WHEREAS, The Metropolitan Sanitray District of Greater chicago,
owns land which is contiguous to the Village of Lemont, Cook County,
Illinois;
WHEREAS, it is in the best interest of the parties that said
land be annexed to and made part of the Village of Lemont;
THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Lemont as follows:
Section 1: That the Village of Lemont hereby annexes the follow-
ing described property pursuant to the attached annexation agreement
dated April 7, 1988
That part of Section 20, Township 37 North, Range 11 East of
the Third Principal Meridian described as follows: All
that part of Lot 213 in Sanitary District Trustees' Sub-
division of Right -of -Way, as recorded March 31, 1908
as Document No. 4180218, lying Westerly of the Westerly
line of Stephen Street of Lemont as extendedland easterly
of a line 500 feet Westerly of and parallel to said
Westerly line of Stephen Street, and lying Southerly
of a line 500 feet Northerly of and parallel to the North-
erly line of the Main Channel of the Sanitary, Drainage
& Ship Canal; and also, that part of Stephen Street and
State Street adjacent to the above described parcel,
all in Cook County, Illinois. All as shown on a Plat of
Annexation attached hereto and made a part hereof.
which is attached hereto and identified as Plat of Annexation to the
Village of Lemomt, Cook County, Illinois, attached hereto and made a
part of this Resolution.
Section 2: The Village President is hereby directed to record
with the Recorder of Deeds and to file with the County Clerk a
certified copy of this Resolution together with the aforementioned

Section 3: This Resolution shall be in full force and effect
after The Metropolitan Sanitary District of Greater Chicago, gives
written consent to this Resolution.

THIS AGREEMENT, made this 7th day of April, 1988, by and between the
VILLAGE OF LEMONT, Cook County, Illinois, a municipal corporation (the
"Village ", and THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO (the
"Owner";
W I T N E S S E T H:
WHEREAS, the Owner is the owner of record of certain real estate
which is located in an unincorporated portion of Cook County, Illinois, and
which is legally described as follows:
That part of Section 20, Township 37 North, Range 11 East of
the Third Principal Meridian, described as follows: All that
part of Lot 213 in Sanitary District Trustees' Subdivision of
Right -Of -Way, as recorded March 31, 1908 as Document No.
4180218, lying Westerly of the Westerly line of Stephen Street
of Lemont as extended and easterly of a line 500 feet Westerly
of and parallel to said Westerly line of Stephen Street, and
lying Southerly of a line 500 feet Northerly of and parallel to
the Northerly line of the Main Channel of the Sanitary,
Drainage & Ship Canal; and also, that part of Stephen Street
and State Street adjacent to the above described parcel, all in

WHEREAS, the Owner and Village desire that the Subject property be
annexed to the Village and zoned under certain terms and conditions and in
the manner herein specified, and it is in the best interests of the Village
that the Subject property be so annexed and developed in accordance with the
provisions of this Agreement; and
WHEREAS, the Owner, and the Village have concluded that the Subject

Property should appropriately be zoned in the M -3 District under the Zoning
Ordinance of the Village; and
WHEREAS, the Owner has presented to and filed with the Village Clerk a
duly executed Petition for Annexation of the Subject property;
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES AND
COVENANTS OF THE PARTIES HERETO, IT IS AGREED BY AND AMONG THE PARTIES HERETO
AS FOLLOWS:
1. The parties hereto respectively agree to do all things
necessary or appropriate to cause the Subject Property to be validly
annexed to the Village as promptly as possible upon the execution of
this Agreement; said annexation to be upon the terms and conditions
set forth in this Agreement.

2. Within 30 days after the annexation of the Subject
Property, the Village agrees to adopt an ordinance zoning the
property as M -3 under the Zoning Ordinance of the Village.
3. As to the Subject property, the Zoning Ordinance will
not be amended or revised so as to prohibit the use of the Subject
Property for its present purposes during the terms of this
Agreement.
4. The Village agrees to comply with the applicable
provisions of the Building Code and all other ordinances and
regulations of the Village, and as the same may be amended from time
to time.
5. Notwithstanding the above, the Village agrees that at
no time during the term of this Agreement will the Village interfere
with any of the lawful operations of the Owner as they affect the
Subject Property, or the Owner's property adjacent to the Subject
Property but not within the corporate limits of the Village.
6. This Annexation Agreement shall be valid and binding
for a period of ten (10) years from the date of this Agreement.
7. This Agreement shall inure to the benefit of and be
binding upon the Owner and Village their successors in title,
assignees, lessees, subsequent developers of the Subject property,
and each of them, and upon the Village and successor corporate
authorities and successor municipalities of the Village.
8. This Agreement shall be enforceable in any court of
competent jurisdiction by any of the parties or by any appropriate
action at law or in equity to secure the performaiumf ttre��•
