RESOLUTION APPROVING 20 FOOT EASEMENT
DEDICATION FOR ROADWAY AND UTILITY PURPOSES
RELATED TO FOURTH STREET IMPROVEMENTS
WHEREAS, the Village of Lemont is proposing to undertake roadway improvements to
Fourth Street, and
WHEREAS, although referred to as a street, Fourth Street is privately owned, with
ownership extending to the centerline of the pavement, and
WHEREAS, the Village has requested that the adjacent owners dedicate a 20 foot
easement to provide for roadway and utility improvements, and
WHEREAS, an easement has been dedicated for the Wlodarski Property and is hereby
attached for approval.
NOW THEREFORE BE IT RESOLVED that the attached 20 foot easement dedication
is hereby approved and shall be recorded with the Cook County Clerk.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE,

EASEMENT AGREEMENT
THIS AGREEMENT is made and
entered into this RA day of

LEMONT, a Municipal Corporation,
hereinafter referred to as "Grantee ",

WITNESSETH:
WHEREAS, Grantor is willing to grant to the Grantee a perpetual easement subject to the
terms, covenants and conditions hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual promises and undertakings and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the
Grantor hereby grants without warranty of title to the Grantee its successors and assigns a perpetual
easement to the VILLAGE OF LEMONT, its successors and assigns, for the full and free right and
authority to install, construct, relocate, replace, inspect, operate, repair and maintain roadways, street
lights, water mains, fire hydrants, valves and water service facilities, sanitary sewer pipes, manholes
and sewer connections, storm sewer pipes, manholes, inlets and service connections, gas mains,
valves, service lines and meters, electric transmission and distribution wires and cables, and such other
appurtenances and facilities as may be necessary or convenient related to said improvements, in, on,
upon, over through, across and under all of the "Easement Premises" legally described as:
The East 20 feet of lot 20 in George L. Becker's Subdivision of the East half of the
Northwest quarter of Section 28, Township 37 North, Range 11 East of the Third
Principal Meridian, in Cook County, Illinois.

The Grantor represents and warrants to the Grantee that Grantor is the true and lawful owner
of the Property and has full right and power to grant and convey the rights conveyed herein.
The Grantee hereby agrees to restore all property disturbed by its activities in use of the
easement to the condition existing prior to the disturbance.
The Grantee shall have the right to remove or trim such trees and brush in the Easement Area
as is necessary to exercise the rights conveyed herein.
The Grantor shall not construct improvements in the Easement Area or change the finish
grade of the Easement Area without the consent of the Grantee.
This Easement is binding upon and shall inure to the benefit of the heirs, successors, assigns,
and licensees of the parties hereto.
