SMOLLEN, CLERK Village of Lemont, County of Cook, Illinois • RESOLUTION ANNEXING LAND ADJACENT TO THE VILLAGE OF LEMONT THAT IS OWNED BY THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO WHEREAS, The Metropolitan Sanitary District of Greater Chicago, owns land which is contiguous to the Village of Lemont, Cook County, Illinois; WHEREAS, it is in the best interest of the parties that said land be annexed to and made a part of the Village of Lemont; THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont as follows: Section 1: That the Village of Lemont hereby annexes the property which is attached hereto and identified as Plat of Annexation to the Village of Lemont, Cook County, Illinois, attached hereto and made a part of this Resolution. t. Section 2: The Village President is hereby directed to f4 record with the Recorder of Deeds and to file with the County Cei Clerk a certified copy of this Resolution together with the crk aforementioned map of the territory that is attached to this Resolution. Section 3: That this Resolution shall be in full force and effect after the Governor of the State of Illinois or the governing authority of The Metropolitan Sanitary District of Greater Chicago,'gives written consent to this Resolution. In support of this Petition, petitioners state under oath as follows: 1. The petitioner Metropolitan Sanitary District of Greater Chicago is the sole owner of record of the Subject Property. There are no electors residing thereon at this time. 2. The petitioner Powell Duffryn Terminals, Inc. is the lessee of the Subject Property. 3. The Subject Property is not within the corporate limits of any municipality, but is contiguous to the Village of Lemont. 4. The undersigned hereby respectfully petition for annexa- tion of the Subject Property to the Village of Lemont by ordinance of the President and Board of Trustees of the Village, pursuant to Section 7 -1 -8 of the Illinois Municipal Code as amended. 5. The foregoing notwithstanding, this Petition for Annexa- tion is contingent upon the Village's prior execution of an Annexa- tion Agreement in form agreed to by the petitioners and the Village, whereby the Village agrees to classify the Subject Property within the Village's M -3 Zoning District, and that the Village take such other action, including the adoption of other ordinances, that is appropriate to effectuate said Agreement. 0- DATED this 3 a day of ti -r , 1984.
