WHEREAS, The Metropolitan Sanitary District of Greater Chicago,
owns land which is contiguous to the Village of Lemont, Cook County,
Illinois;
WHEREAS, it-is in the -best of the parties that said land
be annexed to and made part of the Village of Lemont;
THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Lemont as follows:
Section 1: That the Village of Lemont hereby annexes the
following described property pursuant to the attached annexation
agreement dated April 7, 1988
Lot 214, lying East of State Street (F.A.U. Route 2612)
and Lot 205 in Sanitary District Trustees' Subdivision
of Right -of -Way from the North and South centerline
of Section 30, Township 39 North, Range 14 East of the
Third Principal meridian,.to the Will County Line as
recorded March 31, 1908 per document No. 4180218,
excepting therefrom the Atchison, Topeka and Santa
Fe Railroad Right -of -Way- and. excepting therefrom all
that part of the Northwest Quarter of the Northeast
Quarter of Section 20, Township 37 North, Range 11
East of the Third Principal meridian lying North of
the following described line: Beginning at a point
in the North and South center Section line of said
Section which is 211.82 feet South of the Northwest
corner of the Northeast Quarter of said Section;
thence Northeasterly to a point in the North Section
line of said Section which is 509.06 feet East of
the Northwest corner of the Northeast Quarter of said
Section all in Cook County, Illinois.
which is attached hereto and identified as Plat of Annexation to the
Village of Lemont, Cook County, Illinois, attached hereto and
made a part of this Resolution.

Section 2: The Village President is hereby directed to record
with the Recorder of Deeds and to file with the County Clerk a
certified copy of this Resolution together with the aforementioned
map of the territory that is attached to this Resolution.
Section 3: This Resolution shall be in full force and effect
after The Metropolitan Sanitary District of Greater Chicago, gives
written consent to this Resolution.

ANNEXATION AGREEMENT
THIS AGREEMENT, made this 7th day of April, 1988, by and between the
VILLAGE OF LEMONT, Cook County, Illinois, a municipal corporation (the
"Village ", and THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO (the
"Owner ";
W I T N E S S E T H:
WHEREAS, the Owner is the owner of record of certain real estate
which is located in an unincorporated portion of Cook County, Illinois, and
which is legally described as follows:
Lot 214, lying East of State Street (F.A.U. Route 2612) and
Lot 205 in Sanitary District Trustees' Subdivision of Right -of -Way
from the North and South centerline of Section 30, Township 39
North, Range 14 East of the Third Principal meridian to the Will
County Line as recorded March 31, 1908 per Document No. 4180218,
excepting therefrom the Atchison, Topeka and Santa Fe Railroad
Right -of -Way and excepting therefrom all that part of the
Northwest Quarter of the Northeast Quarter of Section 20, Township

WHEREAS, the Metropolitan Sanitary District of Greater Chicago is" the

Owner of the Subject Property;
WHEREAS, the Subject property is improved and is not included within the
corporate limits of any municipality, but is contiguous to the Village; and
WHEREAS, the Owner, and the Village desire that the Subject Property be
annexed to the Village and zoned under certain terms and conditions and in
the manner herein specified, and it is in the best interests of the Village
that the Subject Property be so annexed and developed in accordance with the
provisions of this Agreement; and
WHEREAS, the Owner, and the Village have concluded that the Subject
Property should appropriately be zoned in the M -3 District under the Zoning
Ordinance of the Village; and
WHEREAS, the Owner has presented to and filed with the Village Clerk a
duly executed Petition for Annexation of the Subject property;
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES AND
COVENANTS OF THE PARTIES HERETO, IT IS AGREED BY AND AMONG THE PARTIES HERETO
AS FOLLOWS:
1. The parties hereto respectively agree to do all things
necessary or appropriate to cause the Subject Property to be validly
annexed to the Village as promptly as possible upon the execution of
this Agreement; said annexation to be upon the terms and conditions
set forth in this Agreement.
2. Within 30 days after the annexation of the Subject
Property, the Village agrees to adopt an ordinance zoning the
property as M -3 under the Zoning Ordinance of the Village.
3. As to the Subject property, the Zoning Ordinance will
not be amended or revised so as to prohibit the use of the Subject. •••

6. This Annexation Agreement shall be valid and binding for
a period of ten (10) years from the date of this Agreement.
7. This Agreement shall inure to the benefit of and be
binding upon the Owner, its successors in title, assignees, lessees,
subsequent developers of the Subject property, and each of them, and
upon the Village and successor corporate authorities and successor
municipalities of the Village.
8. This Agreement shall be enforceable in any court of
competent jurisdiction by any of the parties or by any appropriate
action at law or in equity to secure the performance of the
covenants herein contained.
9. If any provision of this Agreement is held invalid, such
provisions shall be deemed excised from this Agreement, and the
invalidity thereof shall not affect any of the other provisions
contained herein.
