ORDINANCE AUTHORIZING ACQUISITION AND CONDEMNATION
OF THE PROPERTY LOCATED AT 313 CANAL STREET
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/11- 74.4 -4 grants the authority to
municipalities to acquire property by eminent domain within Redevelopment Project Areas; and
WHEREAS, a building commonly known as 313 Canal Street is located in the
Redevelopment Area has been unoccupied and abandoned in excess of 20 years and is
dysfunctional and in a state of disrepair; and
WHEREAS, the Lemont Village Board has determined that it is reasonably necessary to
achieve the objectives of the Redevelopment Plan and Project by acquiring fee simple title to
certain property with the Redevelopment Area commonly known as 313 Canal Street, Lemont
Illinois, together with any and all improvements located on said property; and
WHEREAS, the real property the Village is in need of acquiring is legally described in
"Exhibit A ", attached hereto and incorporated herein by reference; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Lemont, Cook, Will and DuPage Counties, Illinois, in exercise of the authority granted
to it pursuant to 65 ILCS 5/11- 74.4-1 as follows:
SECTION 1: The Village Attorney, John P. Antonopoulos, of the Village of Lemont is
hereby authorized and directed to negotiate with the owner(s) of the subject property to determine
a fair and reasonable price for compensation for the acquisition of the subject property.
SECTION 2, If an agreement with respect to the compensation for the acquisition of the
subject property cannot be reached in a timely manner, the Village Administrator is hereby
authorized and directed to commence eminent domain proceedings to acquire the subject
property.
SECTION 3: This Ordinance shall be in full force and effect from and after its passage
and approval as provided by law.
