AN ORDINANCE AMENDING THE
VILLAGE OF LEMONT BUILDING CODE
ORDINANCE NO. /49/9-
BE IT ORDAINED by the President and Board of Trustees of The Village of
Lemont, Counties of Cook, Will, and DuPage, that the BOCA National Building Code as
adopted is hereby amended to include the following:
SECTION 1. GRADING PLAN
With all applications for a building permit to construct or relocate a principal
building or an accessory building greater than 576 sq. ft. on a lot, two (2) copies of a
certified grading plan must be submitted to the Community Development Department for
review. The grading plan must have the stamp and signature of a registered professional
engineer.
The plan must be drawn in accordance with an accurate boundary line survey and
show to scale the size and location of all the new construction and all existing structures on
the site, distances from lot lines, established street grades, proposed elevations for top of
foundation and grade, elevation of adjacent lots and tops of existing foundations, drainage
swales and drainage break points, and location and elevation of utility structures.
SECTION 2. ENGINEERING REVIEW FEE
An engineering review fee of $300.00 shall be paid to the Village of Lemont at the
time the building permit is issued.
SECTION 3. FINAL SURVEY
Prior to landscaping, the contractor shall be required to submit two (2) copies of an
accurate boundary line and topographic survey for the lot, indicating the following:
A. Existing and proposed top of foundation grade.
B. Existing and proposed lot corner elevations.
C. Existing and proposed finished grade elevation at the four (4) corners of the
home.
D. Existing and proposed elevation of all drainage break points and drainage
arrows within the lot.
E. Existing and proposed location and elevation of all utility structures on the
lot.
F. Stamp and signature of a registered land surveyor or a registered professional
engineer.
Upon submittal of the Final Grading Survey to the Community Development
Department for review, the contractor will be notified within three (3) working days by the
Village Engineer or Building Department staff if the grading of the property is approved for
landscaping.
SECTION 4. LANDSCAPING
All lot areas, including parkway area on Village right -of -way not improved with
driveway or building structures, shall be seeded or sodded by the contractor prior to an
Occupancy Permit being issued.
Prior to an Occupancy Permit being issued, the contractor shall also plant not less
than two (2) trees per lot frontage within the parkway area. Trees shall have a trunk
diameter of not less than two and one -half inches (2- 1/2 "), measured twelve (12) inches
above the ground. The spacing between any two trees, measured along the right -of -way,
shall not be in excess of forty (40) feet. In those situations where two (2) parkway trees
cannot be accommodated, then one (1) tree may be planted in the parkway area and one
(1) in the front yard area.
The planting of the following varieties of trees within a parkway area shall be
prohibited:

SECTION 5. TEMPORARY OCCUPANCY PERMIT
A Temporary Occupancy Permit may be requested between November 1 and June
1 if the necessary landscaping cannot be completed due to adverse weather conditions.
The Temporary Occupancy Permit may be issued upon receipt of a performance
bond, letter of credit, or cash bond (check) from the contractor to the Village of Lemont.
The above security shall be in the amount of $5,000.00 for all lots with up to 22,000
sq. ft. and $10,000.00 for all lots with more than 22,000 sq. ft.
Said security will be held by the Village until all improvements are completed in
accordance with the Ordinance.
A Temporary Occupancy Permit shall be effective until the 1st day of July.
SECTION 6. VIOLATION PENALTIES
Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to
comply with, or who resists enforcement of any of the provisions of this Ordinance shall,
upon conviction, be fined not less than $25.00 nor more than $750.00 for each offense. Each
day that a violation is permitted to exist shall constitute a separate offense.
SECTION 7.
This Ordinance shall be in full force and effect from and after its passage, approval
and publication in the manner provided by law.
All ordinances or parts of ordinances in conflict herewith shall be and the same are
hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.
