In accordance with the provisions of the procedures for initiation and execution of the Stipulated Agreement, the parties will execute the agreement within 60 days from the date of mailing and return it to our office or the terms of the agreement shall be renegotiated or declared void. Box 19280, Springfield, Illinois 62794 -9280 STATE OF ILLINOIS ILLINOIS COMMERCE COMMISSION STIPULATED AGREEMENT This agreement made and entered into, by and between the State of Illinois acting by and through the Illinois Commerce Commission, hereinafter referred to as the "Commission ", the Illinois Central Railroad Company, hereinafter referred to as the "Company ", the Village of Lemont, hereinafter referred to as the "Village" and the State of Illinois, Department of Transportation, hereinafter referred to as the "Department ". WITNESSETH: WHEREAS, it has come to the attention of the Commission through informal correspondence that inquiry should be made into the matter of improving public safety at the crossing of the Company's tracks with public highways known as Industrial Street, Lemont Street, Stephens Street (maintained by Department), Holmes Street, and Spruce Street all located in the Village of Lemont, Cook County, Illinois, designated as crossings DOT 289738E, milepost 25.8 AO, DOT 289736R, milepost 25.17 AO, DOT 289735J, milepost 25.10 AO, DOT 289734C, milepost 24.95 AO, and DOT 289733V, milepost 24.71 respectively; and WHEREAS, proper investigation has been made of the circumstances surrounding the aforesaid crossings by a staff member of the Commissions Transportation Division, Railroad Section; and WHEREAS, the physical aspects, including geometrics of the intersections, train movements, vehicular traffic volume, and sight distances and all other pertinent data relating to the crossings has been obtained and is shown on Exhibits A, A -1, A -2, A -3, and A- 4 attached to the agreement; and WHEREAS, the parties are mutually agreeable to accomplish the proposed improvements upon a determination of the Commission by order. NOW, THEREFORE in consideration of the premises and of the mutual covenants and agreements as hereinafter contained the parties pray that the Commission enter an order according to the provisions of Section 18c -7401 of the Illinois Commercial Transportation Law requiring that certain improvements as hereinafter stated be made and that the cost for the proposed improvements be divided among the parties according to law and that in the interest of the statewide traveling public the Grade Crossing Protection Fund of the Motor Fuel Tax Law be required to bear a substantial portion of the cost; To Wit the parties agree as follows: Section 1 All improvements encompassed by this agreement shall be made in accordance with all applicable State laws, rules, standards, regulations and orders and procedures in general. Section 2 The parties are of the opinion that the proper improvements in the interest of public safety at the aforesaid crossings should be: Industrial Street (DOT 289 738E, milepost 25.8 AO) (1) Install constant warning time circuitry in lieu of existing circuitry. Lemont Street (DOT 289 736R, milepost 25.17 AO) (1) Install constant warning time circuitry in lieu of existing circuitry. Stephens Street (maintained by Department) (DOT 289 735J, milepost 25.10 AO) (1) Install constant warning time circuitry in lieu of existing circuitry. (2) Install one (1), sixty six foot (66') rubber crossing surface and one (1), seventy eight foot (78') rubber crossing surface. Holmes Street (DOT 289 734C, milepost 24.95 AO) (1) Install constant warning time circuitry in lieu of existing circuitry. Spruce Street (DOT 289 733V, milepost 24.71 AO) (1) Install constant warning time circuitry in lieu of existing circuitry. Section 3 The Company has prepared preliminary estimates of cost to accomplish the proposed improvements which it may be required to perform, said estimates are attached as Exhibits B, B- 1, B -2 , B -3, B -4 and B -5 and shall upon order according to the requirements contained therein prepare detailed drawings, detailed circuit plans, estimates of cost and any required specifications for the proposed improvements for the approval of the Commission and Department. Section 4 The Company shall upon order, according to the requirements contained therein, proceed toward the completion of the proposed improvements, accomplishing the work with its own forces or appropriate contracted services and agrees that an appropriate time for the submission of plans should be one hundred twenty (120) days, for the submission of progress reports should be six (6) months and for the completion of the proposed improvements should be twelve (12) months, from the date of Commission order subsequent to this agreement. Section 5 The parties hereto agree that an equitable division of cost for the proposed improvements should be: Industrial Street A. the cost for the installation of the constant warning time circuitry estimated to be $96,560 should be allocated whereby the Department is to bear 90% of the actual cost utilizing Federal Highway Safety Act Funds (Fed. Fund) and the Company should bear all remaining installation cost as well as all future operation and maintenance cost thereof; Lemont Street A. the cost for the installation of the constant warning time circuitry estimated to be $114,480 should be allocated whereby the Department is to bear 90% of the actual cost utilizing Fed, Fund, 10% not to exceed $11,448 should be borne by the Grade Crossing Protection Fund (Fund) and the Company should bear all cost which exceeds that being borne by the Fund as well as all future operation and maintenance cost thereof; Stephens Street (maintained by Department) A. the cost for the installation of the constant warning time circuitry estimated to be $143,350 should be borne 100% by the Department with the Company bearing all future operation and maintenance cost thereof; B. the cost to install the rubber crossing surfaces as detailed in Section (2) herein estimated to be $77,490 should be borne 100% by the Department with the Company bearing all future maintenance cost thereof; Holmes Street A. the cost to install the constant warning time circuitry estimated to be $106,740 should be allocated whereby the Fund should bear 75% of that cost not to exceed $80,055 and the Company should bear all remaining installation cost as well as all future operation and maintenance cost thereof; Spruce Street A. the cost to install the constant warning time circuitry estimated to be $109,230 should be allocated whereby the Fund should bear 75% of that cost not to exceed $81,922 and the Company should bear all remaining installation cost as well as all future operation and maintenance cost thereof; Section 6 This agreement shall be binding upon the parties hereto, their successors or assigns. Upon execution of this agreement by all parties, the Commission shall enter an appropriate order, within 60 days accepting or rejecting such stipulation according to the provisions contained herein. Section 7 _Special provisions. Since federal funding is being utilized for the circuitry improvements and crossing surfaces at the Stephens Street crossing, all such work shall be covered by appropriate provisions of Title 23, Chapter I, Subchapter G, Part 646 of the Federal -Aid Policy Guide adopted Dec. 9, 1991. Since the crossing surface and circuitry work at the Stephens Street (maintained by Department) crossing will be performed by railroad crews, no flagging or contractor liability insurance will be required for said work.
