RESOLUTION ANNEXING LAND ADJACENT
TO THE VILLAGE OF LEMONT THAT IS OWNED BY
THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO
WHEREAS, The Metropolitan Sanitary District of Greater Chicago,
owns land which is contiguous to the,V.illage of Lemont, Cook County,
Illinois; ' S.
WHEREAS, it is in the best interest of the parties that said
land be annexed to and made part of the Village of Lemont;
THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Lemont as follows:
Section 1: That the .Village of Lemont hereby annexes the
following described property pursuant to the attached annexation

That part of Lot 206 in "Sanitary District Trustees
Subdivision of Right -of -Way from North and South
Centerline of Section 30, Township 39 North, Range
14, East of the Third Principal Meridian to Will
County Line" and the Des Plaines River Diversion
Channel lying Easterly of the 100. -foot wide Right -
of -Way of The Atchison, Topeka and Santa Fe Railroad
Company and Westerly of the 200 -foot wide strip of
land conveyed to Ward T. Huston by the Sanitary
District'of Chicago by deed dated October 16, 1941
and recorded as document No. 12780643 in Book of
Deeds 37059, Page 293, in the Office of the Recorder
of Deeds of Cook County, containing 38.7 acres, more
or less in Cook County, Illinois. All as shown on
Plat of Annexation attached hereto and made a part
hereof.
which if attached hereto and identified as Plat of annexation to the
Village of Lemont, Cook County, Illinois, attached hereto and
made a part of this Resolution.
Section 2: The Village President is hereby directed to record
with the Recorder of Deeds and to file with the County Clerk a
certified copy of this Resolution together with the aforementioned
map of the territory that is attached to this Resolution.
Section 3: This Resolution shall be in full force and effect
after The Metropolitan Sanitary District of Greater Chicago, gives
written consent to this Resolution.
Passed and Approved by the President and Board of Trustees of
the Village of Lemont, County of Cook, Illinois, on this
day of , 1988.

ANNEXATION AGREEMENT
THIS AGREEMENT, made this 7th day of April, 1988, by and between the
VILLAGE OF LEMONT , Cook County, Illinois, a municipal corporation (the
"Village ", THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO (the
"Owner ", and TRI -RIVER DOCKS, INC., (the "Lessee ");
W I T N E S S E T H:
WHEREAS, the Owner is the owner of record of certain real estate
which is located in an unincorporated portion of Cook County, Illinois, and
which is legally described as follows:
That part of Lot 206 in "Sanitary District Trustees Subdivision
of Right -Of -Way from North and South Centerline of Section 30,
Township 39 North, Range 14, East of the Third Principal Meridian
to Will County Line" and the Des Plaines River Diversion Channel
lying Easterly of the 100 -foot wide Right -Of -Way of The Atchison;

which real estate is hereinafter referred to as the "Subject Property "; and

WHEREAS, the Lessee is the lessee of the Subject Property; except that
part thereof lying within the Des Plaines River Diversion Channel; and
WHEREAS, the Subject Property is improved and is not included within the
corporate limits of any municipality, but is contiguous to the Village; and
WHEREAS, the Owner, Lessee and the Village desire that the Subject
Property be annexed to the Village and zoned under certain terms and
conditions and in the manner herein specified, and it is in the best
interests of the Village that the Subject Property be so annexed and
developed in accordance with the provisions of this Agreement; and
WHEREAS, the Owner, Lessee and the Village have concluded that the
Subject Property should appropriately be zoned in the M -3 District under the
Zoning Ordinance of the Village; and
WHEREAS, the Owner and the Lessee has presented to and filed with the
Village Clerk a duly executed Petition for Annexation of the Subject
property;

1. The parties hereto respectively agree to do all thins' cn
necessary or appropriate to cause the Subject Property to be validly...
annexed to the Village as promptly as possible upon the execution of
this Agreement; said annexation to be upon the terms and conditions
set forth in this Agreement.

2. Within 30 days after the annexation of the Subject
Property, the Village agrees to adopt an ordinance zoning the
property as M -3 under the Zoning Ordinance of the Village.
3. As to the Subject Property, the Zoning Ordinance will
not be amended or revised so as to prohibit the use of the Subject
Property for its present purposes during the terms of this
Agreement.
4. The Lessee agrees to comply with the applicable
provisions of the Building Code and all other ordinances and
regulations of the Village, and as the same may be amended from time
to time.
5. Notwithstanding the above, the Village agrees that at
no time during the term of this Agreement will the Village interfere
with any of the lawful operations of the Owner as they affect the
Subject Property, or the Owner's property adjacent to the Subject
Property but not within the corporate limits of the Village.
6. This Annexation Agreement shall be valid and binding
for a period of ten (10) years from the date of this Agreement.
7. This Agreement :shall inure to the benefit of and be
binding upon the Owner and Lessee, their successors in title,
assignees, lessees, subsequent developers of the Subject property,
and each of them, and upon the Village and successor corporate
authorities and successor municipalities of the Village.
