in Lemont,
Illinois and legally described as follows:
PARCEL 1: THE WEST 196 FEET OF THE SOUTH 78.20 FEET (EXCEPT
THAT PART NORTH OF THE SOUTHERLY LINE OF McCARTHY ROAD) OF THE
SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 27,
TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL
MERIDIAN, AND THAT PART OF LOT 22 IN COUNTY CLERK'S DIVISION
OF SECTION 27, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD
PRINCIPAL MERIDIAN WHICH LIES NORTHERLY OF A LINE DRAWN FROM
A POINT IN THE WEST LINE OF SAID LOT WHICH IS 635.00 FEET
SOUTH OF THE NORTHWEST CORNER OF SAID LOT, TO A POINT ON THE
EASTERLY LINE OF SAID LOT WHICH IS 559.55 FEET SOUTHERLY (AS

PRINCIPAL MERIDIAN, WHICH LIES NORTHERLY OF A LINE DRAWN FROM
A POINT IN THE WEST LINE OF SAID LOT WHICH IS 997.5 FEET SOUTH
OF THE NORTH WEST CORNER OF SAID LOT TO A POINT ON THE
EASTERLY LOT LINE OF SAID LOT WHICH IS 917 FEET SOUTHERLY (AS
MEASURED ALONG SAID EASTERLY LOT LINE) FROM THE NORTHEAST
CORNER OF SAID LOT; AND LYING SOUTHERLY OF A LINE DRAWN FROM
A POINT IN THE WEST LINE OF SAID LOT WHICH IS 635.00 FEET
SOUTH OF THE NORTHWEST CORNER OF SAID LOT TO A POINT ON THE
EASTERLY LINE OF SAID LOT WHICH IS 559.55 FEET SOUTHERLY (AS
MEASURED ALONG SAID EASTERLY LOT LINE) FROM THE NORTHEAST.
CORNER OF SAID LOT IN COOK COUNTY, ILLINOIS.
WHEREAS, Century Care Management, Inc., hereinafter referred
to as "the Petitioner ", filed an application for annexation to the
Village, an amendment of the zoning map classification of the
subject property, and approval of a special use permit to allow a
nursing and rehabilitation center as a unique use; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont,
Illinois conducted a Public Hearing on October 12, 1993 on the
petitioner's request for a special use permit; and

WHEREAS, notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont
Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Village of Lemont Board of Trustees, after a
public hearing as required by law, approved an annexation agreement
between the Village and the owners of the subject property, which
agreement requires the Village of Lemont to approve a special use
permit to allow the establishment of a nursing and rehabilitation
center on the subject property as described herein; and
WHEREAS, the proposed special use - unique use is generally
consistent with the Village Comprehensive Plan; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of an ordinance to approve the special use
permit as specified below; and
WHEREAS, the President and Board of Trustees of the Village
approve the special use permit for the subject property pursuant to
I11.Rev.Stat.Ch.24, 11- 13 -1.1.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Special Use Permit Approval. The Village of Lemont tria
hereby approves a special use permit, to allow the establishment of
a nursing and rehabilitation center as a unique use, subject to the .n
conditions specified below, on the approximate northern five (5)
acres of the property legally described as follows:
PARCEL 1: THE WEST 196 FEET OF THE SOUTH 78.20 FEET (EXCEPT
THAT PART NORTH OF THE. SOUTHERLY LINE OF McCARTHY ROAD) OF THE
SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 27,
TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL
MERIDIAN, AND THAT PART OF LOT 22 IN COUNTY CLERK'S DIVISION

MEASURED ALONG SAID EASTERLY LOT LINE) FROM THE NORTHEAST
CORNER OF SAID LOT IN COOK COUNTY, ILLINOIS.
SECTION 2: Site Plan Approval and Conditions. As a condition
of this special use permit, development of the nursing and
rehabilitation center shall be in accordance with the site plan
attached as Exhibit A. The nursing and rehabilitation center shall
meet the following development regulations:
A. A minimum forty (40) foot side yard setback shall be
provided along the easterly property line;
B. A minimum of eighty (80) off - street parking spaces shall
be provided;
C. The nursing and rehabilitation center shall have a total
gross floor area no greater than 59,000 square feet;
D. The nursing and rehabilitation center shall be allowed a
maximum of 150 beds, plus an additional 10 beds if approved by
the State of Illinois.
E. Landscaping shall be installed in accordance with a final
landscape plan which plan shall be in substantial conformance
with the "Landscape Plan ", dated December 27, 1993, prepared
by Edward Landau, ASLA, for job number 9315.
SECTION 3: Future Development Restricted to Single- family
Detached Residences. As a further condition of this special use
permit, future development on the southern approximately five acres
of the subject property shall be restricted to detached single
family dwellings on individual lots and shall conform to all
applicable zoning and subdivision regulations of the Village of
Lemont.
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS,
