ORDINANCE NO. 701(
AN ORDINANCE AMENDING ABBEY OAKS PLANNED DEVELOPMENT
ORDINANCE NO. 774 TO ALLOW WROUGHT -IRON FENCING
IN THE CONSERVATION EASEMENT AREAS
WHEREAS, Pat Cronin Construction Inc., as the beneficiary of
State Bank of Countryside Trust No. 92 -1216 and Worth Bank and
Trust Company Trust No. 4868, is the owner of a 73 -acre parcel
(formerly the St. Vincent Seminary), hereinafter referred to as
"the subject property ", located on the north side of 127th Street
west of Archer Avenue in Lemont, Illinois and legally in Exhibit
"A"
WHEREAS, Pat Cronin Construction, Inc., as the beneficiary of
State Bank of countryside Trust No. 92 -1216 and Worth Bank and
Trust Company Trust No. 4868, made application to amend Ordinance
No. 774; and
WHEREAS, the Planning and Zoning Commission of the Village of
Lemont, Illinois (the "Village ") did heretofore commence and
conduct a Public Hearing on July 2, 1996, for approval of the
amendment to the Abbey Oaks Planned Development Ordinance No. 774;
and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont Reporter
Progress, a newspaper of general circulation within the Village;
and
WHEREAS, the Lemont Planning Commission has recommended denial
to the amendment to Ordinance No. 774; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of the Planning Commission recommendations
specified below regarding the subject property; and

WHEREAS, the President and Board of Trustees of the Village of
Lemont adopted Ordinance 774 on March 22, 1993, approving the Abbey
Oaks Planned Unit Development; and
WHEREAS, the proposed amendment would allow wrought -iron
fencing to be located in the conservation easement areas along
127th Street.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Amendment to Planned Unit Development:
Ordinance No. 774 is hereby amended by deleting all of
Paragraph Number 4 in Section 1, and by inserting the
following language:
"That the fence and entrance gate on 127th Street shall be of
a unified design and construction materials. Rear yard fences
are permitted for Lots 1,84 -91 and 120 -125, inclusive if
constructed black wrought iron in a similar style as the 127th
Street fence. Said fence shall not cause the removal of
existing trees. The fence shall be constructed by the owner,
or successors or assigns, as part of Phase I."

THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS,
