AN ORDINANCE ADOPTING THE AMENDED
ZONING ORDINANCE
OF THE VILLAGE OF LEMONT
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, Will, and DuPage, State of Illinois:
WHEREAS, a certain document, three (3) copies of which are on file in the offices of the
Village of Lemont, being marked and designated as "THE LEMONT ZONING ORDINANCE"
is hereby adopted as the Zoning Ordinance of the Village of Lemont in the State of Illinois; and
WHEREAS, the purpose of the Zoning Ordinance is regulating development within the
corporate limits and extraterritorial jurisdiction, and the public health, safety, and general welfare
within the Village of Lemont; and
WHEREAS, the Ordinance is intended to be used in conjunction with the Village of Lemont
Comprehensive Plan, Design Standards, Building Codes, and Subdivision Regulations; and
WHEREAS, Ordinance Number 426 and its subsequent amendments, commonly known as
the Lemont Zoning Ordiannce 1980, are hereby repealed; and
WHEREAS, Ordinance Number 801 and its subsequent amendments, commonly known as
the Lemont Fence Code are hereby repealed; and
WHEREAS, the Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.

construction work, or within six months from the date of the permit
- whichever is sooner. If the construction continues beyond the six
month limit herein set forth, the Community Development Director
may grant extensions of six (6) months each time.
3. Boats
In a Residential District one boat owned by the occupant of the dwelling
and which is not more than 24 feet in length may be stored or parked in
the open on a lot containing a dwelling, provided that it shall be stored
within the buildable area, or, if stored in the back yard, it is stored in a
garage, carport, screen shelter, or similar structure designed so as to
substantially conceal the boat from the view of adjoining property owners;
and provided further that no substantial repair, disassembly or rebuilding
operations are conducted thereon.
4. Commercial Vehicles
Trucks and other commercial vehicles with "C" thru "Z" plates shall
not be permitted to park or to be stored in any residential district,
except when located in a garage, in a fully enclosed structure or in
a manner as to substantially conceal it from the view of adjoinin
property owners if parked in the rear yard area. Any vehicles wit]
external equipment shall not be permitted to park in any residentia
district. All governmental vehicles are exempt from then
restrictions.
b. Small vans, pickup trucks, and other similar vehicles made to
transport passengers with a capacity not to exceed fifteen (15) seats
shall be considered private passenger vehicles, and shall be exempted
from the provisions of Subsection K -4 of this Section.
SEWERAGE AND WATER SYSTEMS
1. Utilities Required. Each use hereafter established which requires sewerage
and water facilities shall be served by public or community sewerage and
water systems, except as hereinafter provided.

Private System Standards. Installation of individual sewage disposal
systems and private wells or community sewerage and water systems shall
be in accordance with standards and specifications set forth in applicable
laws of the Village, County, and State.
4. Lot/Area Standards. A lot that was not a lot of record on the effective date
of this ordinance, which is to be used for a single - family detached dwelling
served with an individual sewerage disposal system shall have an area of
not less than one acre and a width of not less than 150 feet or a greater
area or width if required to conform with regulations contained in this
Section.
5. Newly Annexed Areas. In the case of newly annexed areas, the Village
Board may waive the requirement of connecting to public utilities for a set
time as stated in the annexation agreement, or may waive such
requirements only until the municipal water and sewer services are
provided to the area, provided, however, that there is an irrevocable
commitment by the owner(s) that the connections shall be made to a
public or community sewerage and water system not less than one (1) year
after such system has been installed or extended to within 100 feet of the
property line.
K. FLOOD- PLAIN AREA
All buildings and structures shall be located to conform with the Village Flood

In order to implement these requirements, a statement of the
number of proposed occupants, a copy of the necessary
licenses, if any are required, and a floor plan depicting the
number of bedrooms shall be submitted. If any of the
requirements in this section cannot be met, a Special Use
shall be required.
i. Accessory Uses
Daycare Homes urp to six (6) children at one time`under

2. Special Uses
a. Cellular telephone, telephone exchange and microwave relay towers;
b. Cemeteries and mausoleums, excluding crematories - -on a lot not
less than ten (10) acres in area and provided no building shall be
located less than 300 feet from a lot line.
c. Colleges, universities and accessory uses thereto - -- on a lot not less
than ten (10) acres in area and provided no building is located less
than 200 feet from a lot line.
d. Churches, temples and synagogues.
e. Golf courses, standard; but not including "par 3" golf courses,
commercially operated driving ranges, or miniature golf courses, and
provided that no club house or accessory building shall be located
less than 200 feet from a lot line.
f. Group houses not meeting the Standards of Section VII- B -1 -h.
g. Hospitals -- provided no building shall be located less than 100 feet
from a lot line.
h. Planned Developments -- residential.

not less than 25 feet in width and 40 feet in width

(3) Rear Yard - not less than 30 feet.
b. Other permitted uses
(1) Front Yard - not less than 40 feet.
(2) Side Yards - two side yards each not less than 25 feet in
width, except on corner lots, the side yard adjoining a street
shall not be less than 40 feet in width. For structures more
than 75 feet in length, measured perpendicular to the front
lot line, the interior side yards shall be increased in width by
one (1) foot for each two (2) feet the building exceeds 75 feet
in length. For buildings more than 35 feet in height, each
side yard shall be increased in width by one (1) foot for each
additional two (2) feet of building height over 35 feet.
(3) Rear Yard - not less than 30 feet.
8. Off - Street Parking and Off - Street Loading
In accordance with regulations set forth in Section XII.

SECTION XIV
FENCES
A. DEFINITION
For the purposes of this section, the definitions of terms contained in the
LemontZoning Ordinance shall apply to those terms as used in this section.
Certainother terms are hereby defined as follows:
1. A comer side yard is that portion of a lot extending from the front yard to
the rear lot line and lying between a lot side street line and a line drawn
parallel to said lot side street line at a distance equal to the required
setback from the lot side street line under the applicable regulations of the
Lemont Zoning Ordinance or the actual setback of the principal building
line, whichever is greater.
2. A fence is any structure, other than an enclosed building, forming a barrier
or boundary between lots, between a lot and any street or alley, or between
portions of a lot or lots, including a recreational fence.
a. Fence, Decorative: Decorative fences shall be limited to wood rail
fences, ornamental iron fences, picket fences, and other similar
styles as determined by the Community Development Director
and/or Building Commissioner. No shadow box or board -on -board
fencing is permitted. A decorative fence shall not be solid in design.
Fence, Natural: A fence made of natural growth, such as deciduous
shrubs, hedges, evergreen bushes etc., exceeding ten (IO) feet in
length but not including deciduous or evergreen trees.
c. Fence, Recreational: A fence used principally as a backstop, shield,
or enclosure for a sport or recreational activity.
d. Fence, Man Made Material: Wood, chain link, iron, and similar
materials.

7. Recreational Fences
Any person may petition to the Planning Si Zoning Commission of Appeals
for a permit to construct a recreational fence which would not conform to
any one of the requirements of this section. Such petition, and the
Planning SL Zoning Commission review of the decision on such petition,
shall comply with the requirements of Section A of this Ordinance.
8. Natural Fences Shall Be Restricted as follows:
a. No natural fence shall be planted within, nor shall such natural
fence encroach upon, or extend over, any dedicated right -of -way of
any street, sidewalk or alley.
b. No person shall maintain a hedge, shrub or tree on any portion of
his property which interferes with clear view of traffic or pedestrians
by drivers on streets or in driveways.
c. Natural fences planted in front yards along interior and front lot
lines shall not exceed three (3) feet in height.
d. Natural Fences shall not encroach over adjacent lot lines.
9. Nonconforming Fences
All fences existing and lawfully constructed under previous Ordinances,
maintained in good repair but not in conformance with the provisions of
this Ordinance shall be deemed nonconforming fences and may continue
to exist. Such fences shall be kept in good repair; however, if required,
repairs should have to be made to 50% or more of the fence, a permit shall
be required and the fence shall be removed totally or reconstructed totally
so as to be in conformance with this ordinance.
10. Dumpster Enclosures
All new construction which has dumpsters exceeding one (1) cubic yard
shall be fully enclosed and constructed of masonry or wood material only.
Dense landscape screening may be substituted for fencing upon approval
by the Community Development Director. Existing properties with
dumpsters shall not be required to be screened, but shall have secured lids.

4. Street Banners. Street banners advertising a public entertainment or event,
if specifically approved by the Community Development Director and only
for locations designated by the Community Development Director, during
and for the fourteen (14) days before and three (3) days after the event.
5. Window Signs. Window signs shall be permitted in Business Districts
provided the sum total of all window signs shall not exceed forty percent
(40 %) of the total area of the windows in which they are located and
provided further that such window signs shall not be illuminated or have
any moving parts. A series of windows which are separated by frames and
supporting material of less than six inches (6 ") in width shall be considered
as a single window for the purpose of computation.
Development Signs: Development signs, containing only the name of the
development, the address and telephone number of the owner or agent, the
number, size type and price of lots and/or units, not exceeding one hundred
(100) square feet in area. Maximum height to the top of such signs shall
be fifteen (15) feet. One such sign shall be permitted for each
thoroughfare or highway frontage of the development. Development signs
shall be removed within seven (7) days after 90% of the lots are issued
temporary or permanent certificates of occupancy.
7. Obstructions and Traffic Hazards: Signs shall not be placed in the vision
corridor as it is defined in the applicable section of the Zoning Ordinance.
8. Certain temporary signs and attention- getting devices such as banners,
pennants, valance, or advertising display constructed of cloth, canvas, light
fabric, cardboard, wall board or other light material may be permitted for
promoting special community activities, special promotional sales, special
events, or activities subject to the following provisions:
a. Seasonal (Holiday) Signs: Christmas Signs are allowed from Nov.
1st to Jan 10th; Any other Seasonal (holiday) Signs are allowed 30
days before and 10 days after the holiday;
b. Special Sale Signs: Displayed for thirty (30) days. After the thirty
day period, a different temporary sign may be displayed. Following
the special event a 30 -day period shall be imposed prior to the

c. Public signs and other signs incidental thereto for identification,
information, or directional purpose erected or required by
governmental bodies, or authorized for a public purpose by any law,
statute, or ordinance.
14. Temporary signs such as political campaign signs, real estate signs,
construction signs, etc., shall be in accordance with the ordinances of the
Village of Lemont.
15. Professional nameplates shall not exceed one (1) square foot in area. not
exceeding two (2) square feet in area indicating the address and occupant
of said dwelling.
16. Portable or sandwich signs providing that they meet the standards of this
ordinance.
17. Non - Conforming Signs. All Non - Conforming signs shall follow provisions
outlined in Section I< of this Ordinance.
18. Boundary: All properties fronting Stephen Street from the Illinois and
Michigan Canal right -of- way to Illinois Street; all properties fronting
Talcott Avenue from Stephen Street to Holmes Street, all properties
fronting Canal Street from Stephen Street to Lemont Street; all properties
fronting the south right -of -way of Canal Street from Lemont Street to "old"
State Street; all properties fronting Lemont Street from Illinois and
Michigan Canal to Illinois Street; all properties fronting Main Street from
Fremont Street to Lockport Street; all properties fronting Fremont Street
from Main Street to Illinois Street; all properties fronting Illinois Street
from Lockport Street to Fremont Street; This boundary is congruent with
the Downtown B -2 zoning.
19. Any B -2 properties located outside of the downtown district shall comply
with the commercial/office sign standards as noted in Section XV -E.
E. COMMERCIAL/OFFICE SIGN STANDARDS:
The following signs shall be permitted in the Village subject to all applicable
standards for the following districts: B -1, B -3, B -4 and ORI districts:
1. Purpose and Applicability. These provisions are intended to provide for

examination and treatment of persons on an outpatient basis.
CLOSED CUP FLASH POINT: The lowest temperature at which a
combustible liquid under prescribed conditions will give off a flammable vapor
which will propagate a flame. The Tag closed cup tester shall be authoritative
for liquids having a flash point below 175 °F. The Pensky - Martens tester shall
be authoritative for liquids having a flash point between 175 °F. and 300 °F.
CLUB OR LODGE. PRIVATE: A non - profit association whose facilities are
restricted to persons who are bona fide members and their guests. Foodand
alcoholic beverages may be served on its premises provided they are seondary
and incidental to the principal use.
COMMUNITY DEVELOPMENT DIRECTOR: The Community
Development Director of Lemont, Illinois, or a duly authorized representative.
CONFORMING BUILDING OR STRUCTURE: A building or structure
which: (a) complies with all the regulations of this ordinance or of any
amendment thereto governing bulk of the district in which said building or
structure is located; and (b) is designed or intended for a permitted or
conditional use as allowed in the district in which it is located.
CORPORATE FLAGS: Corporate flags when flown in conjunction with the
flag of the United States of America, provided such corporate flag is no larger
than 24 square feet in area.
COURT: An open unoccupied space other than a yard on the same lot with a
building or group of buildings, and which is bounded on two or more sides by
such building or buildings.
DAYCARE CENTER Any child care facility, licensed by the Illinois
Department of Children and Family Services (IDCFS), which regularly
provides day care for less than 24 hours per day for more than six children,; o
more in a facility other than a family home.
DAYCARE HOME Any child care facility, which regularly provides day care
for less than 24 hours per day for a maximum of 6 children in a family'
including children up to the age of 12 permanently residing in the home.
Daycare homes with more than 3 children must be licensed by the Illinois
Department of Children and Family Services (IDCFS) where applicable.

Daycare homes will also be subject to the zoning ordinance pr
regulating home occupations.
DECIBEL: A unit of measurement of the intensity or loudness of sound.
Sound level meters employed to measure the intensity of sound are calibrated
in decibels. A decibel is technically defined as twenty times the logarithm to
the base ten of the ratio of the sound pressure in microbars to a reference
pressure of 0.0002 micro bar.
DISPLACEMENT (earth): The amplitude or intensity of an earthborn
vibration measured in inches. The displacement or amplitude is one -half the
total earth movement.
DRIVE -IN ESTABLISHMENT: An establishment or part thereof in which
are provide d facilities where serving or consuming commodities or both are
intended to occur primarily in patrons' automobiles parked on the premises.
DUPLEX: A dwelling joined to one other dwelling by a party wall, or vertical
cavity wall, and above - ground physically unifying horizontal structural
elements.
DWELLING: A building, or portion thereof, designed or used exclusively for
residential purposes, including single - family, two - family, and multiple - family
dwellings, but not including mobile homes or other trailers, or lodging rooms in
hotels, motels, or lodging houses.
DWELLING, ATTACHED: A dwelling joined to two other dwellings by
party walls, or vertical cavity walls, and above ground physically unifying
horizontal structural elements.
DWELLING, DETACHED: A dwelling which is surrounded on all sides by
open space on thesame lot.
DWELLING, SEMI - DETACHED: A dwelling joined to one other dwelling
by a party wall, or vertical cavity wall, and above - ground physically unifying
horizontal structural elements.
DWELLING, SINGLE - FAMILY: A dwelling containing one dwelling unit.
DWELLING, TWO- FAMILY DETACHED: A dwelling containing two

EQUIVALENT OPACITY: The shade on the Ringelmann Chart that most
closely corresponds to the density of smoke, other than black or gray.
FALLOUT SHELTER: An accessory building and use which incorporates the
funda mentals for fallout protection - shielding mass, ventilation, and space to live
- and which is constructed of such materials, in such a manner, as to afford to the
occupants substantial protection from radioactive fallout.
FAMILY: One (1) person or two (2) or more persons each related to the other
by blood, marriage, or legal adoption, or a group of not more than three persons
not all so related, together with his or their domestic servants, maintaining a
common household in a dwelling unit. A family may include, in addition thereto,
not more than two (2) roomers, boarders, or permanent guests - whether or not
gratuitous.
FENCE: Any structure, other than an enclosed building' , forming a barrier or

from a right angle.
FENCE, SEMI -OPEN: A fence which is designed and constructed to allow the
free movement of air through the fence.
FENCE, SOLID OR CLOSED: A fence which effectively conceals from viewers
in or on adjacent properties or rights -of -way, materials and activities beyond said
