AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF
LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS
BAILEY'S CROSSING
WHEREAS, McBoy Construction Company, an Illinois Partnership,
hereinafter identified as "the Peitioner ", is the contract
purchaser of a 9.3 acre parcel, hereinafter referred to as "the
subject property ", located on the north, or west, side of Archer
Avenue (Illinois Route 171) approximately 1,200 feet northeast of
127th Street in Lemont, Illinois and legally described as follows:
THAT PART OF LOT 22 IN COUNTY CLERK'S DIVISION OF SECTION 27,
TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL
MERIDIAN, WHICH LIES SOUTHERLY OF A LINE DRAWN FROM A POINT IN
THE WEST LINE OF SAID LOT 987.5 FEET SOUTH OF THE NORTH WEST
CORNER OF SAID LOT TO A POINT ON THE EASTERLY LINE OF SAID LOT
WHICH IS 917 FEET SOUTHERLY (SOUTHERLY ALONG SAID EASTERLY
LINE) FROM THE NORTH EAST CORNER OF SAID SUBDIVISION (EXCEPT
THEREFROM THE WEST 409.21 FEET MEASURED PERPENDICULAR TO THE
WEST LINE OF SAID LOT) IN COOK COUNTY, ILLINOIS
WHEREAS, the Petitioner made application under the provisions
of the Lemont Zoning Ordinance for a residential Planned Unit
Development to be known as BAILEY'S CROSSING; and
WHEREAS, the Plan Commission of the Village of Lemont,
Illinois (the "Village ") did heretofore commence and conduct a
Public Hearing on January 4, 1994 for approval.of a Residential
Planned Development known as BAILEY'S CROSSING; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont
Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Village of Lemont Board of Trustees, after a
public hearing as required by law, approved an annexation agreement
between the Village, the title holder of the subject property, and
the Petitioner, which agreement requires the Village of Lemont to
adopt a Planned Unit Development Ordinance as described herein; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of a Planned Unit Development ordinance as
described herein; and
WHEREAS, the President and Board of Trustees of the Village
approve the development of the subject property as a Planned Unit
Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Planned Unit Development Approval. That a Planned
Unit Development be and is hereby approved and granted to allow the
Petitioner, or its successors or assigns, to construct a Planned
Unit Development upon the subject property legally described above
pursuant to Petitioner's Preliminary Plans attached hereto as
Exhibit A and subject to the following Planning Stipulations:
1. That the zoning classification of the subject property
shall be amended from Cook County R -3 Single- family
Residence to a Special Use - Planned Unit Development with
an underlying zoning of R -5 Single - family Residence.
2. That the property be developed in accordance with the
preliminary plans for no more than 38 single- family
attached dwelling units (townhomes).
3. That the petitioner submit Homeowners Association (HOA)
declarations including provisions for repair and
maintenance of all private common area improvements,
including landscaped areas and detention facilities.
4. That all final engineering plans be approved by the
Village Engineer.
SECTION 2: Zoning District Change and Variation. The subject
property described above be and the same is hereby rezoned from its
present Cook County R -3 Single - family Residence Zoning
Classification to Planned Unit Development with an underlying
zoning of R -5 Single - family Attached Residence District to allow
the construction of single- family attached residences (townhomes)
in accordance with the Preliminary Plans attached hereto as Exhibit
A and the Planning Stipulations identified above. The zoningmap of
the Village of Lemont be and the same is hereby amended in
accordance with the provisions of this Ordinance.
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS,
