O-20-97 04/28/97ITEM V.B.7 VILLAGE OF LEMONT ORDINANCE NO. 6 -J)-9 7 AN ORDINANCE ADOPTING THE 1996 EDITION OF THE INTERNATIONAL MECHANICAL CODE, REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, QUALITY OF MATERIALS, ERECTION, INSTALLATION, ALTERATION, REPAIR, LOCATION, RELOCATION, REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF MECHANICAL SYSTEMS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES; KNOWN AS THE INTERNATIONAL MECHANICAL CODE ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 28th DAY OF April , 1997 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois on this 28th day of April , 1997. VILLAGE OF LEMONT ORDINANCE NO. 6 -.20 -17 AN ORDINANCE ADOPTING THE 1996 EDITION OF THE INTERNATIONAL MECHANICAL CODE, REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, QUALITY OF MATERIALS, ERECTION, INSTALLATION, ALTERATION, REPAIR, LOCATION, RELOCATION, REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF MECHANICAL SYSTEMS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES; KNOWN AS THE INTERNATIONAL MECHANICAL CODE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, State of Illinois as follows: SECTION 1. That certain documents, three (3) copies of which are on file in the office of the Village of Lemont, being marked and designated as the "International Mechanical Code ", including Appendix Chapter A, as published by the International Code Council, be and is hereby adopted as the code of the Village of Lemont for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the Village of Lemont and providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Mechanical Code, 1996 edition, published by the International Code Council, on file in the office of the Village of Lemont are hereby referred to, adopted and made a part hereof as if fully set out in this Ordinance. SECTION 2. That the following sections are hereby revised: Section 101.1 (page 1, second line). Insert: VILLAGE OF LEMONT Section 106.5.2 Insert the following Fee Schedule: B101 - Initial Fee - $30.00 permit fee up to a valuation of $15,000.00 and an additional $30.00 per each $5,000.00 valuation above $15,000.00. B102 - Fee for Reinspection - If it becomes necessary to make a reinspection of a heating, ventilation, air - conditioning or refrigeration system, or boiler installation, the installer of such equipment shall pay a reinspection fee of $30.00. B103 - Temporary Operation Inspection Fee - When preliminary inspection is requested for purposes of permitting temporary operation of a heating, ventilating, refrigeration, or air - conditioning system, or portion thereof, a fee of $30.00 shall be paid by the contractor requesting such preliminary inspection. If the system is not approved for temporary operation on the first preliminary inspection, the usual reinspection fee shall be charged for each subsequent preliminary inspection for such purpose. Section 106.5.3. - Fee Refunds. Change to read: The code official shall authorize the refunding of fees as follows: The full amount of any fee paid hereunder which was erroneously paid or collected. The code official shall not authorize the refunding of any fee paid, except upon written application filed by the original permittee not later than 180 days after the date of fee payment. Section 108.4 - Violation Penalties (page 5) - Insert and Change to Read: Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall, upon conviction thereof, be subject to a fine of not less than $25.00 nor more than $750.00 at the discretion of the court. Each day that a violation continues after due notice has been served shall be deemed a separate offense. Section 108.5 - Stop Work Orders (page 5) - Insert: $25.00 nor more than $750.00 Chapter 16 - Codes (page 126) - Insert: Building Code - BNBC -96 BOCA National Building Code Fire Prevention Code - BNFPC - Current BOCA National Fire Prevention Code SECTION 3. That Ordinance No. 971 of the Village of Lemont entitled "An Ordinance Adopting the 1993 BOCA National Mechanical Code, et al ", and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Village of Lemont hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 5. That the Village Clerk of the Village of Lemont, Counties of Cook, Will and DuPage, State of Illinois, shall certify to the adoption of this Ordinance, and cause the same to be published in pamphlet form. SECTION 6. That this Ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect ten (10) days after this date of final passage, approval, and publication in the manner provided by law.
