ORDINANCE AMENDING ORDINANCE
0 -26 -99 ENTITLED THE LEMONT ZONING ORDINANCE
(Sections XVIII-F-3, XVIII-H-3 and XVIII- J -3 -C)
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, Will, and DuPage, State of Illinois, that Lemont Zoning Ordinance 0 -26 -99 be
amended as follows:

within the Village of Lemont. The published notice may be supplemented by such additional form of
notice as the Board may by rule provide. The findings and recommendations of the Planning and
Zoning Commission shall be submitted to the Village Board not later than sixty (60) days following
the public hearing.

Village Board. If the Plan Commission approves the it shall so indicate on the plat, and if it
disapproves such plat it shall furnish the Village Board and the applicant a written statement setting
forth the reason for disapproval and specifying with particularity the aspects in which the proposed
plat fails to conform to this ordinance and with the intent of the Comprehensive Plan. The Village
Board shall accept or reject said plat within 30 days after its regular scheduled meeting following the
action of the Plan Commission for further consideration, unless additional time for consideration
is agreed to by the Board and petitioner mutually.

Approval of the preliminary plat by the Plan Commission and
Village Board shall be conditioned upon stipulati -ons as
set forth in Section V of this ordinance.
B FINAL PLAT
1 Within one year. after approval of the preliminary plat
by the Village Board, the subdivider shall file with the
Village Clerk an application for approval of the final
plat covering all or a part of the approved preliminary
plan. Such application shall include the original ink
transparency on a permanent material, one transparency
print, five contact prints of the final plat, and four
copies of ail supporting maps, drawings, and all other
required documents. The final plat shall retain the
design characteristics of the approved preliminary plan,
except that the Village Board may require such changes
or revisions as are deemed necessary in the interest and
needs of the community, otherwise if a preliminary plan
is approved by the Plan Commission and the Village
Board, the Village Board cannot change the requirements
for the particular subdivision if the final plat is pre-
sented within one year from date of acceptance of the
preliminary plan. Accordingly, the Village Board shall
refer the application for approval of the final plat to
the Plan Commission for recommendation and report rela-
tive to design characteristics of the final plat.
2 In case application for approval of a final plat is made
for only a part of the approved preliminary plan, if re-
quested by the developer the Village Board may extend
the time for filing application for approval of final
plats covering the remaining area included in the
approved preliminary plan until a later date or dates
beyond the foregoing one-year period.
3 Within 90 days from the date of filing the last required
document or other paper or within 90 days from the date
the application for approval of the final plat was
filed with the Village Clerk, whichever date is later,
the Village Board shall by resolution approve or disapprove
such plat. Upon the adoption of the resolution approv-
ing a final plat, the Village Clerk shall certify such
approval and affix the corporate seal of the Village on
the final plat.

Dear Mayor Kwasneski and Village Trustees:
The Planning and Zoning Commission conducted a public hearing on the above noted case at the
September 21 meeting.
The Commission heard testimony from the Village Planner. The Commissioners feel that the proposed
amendments are really more of a "housekeeping" measure, due to the fact that the current procedure for
processing applications has been in place for many years. However, even the correction of a minor
technicality such as this, should be approved expediently so that there can be no question as to the fair
and consistent manner in which any and all proposals are processed and reviewed by Staff, the Planing
& Zoning Commission and the Village Board.
Following careful review of the petition, the Planning and Zoning Commission's vote to recommend
approval of the annexation and rezoning passed by a vote of 7 -0.

PROPOSAL
Staff was directed by the Village Board at the June Committee of the Whole meeting to review the specific
procedures that are followed in processing an application under the Zoning and Subdivision Ordinances. Staff has
reviewed the current text in both documents and is proposing the changes shown on the attached exhibits: text
deletions are indicated with a strike- through, and text additions are indicated in bold text.
STAFF RECOMMENDATION
The Staff's Recommendation may be based on the following elements and considerations: the Comprehensive plan, Illinois Zoning and
Planning Statutes, Case Law, the Zoning Ordinance, other applicable village ordinances, input from various village departments and
personnel, and professional expertise and knowledge of urban planning practices and principles. It has not incorporated public and/or
expert testimony or new and better information presented during public hearings/proceedings on the petition. The Staff's Recommendation
is subject to change and modification and should not be construed to be final and irrevocable.
The proposed amendments would reflect the current and past (since approx. 1991) procedure for the processing
of applications. Changing this procedure to reflect a strict interpretation of the current provisions of the zoning
ordinance governing application procedures, would add unnecessary delays (up to a month at least) to each
petition making its way through the public process. In the opinion of Staff, such a policy would not serve the
public interest and would lengthen a process that at present takes an average of 2-4 months to complete. Also,
the proposed amendments would not affect the substantial petition review time already allotted to both the
Planning & Zoning Commission and Village Board - 60 and 90 days respectively.
Staff recommends approval of the proposed text amendments.
