THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO
WHEREAS, The Metropolitan Sanitary District of Greater Chicago,
owns land which is contiguouf to the .illage of Lemont, Cook County,

Illinois;
WHEREAS, it is in the beet 'interest of the parties that said
land be ennexed to and made par.t:of.the Village of Lemont;
THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Lemont as follows:
Section 1: That the Village of Lemont hereby annexes the fol-
lowing described property pursuant tp.the attached annexation
agreement dated April 7, 1988
Lots 207, 208 and 211_ in Sanitary District Trustee's
Subdivision and that part'of the Sanitary, Drainage,
and Ship Canal adjadent,;:o ai.:d Lot 207, excepting
therefrom that part taken .the Atchison, Topeka,
and Santa Fe Railroad ri ght- ways, and also, except-
ing therefrom that part-off lot 207•and 208, that lies
presently in the Village of Lemont, "and also excepting
therefrom that part of Lot 211 lying West of Stephen
Street, all in the North Half of Section 20, Township
37 North, Range 11 East of the Third Principal Meridian,
in Cook County, Illinois.
Also annexed that part of Stephen Street adjacent to
said Lot.
All as shown on a Plat of Annexation attached hereto
and made a part hereof.
which is attached hereto and identified as Plat of Annexation to the
Village of Lemont, Cook County, Illinois, attached hereto, and made
a part of this Resolution.
Section 2: The Village President is hereby directed to record

with the Recorder of Deeds and to file with the County Clerk a
certified copy of this Resolution together with the aforementioned
map of the Territory that is attached to this Resolution.
Section 3: This Resolution shall be in full force and effect
after The Metropolitan Sanitary District of Greater Chicago, gives
written consent to this Resolution.

ANNEXATION AGREEMENT
THIS AGREEMENT, made this 7th day of April, 1988, by and between the
VILLAGE OF LEMONT, Cook County, Illinois, a municipal corporation (the
"Village ", and THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO (the
"Owner ";
W I T N E S S E T H:
WHEREAS, the Owner is the owner of record of certain real estate
which is located in an unincorporated portion of Cook County, Illinois, and
which is legally described as follows:
Lots 207, 208 and 211 in Sanitary District Trustee's
Subdivision and that part of the Sanitary, Drainage, and Ship
Canal adjacent to said Lot 207, excepting therefrom that part
taken for the Atchison, Topeka, and Santa Fe Railroad
right -of -ways, and also, excepting therefrom that part of Lot 207
and 208, that lies presently in the Village of Lemont. and also
excepting therefrom that part of Lot 211 lying West of Stephen
Street, all in the North Half of Section 20, Township 37 North,
Range 11 East of the Third Principal Meridian, in Cook County,
Illinois.
Also annexed that part of Stephen Street adjacent to said Lots
which real estate is hereinafter referred to as the "Subject Property "; and
WHEREAS, the Owner, and the Village have concluded that the Subject.

NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES••Ai1D
COVENANTS OF THE PARTIES HERETO, IT IS AGREED BY AND AMONG THE PARTIES HERETO
AS FOLLOWS:

1. The parties hereto respectively agree to do all things
necessary or appropriate to cause the Subject Property to be validly
annexed to the Village as promptly as possible upon the execution of
this Agreement; said annexation to be upon the terms and conditions
set forth in this Agreement.
2. Within 30 days after the annexation of the Subject
Property, the Village agrees to adopt an ordinance zoning the
property as M -3 under the Zoning Ordinance of the Village.
3. As to the Subject property, the Zoning Ordinance will
not be amended or revised so as to prohibit the use of the Subject
Property for its present purposes during the terms of this
Agreement.
4. The Owner agrees to comply with the applicable
provisions of the Building Code and all other ordinances and
regulations of the Village, and as the same may be amended from time
to time.
5. Notwithstanding the above, the Village agrees that at
no time during the term of this Agreement will the Village interfere
with any of the lawful operations of the Owner as they affect the
Subject Property, or the Owner's property adjacent to the Subject
Property but not within the corporate limits of the Village.
6. This Annexation Agreement shall be valid and binding
for a period of ten (10) years from the date of this Agreement.
7. This Agreement shall inure to the benefit of and be
binding upon the Owner, its successors in title, assignees, lessees,
subsequent developers of the Subject property, and each of them, and
upon the Village and successor corporate authorities and successor
municipalities of the Village. • •••

8. This Agreement shall be enforceable in 4gy court of.

9. If any provision of this Agreement is held invalid,
such provisions shall be deemed excised from this Agreement, and the
invalidity thereof shall not affect any of the other provisions
contained herein.
