ORDINANCE NO.
ORDINANCE AMENDING CHAPTER 9.44 OF
THE MUNICIPAL CODE OF LEMONT ENTITLED "TRESPASSING"
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
that the Municipal Code of Lemont 1983 be amended to include the following:
CHAPTER 9.44
SECTIONS:
9.44.01 Acts constituting trespassing designated.
9.44.02 Trespassing prohibited.
9.44.03 Violation -- Penalties.
9.44.01 ACTS CONSTITUTING TRESPASSING DESIGNATED.
The following acts by any person, firm, or corporation shall be deemed included
among those that constitute a trespass:
(a) No person shall enter upon the land or a building, or any part thereof, of
another after receiving, prior to such entry, notice from the owner, occupant or occupant's
authorized agent, person in charge of such land, or peace officer that such entry is
forbidding, or remain upon such land or building, or any part thereof, of another after
receiving notice from the owner, occupant, owner or occupant's agent, person in charge of
such land or peace officer to depart.
(b) A person has received notice from the owner, occupant, owner or occupant's
agent or peach officer within the meaning of subsection (a) if that person has been notified
personally, either orally or in writing, or if a printed or written notice forbidding such entry
has been conspicuously posted, exhibited, or plainly visible at the main entrance or
entrances to such land or the forbidden part thereof.
(c) For the purpose of this article, "peace officer" means any person who, by virtue
of office or public employment, is vested by law with a duty to maintain public order or to
make arrests for offenses, whether that duty extends to all offenses or is limited to specific
offenses.
(d) The pursuit of a course of conduct or action incidental to the making of an
entry upon the land of another in violation of a notice posted or exhibited at the main
entrance to such premises, or at any point of approach or entry, or in violation of any
notice, warning or protest given orally or in writing by any peach officer, owner, or
occupant thereof.
(e) A failure or refusal to depart from the premises of another in case of being
requested, either orally or in writing, to leave by any peace officer, owner or occupant
thereof.
(f) Any entry into or upon any vehicle, aircraft or watercraft made without the
consent of a person having the right to the possession or control thereof, or a failure or
refusal to leave any such vehicle, aircraft or watercraft after being requested to leave by
the person having such right.
9.44.02 TRESPASSING PROHIBITED.
It is unlawful for any person, firm or corporation to commit a trespass within this
municipality upon either public or private property.
9.44.03 VIOLATION — PENALTIES.
Any person, firm or corporation violating any of the provision of this chapter shall,
upon conviction thereof, be fined in an amount not exceeding Five Hundred Dollars
($500.00) and /or community service.
This Ordinance shall be in full force and effect from and after its passage, approval
and publication in the manner provided by law.
All ordinances or parts of ordinances in conflict herewith shall be and the same are
hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.
