ORDINANCE //1./Vi- ORDINANCE AUTHORIZING ADOPTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF LEMONT AND LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210 RELATED TO THE EXPANSION OF LEMONT TOWNSHIP HIGH SCHOOL WHEREAS, the Lemont Township High School District 210 has undertaken efforts to expand the public high school on Porter Street; and WHEREAS, the Lemont Township High School District 210 and the Village of Lemont desire to enter into a agreement which would address certain understandings and obligations by and between these units of government; and WHEREAS, the units of government shall be governed by the terms and conditions of the Intergovernmental Agreement. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees that the attached Intergovernmental Agreement be approved. SMOLLEN, Village Clerk ok 41, NESKI, Village President INTERGOVERNMENTAL AGREEMENT This Agreement made and entered into by and between the VILLAGE OF LEMONT, COOK COUNTY, ILLINOIS and LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210, COOK COUNTY, ILLINOIS: WHEREAS, the aforementioned taxing bodies are organized and existing under the laws and Constitution of the State of Illinois; and WHEREAS, the VILLAGE OF LEMONT, is a municipality, organized and existing pursuant to the laws and Constitution of the State of Illinois, and particularly 65ILCS 5/1 et seq.; and WHEREAS, LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210, is a school district organized pursuant to the Constitution of the State of Illinois and particularly, the Illinois School Code 1O5ILCS 5/1 et seq.; WHEREAS, Article 7, Section 10 of the Illinois Constitution (1970), the School Code, 105 ILCS 5/1 -1 et. seq., and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. provide authority for intergovernmental agreements and cooperation between units of local government and school districts, including both parties hereto; NOW, THEREFORE, in and for consideration of the mutual covenants and agreements contained herein, the VILLAGE OF LEMONT and LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210 agree as follows: 1. It is hereby recognized by both parties hereto that the existing school structures of Lemont Township High School District 210 may be inconsistent with certain zoning and building ordinances of the Village of Lemont and, further, that a portion of said structures encroach upon Village right -of -way. 2. It is hereby acknowledged by the parties hereto that LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210 has various non- conforming uses and encroachments; it is hereby agreed by the Village of Lemont that it shall take no action to enforce any said zoning or building ordinances against LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210 in regards to any such non- conforming uses or encroachments. 3. It is hereby agreed that Lemont Township High School District 210 shall replace the existing three inch water main from the southeast corner of Porter Street and Julia Street to the southeast corner of Catherine Street and Porter Street with an eight inch water main. It is further agreed that the Village of Lemont shall provided a fire hydrant which will be installed by LEMONT TOWNSHIP HIGH SCHOOL DISTRICT 210 at the southeast corner of Catherine Street and Porter Street. 4. It is further agreed that the Village of Lemont shall reimburse Lemont Township High School District 210 for the difference in cost between a six inch water pipe and an eight inch water pipe for said pipe which is to be installed between Julia Street and Catherine Street via Porter Street. 5. The Village of Lemont shall reserve the right of mess and egress onto the land presently known as Porter Street for servicing Village utilities, even if Porter Street is vacated. 6. That the Village shall not impose any tap on fees which may otherwise be assessed for water or sewer connection. 7. IT IS FURTHER AGREED by and between the parties that this Agreement may not be terminated by either of the parties unilaterally but may only be terminated by agreement of all the parties hereto. This Agreement and the terms therein may be enforced by any court of competent jurisdiction in the State of Illinois.
