Ct S p/7 Peas /Q d VILLAGE OF LEMO T RESOLUTION NO. j DATE 1*' 14 -12- A RESOLUTION OF OBJECTION TO SENATE BILL 1828 RESTRICTING A MUNICIPALITY'S ABILITY TO ASSESS AND COLLECT DEVELOPER EXACTIONS WHEREAS, the Village of Lemont has responsibility for planning, zoning, and development review for those properties located both within the Village and in unincorporated areas within 1 1/2 miles of the corporate limits; and WHEREAS, the Village has, in accordance with expressed community concerns for balanced growth management, emphasized appropriate infrastructure expansion with land development; and WHEREAS, the Village has adopted an ordinance assessing land /cash contributions to ensure that developers share the responsibility for funding of infrastructure expansions caused by their development projects; and WHEREAS, Representative Charles Hartke has sponsored legislation now known as Senate Bill 1828, entitled the Infrastructure Expansion Act, with the stated purpose of setting standards for local governments in assessing and collecting fees and exactions on new development to finance infrastructure expansion; and WHEREAS, the proposed legislation would impose severe restrictions on a municipality's ability to ensure that developers contribute a fair share of the costs of development. NOW THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage and Will, State of Illinois, that the Village of Lemont hereby opposes the adoption of Senate Bill 1828 as written. BE IT FURTHER RESOLVED that the Lemont Village Board fully recognizes the need for a due process regarding the imposition of any development exactions and endorses the process included in the Illinois Statutes and our own municipal ordinances. This Resolution shall be in full force and effect from after its passage, approval and publication as provided by law.
