O-83-99 11/08/1999ORDINANCE 'LlSa- ORDINANCE AMENDING ORDINANCE #456 ENTITLED SUBDIVISION REGULATIONS (Section III -A and Section II -B) BE IT ORDAINED, by the President and Board of Trustees of Village of Lemont that Ordinance #456, be amended as follows: Section III. Delete the following provisions of Section III.A. and replace them with the following: A. Preliminary Plat 1. The owner or subdivider, shall file an application for approval of the preliminary plat with the Community Development Director. Fifteen 15 copies of the preliminary plat and the required filing fee shall accompany the application. A Technical Review Committee shall review petitions to provide technical comments to the Planning and Zoning Commission and the Village Board. Such committee shall meet when deemed appropriate by the Community Development Director. The Community Development Director shall set a date for hearing, which date shall not be later than 90 days after the date of filing a completed application and all related documents. 3. Text unamended. 4. When the preliminary plat has been acted upon by the Plan Commission, it shall be referred to the Village Board. If the Plan Commission approves the plat it shall so indicate on the plat, and if it dissaproves such plat it shall furnish the Village Board and the applicant a written statement setting forth the reason for disapproval and specifying with particularity the aspects in which the proposed plat fails to conform to this ordinance and the intent of the Comprehensive Plan. The Village Board shall accept or reject said plat within 30 days after its regular scheduled meeting following the action of the Plan Commission for further consideration, unless additional time for consideration is agreed to by the Board and petitioner mutually. 5. Approval of the preliminary plat by the Planning & Zoning Commission and Village Board shall be conditioned upon stipulation as set forth in Section V of this ordinance. Section II. B. Definitions. SUBDIVISION For the purpose of this ordinance, however, the following cases shall not constitute a "subdivision." a. Deleted. (New): a. The division of a tract, parcel, or lot into parcels or lots all of which resultant parcels or lots exceed five acres. THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE APPROVAL AND PUBLICATION IN PAMPHLET FORM.
