ORDINANCE VACATING PART OF SMITTY AVENUE RIGHT -OF -WAY
(North of McCarthy Road and East of Steeples Road)
WHEREAS, it is proposed to vacate an unimproved 50 foot wide public street right -of -way north of
McCarthy Road and East of Steeples Road in Lemont, Illinois; and
WHEREAS, this street is not being used by the Village to access any property; and
WHEREAS, the Village Trustees of the Village of Lemont conducted a public hearing pursuant to
notice in connection with said vacation; and
WHEREAS, no evidence was presented in objection to said vacation and it is in the best interest of
the Village of Lemont to vacate said street right -of -way,
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of
Lemont that the following described property be vacated in favor of and transferred to the abutting property
owner to the North of:
THE NORTHEASTERLY 50.00 FEET OF SMITTY AVENUE AS DEDICATED BY DOCUMENT
NUMBER 10847697 BEING PART OF THE NORTHEAST QUARTER OF SECTION 27,
TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, LYING
SOUTHEASTERLY OF THE EASTERLY LINE OF STEEPLES ROAD AS SHOWN ON THE
PLAT OF FIALA - CHOWANIEC'S THE STEEPLES RESUBDIVISION PHASE I, BEING A
RESUBDIVISION OF PART OF SAID NORTHEAST QUARTER OF SECTION 27, AND LYING
NORTHERLY OF THE NORTH LINE MC CARTHY ROAD, ALL IN COOK COUNTY,
ILLINOIS.
Except that:
1. The Village of Lemont hereby reserves an easement over, under and across the southwest 20 feet
of said vacated right -of -way for public facilities and drainage.
2. This Ordinance shall not become effective until the owner of the abutting property to the North
pays $85,000 per acre vacated to the Village, and after payment of said amount, title to the vacated right -of-
way shall vest in said adjoining property owner.

This Ordinance shall be in full force and effect from and after its passage, approval and publication
in the manner provided by law.
All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause
the same to be published in pamphlet form.
