AN ORDINANCE GRANTING PROPOSED FRONT AND REAR
YARD VARIANCES FOR A NEW SINGLE - FAMILY HOME
(410 Porter Street)
WHEREAS, an application has been filed by Jeff Guzlas,
President of JLG & Associates, Inc. in connection with a Request
for Variation for the property legally described in Exhibit "A" and
located at 410 Porter Street, Lemont, Illinois.
WHEREAS, the applicant is seeking relief from the Lemont
Zoning Ordinance in order to allow a new single family home to be
located three (3) feet from the rear property line instead of the
minimum 30 feet required and to have a front yard setback of 1.6
feet instead of the minimum required 7.5 feet; and
WHEREAS, the Planning and Zoning Commission of the Village of
Lemont, Illinois, in accordance with said Zoning Ordinance,
conducted a Public Hearing on the petition on June 4, 1996; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Reporter
Progress, a newspaper of general circulation within the Village;
and
WHEREAS, the Lemont Planning and Zoning Commission has
recommended approval of the variations to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interest of the Village will be
served by the approval of this petition granting variations for the
subject property.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Lemont, that the petitioner, Jeff
Guzlas, be granted a variation to allow a new single family home to
be located three (3) feet from the rear property line instead of
the minimum 30 feet required and allow a front yard setback of 1.6
feet instead of the minimum required 7.5 feet, subject to the
conditions attached hereto as Exhibit "B ".

CONDITIONS OF APPROVAL -410 PORTER STREET:
1. The variations shall substantially conform to the Site Grading
Plan, attached hereto as Exhibit "C", except as such plans may
be changed to conform to Village Codes and Ordinances and the
conditions below. In no case may any part of the structure
encroach or overhang into the Porter Street or alley rights -
of -way. The proposed front porch area may extend across the
entire front of the structure if proposed by the petitioner.
2. The entire rear alley area from Stephen Street to Fremont
Street shall be paved with additional gravel by the petitioner
to correct surface irregularities prior to issuance of a final
occupancy permit.
3. Two (2) parkway trees shall be planted along the Porter Street
right -of -way, prior to issuance of a final occupancy permit.
