ORDINANCE NO. /) `I7 -4/ -2 AN ORDINANCE APPROVING SPECIAL USE TO PERMIT INSTALLATION OF A CELLULAR ANTENNA IN THE B -3 COMMERCIAL DISTRICT (1143 State Street, Lemont, Illinois (water tower)) WHEREAS, PrimeCo, hereinafter referred to as "the Petitioner ", is the lessee of an approximately 1 acre parcel, hereinafter referred to as "the subject property ", located at 1143 State Street, in Lemont, Illinois and legally described in Exhibit "A"; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426),for a request for a Special Use to permit installation of a cellular antenna in the B -3 Commercial District; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Reporter Progress, a newspaper of general circulation within the Village; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on April 1, 1997, for approval of a Special Use; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, after a public hearing as required by law, recommended approval of the Special Use Permit; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit described herein. The subject property described above is hereby permitted a Special Use to install personal communications services (PCS) antenna and related equipment on top of and adjacent to the water tower in the B -3 Commercial District. Communications requests a Special Use -3, Commercial Zone District - located water Tower, north of 127th Street, Dear Mayor Kwasneski and Village Trustees; The Planning and zoning commission conducted a public hearing on the above noted case on April 1, 1997. The petitioner, Mr. Art Lopatka, Jr., PMHC Corporation, representing PrimeCo Personal Communications, is requesting a special use to install a cellular communications antenna to the top of the Lemont Water Tower on State Street. The request also includes the installation of interior and exterior equipment to the base of the unit. The petitioner is required under the 13-3, Commercial District, provisions to receive a special use prior to the operation of a tower for transmitting and receiving. The petitioner plans to install the antenna to the top of the tower and house the transmitting and receiving equipment in the interior base of the tower. The only exterior change to the base of the tower is the installation of an evaporator unit /humidifier and a power generator to the east side of the tower. The petitioner proposes to plant landscape screening around the units to shield then from the adjacent properties. The village has owned and maintained the site for approximately 35 years. The lease shall be for five (5) years, and PrimeCo shall have the right to extend the term for three (3) successive Five (5) year periods. Illinois Statutes prohibit leases in excess of 20 years unless various statutory requirements have been met. The commission heard testimony by the Village Planner and Petitioner. Stapleton Scott Studebaker The meeting of the Lemont Planning & Zoning Commission of the Village of Lemont was held on Tuesday, April 1, 1997 at the Village Hall. The meeting was called to order by commissioner Kathy Murphy at 7:30 p.m. The following Commissioners were present: Tom Metzger, Kathy Murphy, Ellen Pearson and Ron Stapleton. Absent: Terry Duffy, Gary Gray and Scott Studebaker. A motion was made by Ms. Pearson and seconded by Mr. Stapleton to approve the minutes of the March 18, 1997 meeting. Motion carried by voice vote. PUBLIC HEARING A. Bethany Lutheran Church - Lemont/Lincoln Street - Lemont, IL Request for sign variation to allow a sign to be 48 square feet instead of the maximum permitted 16 feet . Mr. Perry stated that the petitioner is requesting a 48 square foot sign instead of the 16 square feet required in the R -4. This church is located on the corner of Lincoln & Lemont Street. It has approximately 218 feet along Lemont Street and 110 feet along Lincoln Street. It is currently zoned R-4 single - family detached. The existing sign is 10 square feet and lacks visibility from that location. The proposed sign is approximately 8 x 6 feet with a total of 485 square feet. The sign will be constructed of wood with a limestone base. They will move this sign back 5 -8 feet from the existing building. Reverend Glenn Bergmark and Donald Garling were the petitioner representatives. Rev. Bergmark gave the history of the site and the building. He stated that the sign has to be oversized in terms of visibility. Most signs are at a 90 degree angle but they would need a 45 degree angle because it is on a corner. Rev. Bergmark stated that they are moving the sign back for better visibility. The sign will have interior lighting so there will not be any lights shining on the sign. They have not received any negative response to their sign proposal. They would like to make this change as soon as possible. It is very similar to the St. Al's church sign. Mr. Metzger asked if they will be moving the bushes. Mr. Garling stated that they will be removing some of the bushes and do landscaping. Mr. Perry stated he had one information call on this petition. A motion was made by Mr. Stapleton and seconded by Ms. Pearson to close the public hearing. Motion carried by voice vote. Illinois Statutes prohibit leases in excess of 20 years unless various statutory requirements have been met. Mr. Perry stated that the existing water tower stands 135 feet above grade level. The proposed antenna will be an additional nine feet and will include a new 2 lightning rod and aircraft warning light, a GPS antenna, a PrimeCo panel antenna and a new antenna pod. Regarding public response, Mr. Perry stated that there has been some public response to the petitioner with concerns involving potential frequency disturbances with other transmission in the area. Staff has received a call from the bank regarding disturbing their security frequency. Mr. Art Lopatka, FMHC Corporation - the agent for PrimeCo was the representative for the petitioner. He introduced the construction Manager, David Wong. Mr. Lopatka gave a history of personal communication services, etc. He stated that they are now working out a lease agreement with the Village attorney. He stated that they need the 135' high for the antenna. Mr. Lopatka stated that he called the security company for the bank and found out that the frequencies are very far apart. He has contacted Bonnie Houdak and informed her of this. He also stated that if the FAA does not require aircraft warning lights, PrimeCo won't put it on. Ms. Pearson asked how tall the equipment on the ground will be. Mr. Lopatka stated that the cabinet will be approximately 3 -4 feet high. They are proposing 4 foot high shrubs. Mr. Stapleton asked how close their nearest tower was. Mr. Lopatka stated that it is around 1 -355 and 1 -55 in Bolingbrook. Ms. Murphy asked how far the towers are generally spaced. Mr. Wong stated that the spacing is determined by the terrain. This is determined by a radio frequency engineer. It usually averages about 4 to 5 miles. Mr. Lopatka stated that PrimeCo may consider the need to put a tower at Route 83 and Archer Avenue. Mr. Stapleton asked if they were planning on putting a tower there at 135 feet. Mr. Wong stated that are not sure but it may need to be taller. Mr. Wong also stated that PrimeCo has a policy of co- locating with other carriers. Mr. Buening stated that there are limits on the heights for new antennas of 100'. If they located on an existing tower it is o.k. Ms. Murphy asked if any ground equipment would be affected by these devices. Mr. Wong explained the range they operate on and stated that it is such a different frequency range it will not affect televisions, radios or medical devices. He stated they have located these devices on hospitals and retirement homes. Mr. Wong also stated that all health safety studies have been negative. 3 Mr. Buening stated that there is an existing ESDA antenna on the tower and they made sure that this will not interfere. Ms. Pearson made a motion which was seconded by Mr. Stapleton to close the Public Hearing. Motion carried by voice vote. Each one will have to build their own system. We have to allow them to locate. Each company has it's own network and they do not locate in the same area. Based on the minimal changes occurring to the exterior of the water tower and the lease agreement, allowing the village thorough regulating power over the proposed activities, it is staff's opinion, the use will not cause any hardship or create any safety concerns and is consistent with the land use activities in the surrounding area.
