RESOLUTION GRANTING TEMPORARY EASEMENT TO THE ILLINOIS STATE
TOLL HIGHWAY AUTHORITY FOR CONSTRUCTION OF THE
NORTH -SOUTH I -355 TOLLWAY EXTENSION FROM I -55 TO I -80.
WHEREAS, the Illinois State Toll Highway Authority desires to construction an extension
of the North -South I -355 Tollway from I -55 to I -80 immediately adjacent to the Village of Lemont;
and
WHEREAS, in order to complete construction of the tollway extension, a temporary
easement is required from the Village of Lemont; and
WHEREAS, it is in the best interest of the Village of Lemont and the Illinois State Toll
Highway Authority to enter into this mutual agreement.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees that the
attached Grant of Temporary Easement be approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE, ILLINOIS,

GRANT OF TEMPORARY EASEMENT
THIS INDENTURE WITNESSETH, that
the Grantor, the Village of Lemont, a municipal
corporation of Cook County, Illinois, for and in
consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration, in
hand paid, the receipt of which is hereby
acknowledged, hereby represents that it owns
the fee simple title to the property underlying the
easements granted herein and does by these
presents grant the right, easement and privilege
to enter upon the property commonly known as
Parcel Numbers NS- 701 -018.1 TE and NS -701-
018.2TE and legally described in Exhibit "A"
attached hereto and made a part hereof unto
The Illinois State To Highway Authority
(hereafter "Authority "), its agents, employees or
contractors for toll highway purposes, including
but not limited to improving the North -South
Tollway and related improvements.
The right, easement and privilege granted herein shall terminate five (5) years from
the date hereof or upon the completion of the aforementioned improvement project, which
ever is the sooner. Additionally, for and in consideration of this grant of temporary
easement, Authority does by the acceptance hereof agree to pay for and restore any
damages to adjacent property owned by Grantor caused in connection with the use of the
aforementioned property and to restore the said easement property to its condition. as it
existed prior to the construction. promptly following completion of the aforementioned
improvement.
