AN ORDINANCE ADOPTING THE 1996 BOCA NATIONAL BUILDING CODE, AN ORDINANCE ESTABLISHING MINIMUM REGULATIONS GOVERNING THE DESIGN, CONSTRUCTION, ALTERATION, ENLARGEMENT, REPAIR, DEMOLITION, REMOVAL, MAINTENANCE AND USE OF ALL BUILDINGS AND STRUCTURES, KNOWN AS THE BUILDING CODE ORDINANCE NO. 0-79-17 BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, State of Illinois, as follows: SECTION 1. ADOPTION OF BUILDING CODE. That a certain document, three (3) copies of which are on file in the offices of the Village of Lemont being marked and designated as "The BOCA National Building Code, Thirteenth Edition, 1996" as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code of the Village of Lemont in the State of Illinois; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Ordinance, with the additions, insertions, deletions and changes, if any prescribed in Section 3. of this Ordinance. SECTION 2. INCONSISTENT ORDINANCES REPEALED. That Ordinance Number 973 of the Village of Lemont entitled "An Ordinance Adopting the BOCA National Building Code /1993 ", and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. MISCELLANEOUS FEES: Detached Garages $100.00 Sheds (144 sq. ft. or less) $ 30.00 Siding /Brick Veneer $ 30.00 Porches (open) $ 30.00 Decks /Patios /Pergolas $ 30.00 Fences $ 30.00 Fireplace added after construction $ 30.00 Residential Swimming Pools: Above Ground $ 30.00 In Ground $100.00 Signs $ 1.25 /sq. ft. - $30.00 minimum Lawn Sprinkler Systems $ 50.00 for 75 heads or less over 75 heads - $25.00 for each additional 50 heads or fraction thereof Demolition $ 30.00 REINSPECTION FEES: Whenever a reinspection is required, due to incorrect, incomplete or inaccurate information or construction, an additional fee of $30.00 per inspection, per inspector, shall be charged. This fee shall be payable prior to the reinspection being performed. LATE FEE: When construction has been started prior to the issuance of a permit for new building construction (i.e.; single family residence, townhome, condominium, multi - family structure, or new commercial construction), the normal permit fee as required by this Ordinance shall be increased by the amount of $1,000.00. When construction has been started prior to the issuance of a permit for other construction (i.e.; shed, deck, fence, pool, etc.), the normal miscellaneous fee as required by this Ordinance shall be increased by the amount of $30.00. VILLAGE INSPECTION FEE: When the Building Department is requested by a buyer or seller of a building to inspect the building for sale to determine building code violations, the following fee shall be paid for the inspection: Single - Family Residence $ 150.00 Multi - Family Residence $ 150.00 first unit $ 50.00 each additional unit Commercial $ 150.00 first unit $ 50.00 each additional unit SECTION 113.6 (Page 5) Add new section: No building shall be erected, converted, enlarged, reconstructed, or structurally altered with the use of pre - fabricated structural members that are completely enclosed and unable to be inspected on site, unless approved by the Board of Trustees in regular session. SECTION 116.4 (Page 6) - Violation penalties - Change to Read: Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a Misdemeanor, punishable by a fine of not less than $25.00 nor more than $750.00 at the discretion of the court. Each day that a violation continues after due notice has been served shall be deemed a separate offense. SECTION 117.2 (Page 6) - Unlawful continuance - Change to Read: Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $25.00 nor more than $750.00. SECTION 1204.2 (Page 140) - Floor area - Add: No single- family attached or detached residential dwelling shall be erected, converted, or reconstructed unless all habitable rooms of said building (exclusive of attics, basements, utility and garage areas) are a total of 900 square feet or greater. SECTION 1806.1 (Page 206) - Frost protection - Add: The Village of Lemont's frost line is 42 inches below grade. SECTION 1810.3.1 (Page 207) - Plain Concrete - Change to Read: In plain concrete footings on soil, the edge thickness shall be not less than 10 inches with a width not less than 18 inches for frame construction, and 20 inches for brick veneer. SECTION 3408.2 (Page 320) - Applicability - Insert: (ten days after passage) SECTION 4. SAVING CLAUSE. That nothing in this Ordinance or in the Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance. SECTION 5. DATE OF E} r ECT. That the Village Clerk of the Village of Lemont, Counties of Cook, Will and DuPage, State of Illinois, shall certify to the adoption of this Ordinance, and cause the same to be published in pamphlet form. This Ordinance shall take full force and effect ten (10) days after this date of final passage, approval, and publication in the manner provided by law. That the following sections are hereby revised as follows: SECTION 101.1 (Page 1) Insert: Village of Lemont. SECTION 108.2 - Suspension of Permit (Page 3) Change to Read: Suspension /Expiration of Permit. Every permit issued by the building official under the provisions of this code shall expire after one year from the issue date of the permit, or become null and void if the building or work authorized by such permit is not commenced within six months from the issue date of the permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of six months. Before work can be resumed, a new permit shall be obtained to do so, and the fee therefore shall be one -half the amount required for a new permit for such work, provided no changes have been made in the original plans and specifications for such work; and provided further that such suspensions or abandonment has not exceeded six months. SECTION 112.3.1 - Fee Schedule - Change to Read: Permit fees for the construction of buildings or additions to buildings shall relate to the estimated construction value of the building. The estimated construction valuation will be determined by the latest Building Valuation Data Report as published in the Building Official and Code Administrators (BOCA) Magazine. The unit costs for the different construction types will be applied to the gross square footage of a building (including basements and garages) to determine the valuation of the building for all structural, electrical, plumbing, mechanical, interior finish, normal site preparation including excavation and backfill, overhead and profit. Architectural fees, cost of land and off site costs are not included. Any Building Valuation submitted by permit applicant that exceeds the computed valuation will be utilized as the Building Valuation. Permit fees for remodeling an existing building will be based on the estimated cost of the contractor doing the work. Permit fees for moving buildings will be based on complete value of the home after the move (excluding land).
