ORDINANCE NO. O-2, 97
WHEREAS Ryan Companies, US, Inc., hereinafter referred to as "the Petitioner ", is the
owner of an approximately 34 acre parcel, hereinafter referred to as "the subject property", located
on the northwest corner of 135th Street and Archer Avenue in Lemont, Illinois and legally described
in Exhibit "A ".
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance for a Commercial Planned Unit Development to be known as TARGET/KOHL'S
SHOPPING CENTER; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois (the
"Village ") did heretofore conduct a Public Hearing on August 4, 1998, August 18, 1998 and October
6, 1998 and subsequently recommended approval on October 20, 1998 of a Commercial Planned
Development known as TARGET /KOHL'S SHOPPING CENTER, and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by
law and was published in the Lemont Reporter Progress, a newspaper of general circulation within
the Village; and
WHEREAS, the Village of Lemont Board of Trustees, after a public hearing as required by
law, approved an annexation agreement between the Village and the owner of the subject property,
which agreement requires the Village of Lemont to adopt a Planned Unit Development Ordinance
as described herein; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by the adoption of a Planned Unit Development ordinance as
described herein; and
WHEREAS, the President and Board of Trustees of the Village approve the development
of the subject property as a Planned Unit Development pursuant to ILCS (1994) 65 5/7 -1 -8.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Zoning Man Amendment from Cook County R -4 Residence District to Lemont
PUD B-3 Commercial District. The Zoning Map is amended from Cook County R-4 Residential
District to PUD B -3 Commercial District for the Commercial Tract (East Parcel) as legally described
in exhibit "A ", and to PUD R -4 Single - family Residential District for the Residential Tract (West
Parcel) as legally described in exhibit "A ".
SECTION 2: Zoning District Change and Variation. A Special Use Permit for a Commercial
Planned Development is hereby granted for the use of the east parcel of the subject property as a
Shopping Center. Said commercial planned development shall be subject to conditions specified
herein:
1. Variation is being requested per the parking provision "Shopping Centers are required to
provide two times the required number of parking spaces ", pursuant to Section X. -Off Street
Parking 12.d. of the Lemont Zoning Ordinance. The petitioner is requesting a waiver
from this standard;
2. Variation is being requested to increase the depth of the detention ponds, from four (4)
feet to an estimated 6.6 feet, pursuant to Section 7. Storm water Management and Storm
Sewer, 7.02A. 7 &9 of the Subdivision Design Standards.
3. Variation is requested to allow a total of parking spaces to be 8.5 feet wide instead
of the minimum required 9 feet, pursuant to Section X -D -3 of the Lemont Zoning Ordinance.
SECTION 3: Permitted Uses and Special Uses.
The development shall be permitted to have such Permitted and Special Uses as listed in Exhibit "B ".
Any such changes to the use list shall be subject to public hearing by the P &Z Commission and
approval by the Village Board.
SECTION 4: Conditions of Approval. The development shall be subject to the conditions as stated
in Exhibit "C ".
SECTION 5: Setbacks. All buildings and parking lots shall meet setback requirements for exterior
property lines of the development only except as noted in Exhibit '`C ".

EXHIBIT C
CONDITIONS:
1. Approvals shall substantially conform to the Site Plan, as attached as exhibit "D ", Landscape
Plan, as attached as exhibit "E" (as amended), Preliminary Engineering, as attached as exhibit
"F' (as amended), Architectural Elevations (including materials on all sides of the buildings),
as attached as exhibit "G" and western property boundary schematic elevations, as attached
here as exhibit "H", except as such plans may be changed to conform to all Village codes,
ordinances and the conditions below. The Target Center building. foot print and/or square
footage may be reconfigured upon review and approval by the Village Board. (Following
final plan amendments, all plans shall be attached with specific plan numbers, designers
name(s), date of plans, and document or I.D. number of the plans);
Cross parking agreements between site users shall be required, as attached as part of the plat,
since separate ownership tracts are being proposed;
3. Specific permitted uses shall be granted approval as part of this petition, inclusive of the
Commercial Center and all Outlots. All uses proposed shall conform to the permitted use
section as attached as exhibit `B ", subject to amendment by the Village Board. All uses
proposed in this development shall require staff review for compliance;
�. The Lemont Fire District shall approve the location of the tire hydrants for the project;
5. IDOT, Will County Highway Department and Cook County Highway Department review and
approvals are required for access onto Archer Avenue, State Street and 135th Street;
The triangle section of land along. State Street owned by Cook County should be
incorporated into the design and approvals of the Center. Staff recommends if the Village
or Petitioner should receive title on the property all improvements, easements and
landscaping on the triangle property be incorporated into Village approvals;
Fire Hydrants and water valves are required at the end of all dead end mains.
Permits are required from IDNR. MW RD and all appropriate governmental agencies for the
construction of detention, parking areas in Fioodplain and Floodwav areas and utility
crossings over IDNR regulated watervays;
A Nationwide Permit (N P) from the Army Corp. Of Engineers shall be required for any
wetland excavation. if applicable.

All approvals shall be subject to the implementation of mitigation techniques intended
to reduce any pollutants discharged from the site, including road salt, motor oil and
other substances discharged into Long Run Creek. Engineering plans shall reflect the
installation of a vortex or infiltrator system at locations determined by the Village
Engineer. The systems shall be monitored and cleaned periodicallv. The detention
ponds shall indicate the planting of a salt - tolerant native specie to establish natural
filtration of the storm water. The native species shall be approved by the Village
Engineer and t,-S Army Corps of Engineer;
11. A fence shall be incorporated into the screening design adjacent to the western
properties and north of the retaining wall adjacent to the ComEd utility easement north
of the subject property. The details shall be provided on the site plan indicating the
location, height and style of the fence proposed. The fencing is intended for the
purpose of safety because of the difference in grade elevations to the adjacent properties
and shall be installed after completion of the retaining walls;
12. Approvals shall be subject to a separate Final Plat of Subdivision for the eight (3) lot
residential subdivision and Final Plat of Subdivision shall be required for the main
shopping center site;
13. Approvals shall be subject to the anr.exation of the property north of the Target
Development as to create appropriate contiguity, as per Illinois State Statute;
14. A preliminary Photometric Plan has been provided to the Village. It has been agreed
that the westerly sector of the commercial portion of the PI D shall exceed no greater
than one -tenth of one footcandle at the property line prior to landscape screening.
Footcandle calculations shall be required at the property lines and site shall not exceed
the Villages minimum standards for lighting, as approved by the Village Engineer prior
to final approval;
15. Sidewalks and parkway trees shall be provided along 135th Street, Archer Avenue and
the triangle section of property along State Street, currently owned by Cook County;
16. Signage specifications, location of free - standing signs, including size, *materials and
landscaping, as attached as Exhibit "_ ", inclusive of the following:
i. A limit of two ; 2 Free- Standing Signs for the site. one I ` at the southerly
Archer Avenue entrance and one (1 ) at the 135th Street entrance. The free -
standing signs shall be a maximum of eight (8; feet in height and a maximum of
60 square feet of sign area. Furthermore, the proposed Outiots shall be in
accordance with the new sign standards, permitting one (1) free - standing sign
per tract ownership;
Total on- buldin; signage shall be based on a maximum of one 1) square foot of
si -n area per l:..near fcot of building frontage This standard will limit the si
area to appro:.- -nattily 1.200 square feet of sizn area for the Center. Staff

would also recommend that signage be restricted to the front of the building
only, except that there shall be no more than three (3) s grts of uniform size
permitted on the eastern elevation of the Target Center, facing State Street, not
exceeding one square foot of sign per each linear foot of the eastern face of the
building. These sibs shall only advertise the eastern three (3) units of the
building. However, in no circumstances shall the total on- building signage
exceed 1,200 square feet for the Target Center. No location restrictions for on-
building signage location is being recommended for either Outlots;
iii. Maximum sign area for both Outlots shall be based on the linear frontage along
Archer Avenue. Based on this limitation, signage would be restricted to 275
square feet of sign area for Oudot "D" and 270 square feet for Oudot "E ".
iv. All on- building signage for the Target`Kohl's Center, including Outlots, shall be
limited to individual letter type signs. No box signage shall be peimitted.
17. A two (2) year limitation shall be imposed to receive final approval for the Site
Development Permit Grading Permit. beginning on the day the project receives Village
Board final approval. Any extensions to this time limit shall require Village Board
approval;
13. Approvals shall be subject to the amended Landscaping Plan, as revised to incorporate
the recommendations from the Village's Landscape Consultant, as recommendations
attached here to as exhibit "1 ";
19. Building Elevations shall be amended to incorporate "Limestone -like Columns" on the
western section of the Center, as depicted on the remainder of the building. Elevations
shall include all specific materials and design features to be incorporated on the Center's
facade including rough limestone features. a "stepped -back" enu-vwav, elliptical canopy
and horizontal bands of limestone or limestone like material, a spring arch "supported"
by columns at either side of the Kohl's entryway. The easternmost portion of the
structure shall incorporate pediments (the wide, low pitched gables at eh parapet line
above the entries.) The three entryways shall include limestone piers through the
stepped -back entry for the largest of the three smaller users. All architectural elevations
shall be contingent on Village Board approvals. Architectural elevations are attached as
exhibit "(y

A detention system maintenance agreement shall be developed and submitted for
Village approval, establishing ownership and maintenance arrangements for the on -site
detention basins and drainage structures, pursuant to the Village's Engineering
Consultants review and approval by the Village Engineer. The design of each detention
basin shall include fountain systems intended to service as an aesthetic and functional
objective, as approved by the Village Engineer;
2 l . All approvals shall be contingent on engineering approval in accordance with the Village
Engineer and the Village's Engineering Consultant as it applies to storm water
discharge;

22• The petitioner has agreed to development and implement safety measures for the
detention ponds basins. These details shall be provided incorporating landscape
screening for the pond on the southwest corner of the property intended to screen the
western property owners. Other safety measures are proposed to the interior of the
ponds incorporating shallow perimeter grades to help prevent abrupt grade changes;
23. All approvals shall be subject to historic lighting fixtures being installed along the front
of the Target Center, the parking lots, entrances along Archer Avenue and 135th Street,
and both Outlots. The locations shall be incorporated on the Site Plan, as attached as
exhibit "L ". The lighting standards shall be similar to the downtown lighting
standards, attached as exhibit "K ";
24. All approvals shall be subject to product delivery times limited to local carriers from
8:00 A.M. to 8:00 P.M., Monday - Friday. There will be no weekend or holiday
delivery hours. The only exception shall be Christmas hours (Thanksgiving through
December 25) as delivery times shall be extended to 24 hours, Monday - Friday.
Overnight deliveries are not permitted. These limitations shall apply to each business
including the Outlots.
25. Store hours shall be limited to 8:00 A.M. to 10:00 P.M., daily. Special hours shall
apply on holidays and pre- Christmas. Stores will be closed on Easter Sunday,
Thanksgiving Day and Christmas Day.
26. Noise standards shall be limited to the following: The Target rooftop mechanical units
shall produce 58 dB(A) above ambient levels at 15 -feet from the source; the Target and
all compactors shall produce no greater than 50 dB(A) above ambient levels at 100 -feet
from the source.

The Village's Landscape Consultant has reviewed the revised landscape plans (dated 9/24/98) for the Target site and has the
following comments /recommendations:
1) The western property line needs additional landscaping to more adequately buffer future adjacent residential
development.
a. Extend the row of canopy trees (currently ending at about 6 +50) to the northern property line - these trees
should consist primarily of taller - growing deciduous trees, spaced approximately 1 5 -feet off center.
b. Plant an additional row of trees in a staggered pattern along the west face of the fence to create a more
effective buffer - these trees should consist primarily of medium - height dense evergreen trees, spaced
approximately 10 -feet off center.
c. Spruce up the area (in front of the "evergreen backdrop ") with additional ornamental plantings. Some .
landscaping suggestions are for small flowering trees, shrubs, perennial beds, etc.
2) The western side of the southwestern detention pond (section 0 +00 to 2+00) could also use additional landscaped
screening, similar to the scheme proposed above.
3) While the selection and diversity of plantings for the overall site is good and works well in the more formal areas
(entranceways, parking lot and building), the informal areas (detention areas and western property line) need some
additional variety:
a. Species suggestions for the western property line include: oaks, Kentucky coffee tree, sugar maple, buckeye,
hornbeam, hickory and catalpa. These trees are more woodland like and would make for an interesting and
appealing contrast to those on the rest of the site.
b. Species suggestions for the detention areas include water- loving trees such as river birch or bald compress.
Please address these suggested modifications in a revised landscape plan for the site. Feel free to call me with any questions.

RE: Case Number 98.22. Request for approval for the Annexation, zoning change from R -3,
Cook County to B -3, Planned Unit Development, as a Special Use, Preliminary Plat approval
for a six (6) lot Commercial Subdivision, Preliminary Plat approval for an eight (8) lot
residential subdivision for the property generally known as the Target Center.
Dear Mayor Kwasneski and Village Trustees:
The Planning and Zoning Commission conducted a public meeting on August 4, public
hearings on August 18 and October 6, 1998. Also the Commission conducted a public
workshop on October 20, 1998. The petitioner, Ryan Companies, US, Inc., contract purchaser
of the property is requesting approval to construct 272,900 square feet of
commercial/retail/general merchandising center, including outlots, for the property located at
the northwest corner of Archer Avenue and State Street. The petition consists of the following
items; Annexation of the property and rezoning from R -4, Cook County Residential to B -3,
General Commercial District. with a Special Use for a PUD for 30.11 acres; a rezoning of 3.60
acres from R -4, Cook County Residential to R -4, Lemont Single Family Residential;
Preliminary Plat approval for a six (6) lot Commercial Subdivision; and a Preliminary Plat
approval for a eight (8) lot single family residential subdivision.
The petitioners request includes as part of the PUD two (2) variances. A variance request to
the Subdivision Design standards requesting relief to increase the depth of the detention ponds,
from the four (4) foot requirement to an estimated five and one half (51/2) feet; the second
variance request is to the Lemont Zoning Ordinance asking relief to the parking provisions, as
stated "Shopping Centers are required to provide two (2) times the required number of parking
spaces."
The Commission heard testimony by the Village Planner, the petitioner and representatives of
the petitioner. Approximately 60 members of the public spoke against the project while
approximately five (5) citizens spoke in favor. Those speaking against the proposal expressed
concerns about the following issues: environmental impacts to Long Run Creek; screening and
buffering adjacent to the residents north and west of the subject property; intrusion of light
onto adjacent properties; noise that will be intruding onto the neighboring property as a result
of the air conditioning units and the internal traffic; the increase traffic congestion as a result of
the project and the impact to the region; the appropriateness of the land use for this proposal;
safety concerns as a result of the construction of the retaining walls being constructed adjacent
to the property owners to the west and north of the subject property; the negative impact to
the property values for the residents to the west of the subject property; the negative traffic
impact to the adjacent roadways and to 135th Street.

Following careful review and detailed consideration of the proposal, the Planning and Zoning
Commission voted 6 -0 -1 in favor of the project (Ron Stapleton abstaining) , for the following:
the Annexation the entire 33.71 acres; a zoning change from R -4. Cook County to B -3,
Planned Unit Development, as a Special Use for the eastern 30.11 acres and a zoning change
for 3.60 acres from R -4, Cook County Residential to R -4, Lemont Single Family Residential;
Preliminary Plat approval for a six (6) lot Commercial Subdivision; Preliminary Plat approval
for an eight (8) lot residential subdivision. All approvals by the Commission are subject to the
following conditions:
1. Approvals shall substantially conform to the Site Plan, as attached as exhibit "_",
Landscape Plan, as attached as exhibit "" (as amended), Preliminary Engineering, as
attached as exhibit "" (as amended), Architectural Elevations (including materials on
all sides of the buildings), as attached as exhibit "_" and western property boundary
schematic elevations, as attached here as exhibit "", except as such plans may be
changed to conform to all Village codes, ordinances and the conditions below. The
Target Center building foot print and/or square footage may be reconfigured upon
review and approval by the Village Board. (Following final plan amendments, all plans
shall be attached with specific plan numbers, designers name(s), date of plans, and
document or I.D. number of the plans);
?. Cross parking agreements between site users shall be required, as attached as part of the
plat, since separate ownership tracts are being proposed;
3. Specific permitted uses shall be granted approval as part of this petition, inclusive of the
Commercial Center and all Outlots. All uses proposed shall conform to the permitted
use section as attached as exhibit "", subject to amendment by the Village Board. All
uses proposed in this development shall require staff review for compliance;
4. The Lemont Fire District shall approve the location of the fire hydrants for the project;
5. IDOT, Will County Highway Department and Cook County Highway Department
review and approvals are required for access onto Archer Avenue, State Street and
135th Street;
The triangle section of land along State Street owned by Cook County should be
incorporated into the design and approvals of the Center. Staff recommends if the
Village or Petitioner should receive title on the property all improvements. easements
and landscaping on the triangle property be incorporated into Village approvals;
The water main should be extended to the west property line along 135th Street and
preferable looped to the proposed residential development. Fire Hydrants and water
valves are required at the end of all dead end mains. The server main on 135th Street
should be extended to the western property line. if it is found to be possible to have this
used as a gravity flow- sewer:
S. Permits are required from IDNR. MWRD and all appropriate governmental agencies for

the construction of detention, parking areas in Floodplain and Floodway areas and
utility crossings over IDNR regulated waterways;
9. A Nationwide Permit (NWP) from the Army Corp. of Engineers shall be required for
any wetland excavation, if applicable;
10. All approvals shall be subject to the implementation of mitigation techniques intended
to reduce any pollutants discharged from the site, including road salt, motor oil and
other substances discharged into Long Run Creek. Engineering plans shall reflect the
installation of a vortex or infiltrator system at locations determined by the Village
Engineer. The systems shall be monitored and cleaned periodically. The detention
ponds shall indicate the planting of a salt - tolerant native specie to establish natural
filtration of the storm water. The native species shall be approved by the Village
Engineer and US Army Corps of Engineer;
11. A fence shall be incorporated into the screening design adjacent to the western
properties and north of the retaining wall adjacent to the ComEd utility easement north
of the subject property. The details shall be provided on the site plan indicating the
location, height and style of the fence proposed. The fencing is intended for the
purpose of safety because of the difference in grade elevations to the adjacent properties
and shall be installed after completion of the retaining walls;
12. Approvals shall be subject to a separate Final Plat of Subdivision for the eight (8) lot
residential subdivision and Final Plat of Subdivision shall be required for the main
shopping center site;
13. Approvals shall be subject to the annexation of the property north of the Target
Development as to create appropriate contiguity, as per Illinois State Statute;
14. A preliminary Photometric Plan has been provided to the Village. It has been agreed
that the westerly sec-tor of the commercial portion of the PUD shall exceed no greater
than one -tenth of one footcandle at the property line prior to landscape screening.
Footcandle calculations shall be required at the property lines and site shall not exceed
the Villages minimum standards for lighting, as approved by the Village Engineer prior
to final approval;
15. Sidewalks and parkway trees shall be provided along 135th Street, Archer Avenue and
the triangle section of property along State Street, currently owned by Cook County;
16. Signage specifications, location of free - standing signs, including size, materials and
landscaping, as attached as Exhibit "_", inclusive of the following:
i. A limit of two 2 i Free - Standing Signs for the site. one (l) at the southerly
Archer Avenue entrance and one (1) at the 135th Street entrance. The free-
standing signs shall be a maximum of eight (8) feet in height and a maximum of
60 square feet of sign area. Furthermore. the proposed Outlots shall be in

accordance with the new sign standards, permitting one (1) free - standing sign
per tract ownership;
ii. Total on- building signage shall be based on a maximum of one (1) square foot of
sign area per linear foot of building frontage. This standard will limit the sign
area to approximately 1,200 square feet of sign area for the Center. Staff
would also recommend that signage be restricted to the front of the building
only, except that there shall be no more than three (3) signs of uniform size
permitted on the eastern elevation of the Target Center, facing State Street, not
exceeding one square foot of sign per each linear foot of the eastern face of the
building. These signs shall onlv advertise the eastern three (3) units of the
building. However, in no circumstances shall the total on- building signage
exceed 1,200 square feet for the Target Center. No location restrictions for on-
building signage location is being recommended for either Outlots;
iii. Maximum sign area for both Outlots shall be based on the linear frontage along
Archer Avenue. Based on this limitation, signage would be restricted to 275
square feet of sign area for Outlot "D" and 270 square feet for Outlot "E ".
iv. All on- building signage for the Target/Kohl's Center, including Outlots, shall be
limited to individual letter type signs. No box signage shall be permitted.
17. A two (2) year limitation shall be imposed to receive final approval for the Site
Development PermitiGrading Permit, beginning on the day the project receives Village
Board final approval. Any extensions to this time limit shall require Village Board
approval;
18. Approvals shall be subject to the amended Landscaping Plan, as revised to incorporate
the recommendations from the Village's Landscape Consultant, as recommendations
attached here to as exhibit " ";
19. Building Elevations shall be amended to incorporate "Limestone -like Columns" on the
western section of the Center, as depicted on the remainder of the building. Elevations
shall include all specific materials and design features to be incorporated on the Center's
facade including rough limestone features, a "stepped -back' entryway, elliptical canopv
and horizontal bands of limestone or limestone like material, a spring arch "supported"
by columns at either side of the Kohl's entryway. The easternmost portion of the
structure shall incorporate pediments i the wide. low pitched gables at eh parapet line
above the entries.) The three entryways shall include limestone piers through the
stepped -back entry for the largest of the three smaller users. All architectural elevations
shall be contingent on Village Board approvals. Architectural elevations are attached as
exhibit
20. A detention system maintenance agreement shall be developed and submitted for
Village approval, establishing ownership and maintenance arrangements for the on -site
detention basins and drainage structures. pursuant to the Village's Engineering

Consultants review and approval by the Village Engineer. The design of each detention
basin shall include fountain systems intended to service as an aesthetic and functional
objective, as approved by the Village Engineer;
21. All approvals shall be contingent on engineering approval in accordance with the Village
Engineer and the Village's Engineering Consultant as it applies to storm water
discharge;
22. The petitioner has agreed to development and implement safety measures for the
detention ponds basins. These details shall be provided incorporating landscape
screening for the pond on the southwest corner of the property intended to screen the
western property owners. Other safety measures are proposed to the interior of the
ponds incorporating shallow perimeter grades to help prevent abrupt grade changes;
23. All approvals shall be subject to historic lighting fixtures being installed along the front
of the Target Center, the parking lots, entrances along Archer Avenue and 135th Street,
and both Oudots. The locations shall be incorporated on the Site Plan, as attached as
exhibit "_". The lighting standards shall be similar to the downtown lighting
standards, attached as exhibit
24. All approvals shall be subject to product delivery times limited to local carriers from
8:00 A.M. to 8:00 P.M., Monday - Friday. There will be no weekend or holiday
delivery hours. The only exception shall be Christmas hours (Thanksgiving through
December 25) as delivery times shall be extended to 24 hours, Monday - Friday.
Overnight deliveries are not permitted. These limitations shall apply to each business
including the Outlots.
25. Store hours shall be limited to 8:00 A.M. to 10:00 P.M., daily. Special hours shall
apply on holidays and pre - Christmas. Stores will be closed on Easter Sunday,
Thanksgiving Dav and Christmas Day.
26. Noise standards shall be limited to the following: The Target rooftop mechanical units
shall produce 58 dB(A) above ambient levels at 15 -feet from the source; the Target and
all compactors shall produce no greater than 50 dB(A) above ambient levels at 100 -feet
from the source.

Simon Batistich, the petitioner's attorney, reviewed the concept plan for the
petitioners.
Mr. Batistich said that the shop contains all surface mount lifts, not hydraulic lifts.
Mr. Metzger said that he is concerned with noise, especially for the residents to
the north. The petitioner, Mike Principe, said that the rear door is usually closed,
but there would be the possibility of it being open during the summer. Chairman
Duffy asked if venting could be installed to minimize the need to keep the rear
door open. Mr. Principe said that he would definitely look into it. Chairman Duffy
suggested to keep the front door open so noise would be projected to 127th
Street. Mr. Principe said that an air ratchet produces 102 decibels which is the
loudest piece of equipment he operates. Mr. Studebaker said that he stood
outside a similar business and the only noise he heard was the wrench that
takes the lugnuts off of tires.
Mr. Studebaker said that the photos presented to the commissioners by a
resident at the last meeting were of auto repair shops, not of a similar use to this
request, and wanted to make a comment out of fairness to the petitioner.
Mr. Stapleton said that this request is blatant spot zoning, is not an appropriate
use for the area and does not follow the Comprehensive Plan. Mr. Stapleton
does not like the noise that would be generated with the rear door open and the
need for another auto related repair shop with 12 others in Lemont is dubious.
Ms. Pearson shares the same concerns as Mr. Stapleton.
Mr. Bruce said that B -1 zoning should remain.
Ms. Murphy said that the plan is nice, but agrees with Mr. Stapleton and Mr.
Bruce.
A motion was made by Ms. Murphy and seconded by Ms. Pearson to approve
case number 98.23 Request for Rezoning from B -1 Neighborhood Shopping
District to B -3 Commercial District and a Special Use to allow the operation of a
garage for automobile repairs on the north side of 127``' Street, west of Walter
Street, known as Pepper's Automotive, along with staff recommendations and
other attachments. Motion denied 2 -5, with Mr. Studebaker and Chairman Duffy
in favor.
B. 98.22 Request for Special Use fora Planned Unit Development and
Variances as part of the P.U.D. Ordinance, Rezoning from Cook County R-4 to
B -3, General Commercial for 30.38 acres, Rezoning from Cook County R-4 to R-

4 Single Family Residential, Lemont (3.6 acres) and Preliminary Plat for an eight
(8) lot Single Family Subdivision and a five (5) lot Commercial Subdivision, for
Target/Kohl's Construction, located at 135t Street and Archer Avenue.
Mr. Perry said that a number of outstanding issues from the last meeting were
put together in a memo by Michael Malicki and are included in staffs report.
Mr. Malicki said that he needed to address some corrections to the memo
addressed to Mr. Perry dated October 13, 1998. Mr. Malicki said that there is a
request for two free standing signs, not three signs as referenced in the memo.
Mr. Malicki said that there is one entrance on 135th Street, not two entrances as
referenced in the memo.
Mr. Malicki said that he concurs with all but one sign recommendation for no
signage on the side of the building. Mr. Malicki said that the small user on the
east end of the property may require a sign on the front and side of the building
in order to be seen.
Matt Anderson, of Joseph Schudt and Associates, said that for the on -site storm
water management, a CSR hydro conduit will be placed in the last or second to
last manholes to trap pollutants. The infiltrator will be maintained yearly.
Mr. Malicki said that the photometric study originally submitted was for the
western area and they are currently working on the eastern area.
Mr. Malicki said that a fence is not allowed at the west property line due to the
floodway, and are looking into alternate ideas.
Mr. Malicki said the they can work with the Village on the color of the light poles.
Mr. Malicki said that the light poles proposed for the parking lot are
approximately 30 feet in height. Ms. Murphy said that it should be possible to get
historic looking lights with 35 foot poles and double headers. Mr. Malicki said
that he can look into it and it will not be a problem in the gateways.
Mr. Malicki said that if they can't work with the county, the walk will end as
proposed. Mr. Malicki said that sidewalks are incorporated around the entire
perimeter of their property.
Chairman Duffy asked about the progress of the water management studies. Mr.
Malicki said that their engineers met with the Village Engineer and Eric Gil of
Christopher Burke Engineering and also had a productive meeting with the
Illinois Department of Transportation.
I■;1r. Stapleton asked if there is a problem with a monument sign in the floodway.
Mr. Gil said that a monument sign is an appropriate use of a floodway.

Chairman Duffy asked about the noise levels of the rooftop mechanicals. Mr.
Malicki said that he got the information from the Target design handbook. Mr.
Malicki said that any noise would most likely impact the proposed residences
and not the existing residents. Mr. Malicki said that the sound level is well within
the criteria.
Ms. Pearson said that she was okay with the 4% foot detention, but has a
concern with the 51/2 foot detention. Warren Opperman, of Joseph Schudt and
Associates, said that there will be a safety ledge about 5 to 10 feet wide, which
would prevent a child from slipping in all the way to the bottom.
Mr. Metzger asked about the proposed fencing on the west and north. Mr.
Metzger said that he is not usually in favor of fencing, but is concerned about
safety in this case with such a steep drop off. Mr. Malicki said that a fence would
be a screen to residents and a safety precaution but would much rather have
landscaping because it is easier to maintain, but also believes a fence is
necessary. Mr. Malicki said that he does not recall a fence being proposed along
the north right -of -way, but mainly along the proposed residences. Chairman
Duffy suggested.a tapered fence at the north for warning purposes. Chairman
Duffy said to seriously look into fencing and to make it a condition.
Mr. Metzger asked if there will be enough room for vegetation to grow in the
parking landscape areas. Jeff Martin, of Teska, said that the landscape areas
are four feet by four feet and vegetation will grow nicely.
Mr. Malicki said that they are dropping the tree preservation variance request
and will survey the entire site. The remaining two variances are to increase the
depth of the detention ponds from 4 feet to 5% feet and a waiver to the parking
provision standards.
Mr. Buening requested that there be a maximum formula for the leftover square
footage for the signage at the east end of the property. Mr. Stapleton is in favor
of side signage for one store or all three stores as long as it's not too big. Ms.
Pearson and Ms. Murphy agree. Mr. Metzger is not in favor of signage. Mr.
Studebaker is in favor of one sign for the smallest building. Mr. Bruce said that if
there is more than one sign, there should be uniformity. Chairman Duffy said that
staff should make the judgment.
Mr. Buening reviewed the changes and additions to staff recommendations. Mr.
Buening said that recommendation number 11 should be changed from "If the
Commission chooses to incorporate a fence" to "A fence shall be incorporated
into the design for the western and northern properties; details shall be provided
indicating the location, height and style of the fence proposed. Fencing for safety
purposes shall be erected along the north and west retaining wall after

completion of the retaining walls."
Mr. Buening said that recommendation number 15 should be changed to read,
"Sidewalks and parkway trees shall be provided along 135th Street, Archer
Avenue and State Street, deleting "If the Commission chooses to waive this
requirement for any section, staff recommends cash -in -lieu of construction."
Mr. Buening said that the third sentence of staff recommendation number 16 ii
should be changed to read, "Staff would also recommend that signage be
restricted to the front of the building and the east side of the easternmost unit
which shall have up to three uniform design signs for the easternmost tenants.
The sign area shall not exceed one square foot for each linear foot of building
space." Mr. Buening said that the square footage for the three signs is not in
excess of 1200 square footage allowed for the shopping center.
Mr. Perry said that "arriation" should be added to staff recommendation number
20.
Mr. Buening said that number 24 should be added to staff recommendation and
should read, "Light fixtures of a decorative nature shall be incorporated to the
development plans. Said fixtures shall be of similar character to the street lights
on Main Street. Fixtures shall be located at the entrances to the development
and in front of the buildings."
A motion was made by Mr. Metzger and seconded by Mr. Studebaker to approve
case number 98.22 Request for Special Use for a Planned Unit Development
and Variances as part of the P.U.D. Ordinance, Rezoning from Cook County R-4
to B -3 General Commercial for 30.38 acres, Rezoning from Cook County R-4 to
R-4 Single Family Residential, Lemont (3.60 acres) and Preliminary Plat for an
eight (8) lot Single Family Subdivision and a five (5) lot Commercial Subdivision,
at 135''' Street and Archer Avenue, known as Target/Kohl Construction, along
with attachments, twenty four (24) conditions of staff recommendations as
amended, a variance to the parking provision that shopping centers are required
to provide two times the required number of parking spaces and a variance to
the Subdivision Design Standards to increase the depth of the detention ponds
from four (4) feet to an estimated five and a half (5'/z) feet. Motion carried 6 -0 -1,
with Mr. Stapleton abstaining.
