A RESOLUTION OF OBJECTION TO COOK COUNTY ZONING BOARD OF
APPEALS REGARDING A REQUEST FOR A SPECIAL USE FOR A PLANNED UNIT
DEVELOPMENT IN R -4 SINGLE - FAMILY RESIDENTIAL DISTRICT -
APPROXIMATELY 76 ACRES LOCATED IN LEMONT TOWNSHIP

WHEREAS, the Village of Lemont is a zoned municipality with
limits near to the property which is the subject matter of a
request for a Special Use in the cause known as Docket Number 5804
before the Cook County Zoning Board of Appeals, said property being
described as follows:
E. 1/2 of NW 1/4 of Sec. 31, T37N, R11, E. of 3rd PM except
E'ly 300.00' of N'ly 726.00' of said NW 1/4 (See ZBA Docket
#5804)
WHEREAS, the boundary of the subject property is within one
and one -half miles of the municipal corporate limits of the Village
of Lemont; and
WHEREAS, the requirements of the Cook County Zoning Ordinance
specify that a Planned Unit Development should provide amenities
and open space beyond the minimum required by law; and
WHEREAS, the Preliminary P.U.D. Plat submitted to the Cook
County Zoning Board of Appeals shows no special site facilities or
amenities and the only park or open space indicated is contained in
three decentralized stormwater ponds; and
WHEREAS, the subject property exhibits no unique features
which would warrant the establishment of a Planned Unit Development
to preserve natural site qualities; and
WHEREAS, the Cook County Zoning Ordinance specifies that the
purpose of a Planned Unit Development is to encourage more creative
and imaginative design than that which would be allowed under
district zoning regulations; and
WHEREAS, the proposed subdivision does not exhibit any
particularly unique or creative design features; and
WHEREAS, the establishment of a Planned Unit Development will
enable the petitioner to circumvent the development review process
of the Village and Township of Lemont, which are the agencies most
directly impacted by the development of the subject property; and
WHEREAS, the subject property is located in a critical
development area for the Village, near the planned 127th Street
interchange of the extension of the I -355 North -South Tollway,
which is expected to be the catalyst for light industrial and
commercial development; and
WHEREAS, as water and sewer are currently unavailable to the
site, County health standards dictate minimum requirements for well
and septic which cannot be met under the standards of the Cook
County R -4 district classification.
NOW THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage and
Will, State of Illinois, that the Village of Lemont hereby objects
in writing to the proposed Special Use.
This Resolution shall be in full force and effect from after
its passage, approval and posting as provided by law.
