AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF
LEMONT FROM COOK COUNTY R -3 RESIDENCE TO VILLAGE OF LEMONT
R -5 MULTIPLE - FAMILY RESIDENCE AND PLANNED DEVELOPMENT
WHEREAS, Dean P. Chowaniec, hereinafter referred to as
"the Petitioner ", is the owner of an approximately 21.59 acre
parcel, hereinafter referred to as "the subject property ",
generally located at 12200 Archer Avenue in Lemont, Illinois and
legally described in Exhibit "A ".
WHEREAS, the Petitioner made application under the provisions
of the Lemont Zoning Ordinance of 1980 (No.426),for a Zoning Map
amendment from Cook County R -3 Single- family Residence to Village
of Lemont R -5 Multiple - family Residence District;
WHEREAS, the Planning & Zoning Commission of the Village of
Lemont, Illinois (the "Village ") did heretofore commence and
conduct a Public Hearing on November 7, 1995 for approval of a
Zoning Map Amendment; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Reporter
Progress, a newspaper of general circulation within the Village;
and
WHEREAS, the President and Board of Trustees of the Village of
Lemont, after a public hearing as required by law, approved Zoning
Map Amendment;and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by approving the Zoning Map Amendment as described herein;
and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Zoning District Change: The subject property
described above is hereby rezoned from its present Cook County R -3
Single - family Residence to Village of Lemont R -5 Multiple- family
Residence District. The zoning map of the Village of Lemont is
hereby amended in accordance with the provisions of this Ordinance.
SECTION 2: Residential Planned Development Approval: A
Special Use Permit for a residential planned development is granted
for the future use of the subject property as an attached single
family development. Said planned development shall be subject to
the conditions as approved by the Village Board, attached hereto as
Exhibit "B ".
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.

EXHIBIT "B"
CONDITIONS OF APPROVAL - -THE STEEPLES
1. The development shall substantially conform to the preliminary
plat, attached hereto as Exhibit °C ", and the Floor Plans and
Architectural Elevations, attached hereto as Exhibit "D ",
except as such plans may be changed to conform to village
Codes and Ordinances and the conditions below. Buildings may
have a side yard setback of 30 feet instead of the minimum
required 60 feet.
2. Cash -in -lieu of sidewalks along Archer Avenue and McCarthy
Road shall be submitted in the amount of $24,440 prior to
issuance of building permits for the townhomes. All jogging
paths shall be located on private property and not in public
rights -of -way.
3. A tree survey, landscaping and preservation plan, and
engineering and grading plans need to be submitted in
conjunction with final plat review.
4. An Army Corps of Engineers permit is needed prior to final
plat review to permit filling of the on -site wetlands.
5. Comments shall be submitted from IDOT and the CCHD for access
to Archer Avenue and McCarthy Road, respectively.
6. The well site shall be conveyed to the Village prior to
issuance of building permits for the townhome units.
7. Lots for individual buildings shall be made larger such that
they incorporate an area that includes all required setbacks
for each building.
