PIN 22 -19- 400 -016; ORDINANCE NO. /V5 AN ORDINANCE APPROVING SPECIAL USE TO PERMIT OUTSIDE STORAGE OF GOODS AND MATERIALS AND A VARIATION TO PERMIT A FENCE HEIGHT OF 10 TEN FEET INSTEAD OF 8 FEET (16135 New Avenue) WHEREAS, New Venture Partnership, hereinafter referred to as "the Petitioner ", is the owner of an approximately 4.3 acre parcel, hereinafter referred to as "the subject property", located at 16135 New Avenue, in Lemont, Illinois and legally described in Exhibit "A". WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426),for a request for a Special Use to allow outdoor storage in an M -1 District and a Variance to allow a perimeter screening fence to be ten (10) feet in height instead of the maximum permitted eight (8) feet; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on July 2, 1996 for approval of a Special Use and Variance; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Reporter Progress, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved a Special Use Permit and a Variance;and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit and Variance as described herein; and 1 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Special Use. The subject property described above is hereby permitted outdoor sales and storage. SECTION 2: Variance. The perimeter screening fence to be ten (10) feet in height instead of the maximum permitted eight (8) feet is hereby permitted. SECTION 3: Conditions. The Special Use and Variance are subject to the following conditions: 1. The outdoor storage area shall be confined to those areas which are fully screened by fencing and /or a chain link fence with dense landscape plantings. 2. The ten (10) foot high fence shall not extend across the front of the building along New Avenue. 3. A. plan shall be submitted for the paving of nine (9) parking spaces and an access aisle for said spaces. This area shall be directly adjacent to the existing paved area along Industrial Drive. Said paving shall be completed prior to the issuance of a final occupancy permit for the new building.
