ORDINANCE NO 76- fg AN ORDINANCE APPROVING A SPECIAL USE ( Lemont Lanes, 1015 State Street, Lemont, Illinois) WHEREAS, Lottie Tomala and Lottie Koziel, hereinafter referred to as "the Petitioners," are the owners of a bowling alley, hereinafter referred to as "the subject property," located at 1015 State Street, and legally described in Exhibit "A." WHEREAS, the Petitioners made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426), for a request for a Special Use to allow an outdoor cafe & dining area in the B -3 District, pursuant to Section VIII.E.2.0. of the Lemont Zoning Ordinance; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on July 20, 1999 and August 3, 1999 for approval of a Special Use; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved a Special Use Permit; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: Special Use. The subject property described above is hereby permitted to allow an outdoor cafe and dining area in the B -3 District, pursuant to Section VIII.E.2.o. of the Lemont Zoning Ordinance. SECTION 2: Conditions. The Special Use is subject to the following conditions: 1. The project shall be built substantially in conformance with the site plan, attached as exhibit "2 ", the architectural elevation, attached as exhibit "3", the outdoor cafe layout, attached as exhibit "4 ", the fence elevation, attached as exhibit "5 ", the fence specifications attached as exhibit "6 ", and the lighting specifications attached as exhibit "7 ", except as such plans may be changed to conform to Village Codes and Ordinances; 2. The existing trees on the site will be preserved and protected with appropriate measures approved by the Planning Staff, and specifically - the site plan shall be revised to exclude the dripline of the tree which currently overlaps with the cafe /outdoor dining area, by reconfiguring and/or reducing the cafe area as a whole; 3. Future permits submitted for additional signage shall also incorporate existing window signage; however, if additional signs are not proposed, existing window signage shall be applied for in conjunction with the fence /patio building permits; 4. The parking lot shall be seal coated and restriped in conformance with exhibit "2" prior to the issuance of a certificate of occupancy for the cafe /outdoor dining area 5. The cafe area shall close no later than 12:00 am; 6. The special use shall be reassessed by the Village within two years of the date of issuance of a certificate of occupancy for the cafe /outdoor dining area. If the Village Board determines at such a time, that usage of the cafe /outdoor dining area has created a serious parking problem, they shall have the right to the modify and/or reduce the months, seating capacity, and/or hours of operation of the cafe /dining area; 7. The petition is subject to review by the Liquor Commission; 8. A landscape plan shall be submitted for approval by Village Staff and the Village Landscape Consultant; and 9. Live outdoor entertainment shall not be allowed, unless a special event permit is issued by the Village for such. The petitioner, Lemont Lanes, Inc., has satisfactorily responded to all of the concerns expressed by the Review Board. Stipulations for service of alcohol: Hours of operation: 12:00 noon to 12:00 midnight Months of operation: Limited to warm weather months only. Primary function of patio: Service of lunch and dinner; after - bowling social area. Entertainment: By special permit only [hours to be determined as as permit is reviewed]. Noise level: Must conform to Nuisance Ordinance. Emergency Exits: Panic gates in wrought iron fence. Checking of I.D. By waitress at time of service. Supervision: Required for outdoor area. Minors: Will be permitted in the patio if ordering food. The Liquor Control Review Board finds no objection to granting of the Special Use for the outdoor cafe and the variances requested (front yard encroachment and additional parking requirements).
