ORDINANCE APPROVING LEASE
AGREEMENT FOR PROPERTY AT CANAL STREET
AND STEPHEN STREET FOR PARKING AND PARK PURPOSES
WHEREAS, the Village of Lemont has leased property at the southwest corner of
Stephen Street and Canal Street for a number of years; and
WHEREAS, no formal written lease agreement has ever been executed; and
WHEREAS, the Village now seeks to formalize the lease in an effort to modify the
site to re- configure the parking and install a public plaza; and
WHEREAS, the property owner and Village have agreed to lease terms governing
the property for a twenty (20) year term.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
that the lease agreement attached is hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS,

THIS INDENTURE, made this 1st day of May, 1994, between ROBERT S. SNOW
TRUST #2 (FIN #: 36-7056626) d /b /a BUDNIK ENTERPRISES, hereinafter referred to
as Lessor, and VILLAGE OF LEMONT, a Municipal Corporation, hereinafter referred
to as Lessee:
Lessor, for and in consideration of the covenants and agreements hereinafter
mentioned, to be kept and performed. by Lessee, has demised and leased to Lessee, all
those premises situated in the Village of Lemont in the County of Cook and State of
Illinois, known and described as follows, to wit:
Lots 1 and 2 in Block 34 in Village of Keepotaw, a part of the
East 1/2 of the Southeast 1/4 of Section 20, Township 37
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
TO HAVE AND TO HOLD the above described premises, with the appurtenances,
unto Lessee, from the 1st day of May, 1994, to and including the lst day of May, 2014.
AND Lessee, in consideration of the leasing of the premises aforesaid by Lessor to
Lessee, does covenant and agree with Lessor to pay Lessor, as rent for said demised
premises, at the office of ROBERT S. SNOW as Trustee under Trust #2 the sum of TWO
THOUSAND SIXTY DOLLARS AND 00/100 ($2,060.00) per year commencing May 1,
1994 and payable on the lst day of May each year thereafter except that each annual
payment shall be adjusted by the percentage change in the Consumer Price Index (CPI -U)
for the Chicago Area as published by the U.S. Department of Labor for the previous full
calendar year.

The Lessee further covenants and agrees:
1. The Lessee shall be authorized to reconfigure the property in general
conformance with the Plan that is attached hereto as identified as Exhibit "B ",
2. The Lessee shall name the Lessor as additional party insured and shall indemnify
the Lessee in connection with the use of the property and for any acts or omissions by the
Lessee,
3. The Lessee will inform the Lemont Township Assessor of the Public Use of the
property and assist the Lessor in reassessing the real estate value.
4. The Lessee will identify and name the site as the E.F. Budnik Park or the E.F.
Budnik Plaza. Such name shall not be changed during the terms of this Lease.
IT IS FURTHER COVENANTED AND AGREED by and between the Lessor
and the Lessee that the Lessor shall grant a right of first refusal to the Lessee to purchase
the subject property during the term of this Lease. In the event Lessor is desirous of
selling the property during the term of this Lease, he shall notify the Lessee in writing of
his intention to sell the property and provide a copy of any bona fide offers in writing to
the Lessee. The Lessee, upon receipt of said notice shall have 30 days to elect to exercise
its right to purchase said property under the same terms and conditions of the bona fide
offer and in the event the Lessee shall fail to affirmatively respond to said notice, then the
right to purchase the subject property shall terminate and be of no further course and
effect.
IT IS FURTHER COVENANTED AND AGREED that a eopy or a Memorandum
of this Agreement shall be recorded in recordable form with the Cook County Recorder
of Deeds.

IT IS FURTHER UNDERSTOOD AND AGREED that all of the conditions and
covenants contained in this Lease
