A RESOLUTION AUTHORIZING AND DIRECTING THE FILING
OF AN APPLICATION UNDER THE 1998 COOK COUNTY
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
FOR SET -ASIDE INFRASTRUCTURE IMPROVEMENT FUNDS
BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Cook,
Will and DuPage Counties, Illinois , as follows:
WHEREAS, a request is hereby made to the County of Cook, Illinois, for Community
Development Block Grant (CDBG) set aside funds for Program Year 1998 in the amount of
($200,000.00) for the following project:
PROJECT AMOUNT
Public Utility and Roadway Improvements $200,000.00
as identified in the Village's CDBG application; and
WHEREAS, the Village President is hereby authorized to sign the application and various
forms contained therein, and the Village Clerk is hereby directed to attest to said signature, and the
Village President is further authorized to make all required submissions and do all things necessary
to make application for the funds requested above in this Resolution, a copy of which application is
on file in the office of the Village Clerk; and
WHEREAS, the Village President is hereby authorized to certify that matching funds which
have been identified as supporting its project as set out within its application will be made available
upon the approval of the projects by the County of Cook, Illinois or the prorated share thereof; and
WHEREAS, this resolution shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner as provided by law.

VILLAGE BOARD MEETING
June 14, 1999 - 7:30 PM
MINUTES of a regular public meeting of the President and Board of Trustees of the Village
of Lemont, Cook, DuPage and Will Counties, Illinois, held at the Village Hall, 418 Main
Street, Lemont, Illinois, in said Village at 7:30 PM on the 14th day of June, 1999.
I. CALL TO ORDER.
The Temporary Chairman called the meeting to order and directed the Village Clerk to call the roll.
Upon roll call, the following answered present: Keith Latz, Temporary Chairman, and Trustees
Benik, Blatzer, Markiewicz, Studebaker. Trustee Rimbo was absent.
II. PUBLIC HEARING REQUIREMENTS.
A motion was made by Trustee Markiewicz, seconded by Trustee Studebaker, to open a Public
Hearing on June 14, 1999 at 9:27 p.m., regarding a Cook County Community Development Block Grant
Application for infrastruture improvements for Lemont Senior Housing project. Voice vote. _5_ ayes.
Motion passed.
III. PURPOSE OF THE MEETING.
Scott Buening, Community Development Director, explained the purpose of the Public Hearing and
entered into the record a copy of the notice of the meeting that was published in the Lemont Metropolitan
on May 27, 1999. Mr. Buening stated that the purpose of the Public Hearing was for the Village to receive
input into the application for Cook County Community Development Block Grant funds for infrastructure
improvements for the Lemont Senior Housing project in Lemont. He introduced Mr. Michael Pizzuto to
explain the process.
IV. CDBG PROCESS.
Mr. Michael Pizzuto of the Stough Group presented an overview of the Lemont Senior Housing
project and discussed the process for applying for CDBG funds under the economic development set -aside
grant process.
V. QUESTIONS AND DISCUSSION.
Village trustees asked various questions regarding the application and the dollar amounts involved,
particularly the matching fund portion of the grant. Questions were directed to Mr. Pizzuto who responded
for the Stough Group.
VI. ADJOURNMENT.
There being no public comment, at 9:58 p.m., a motion was made by Trustee Markiewicz, seconded
by Trustee Blatzer, to adjourn the Public Hearing. Voice vote: 5 ayes. Motion passed.

INTRODUCTION
SUBGRANTEE APPLICATION FORM
This Subgrantee Application Form is to be used in applying for funds under the Cook County
Community Development Block Grant Program for the 1999 Program Year. The form is
divided into two sections:
Part 1 - General Instructions
Part 2 - Special Instructions
Part 1 contains forms and instructions required of all applicants. Part 1 also includes samples
of the resolution format that is required to be submitted with the application.
Part 2 contains special instructions for submitting applications for specific project types. The
special instructions in Part 2 are divided into separate sections by eligible activity. Each
proiect type requires a detailed narrative describing proiect related items. Please review these
special instructions and prepare the required narrative.
The "Handbook of Eligible Activities" must be used in conjunction with this application form
in order to prepare a grant application.

$350.000. Communities with a city -wide concentration of low and moderate income persons

exceed $800,000. Regional residential rehabilitation agencies may apply for two (2) projects,
not to exceed $1,000,000.

rely on funds budgeted in previous program years or on anticipated future
revenues. The following are examples of anticipated accomplishments and

PROJECT NARRATIVE AND JUSTIFICATION
Project Area:
North of Main Street, south of the I & M Canal, east of Holmes Street in
Lemont, Illinois.
Project Scope and Purpose:
Installation of storm sewers, water mains, street, curb, gutter and sidewalks
associated with construction of low and moderate - income senior citizen
housing development. Project necessary to provide affordable housing for
Lemont senior citizens, and to complement housing and commercial
redevelopment efforts underway in the area.
Specific Accomplishments Anticipated by 11/00:1
• 10,000 cubic yards topsoil stripped.
• 44,000 cubic yards earth embankment /fill installed.
• 750 linear feet curb and gutter removal and replacement.
• 20 manholes installed.
• 18 catch basins installed.
• 2,810 linear feet storm sewer installed.
■ 1,000 linear feet sanitary sewer installed.
• 1,850 linear feet water main installed.
• 4 fire hydrants installed
• 1,7200 linear feet trench backfilled.
• 285 square yards bituminous removal and replacement.

Eligibility /Justification:
This project will assist in the provision of 43 units of low and moderate -
income senior citizen housing, serving a limited clientele that is 100%
eligible. This project is an eligible infrastructure improvements project.

Economic Development Set -Aside
1999 APPLICATION
CITIZEN PARTICIPATION PLAN
Pursuant to Section 508 of the Title I Housing and Community Development Act of
1974 (as amended in 1990) the Village of Lemont must have a written Citizen
Participation Plan which provides a framework for public participation. The Village
of Lemont's Citizen Participation process of the CDBG program is as follows:
1. The Village held a public hearing on June 14, 1999 in order to present the CDBG
Application.

2. The meeting was announced on 5/27 , 1999 in the Newspaper, which is a
publication of local circulation.
3. Citizens were welcome to make comments or suggestions any time prior to
submission of the Application.
4. The Village has allowed for technical assistance to representatives of low and
moderate - income persons, and for other eligible applicants.
5. The Village Board at the June 14, 1999 regular meeting of the Lemont Village
Board approved a resolution approving the Application.
6. A copy of the Application will remain on file in the Village Clerk's office for
review and comment throughout the program year.
FORM D
ASSURANCES
The Applicant hereby assures and certifies that it will comply with the regulations, policies,
guidelines and requirements with respect to the acceptance and use of Federal funds for
this federally- assisted program. Further, the Applicant gives assurances and certifies with
respect to the grant that:
A. It possesses legal authority to make a grant submission and to execute a community
development and housing program.
B. Prior to submission of its application to Cook County, the Applicant is following a
detailed citizen participation plan which meets citizen participation requirements
under 24 CFR Section 91.105, prepared its final statement of Community
Development and projected use of funds, and made the application available to the
public, as required by 24 CFR Section 91.105.
C. It is following a detailed citizen participation plan which:
1. Provides for and encourages citizen participation, with particular emphasis on
participation by persons of low and moderate income who are residents of
slum and blighted areas, and of areas in which funds are proposed to be
used, and provides for participation of residents in low and moderate income
neighborhoods as defined by the local jurisdiction;
2. Provides citizens with reasonable and timely access to local meetings,
information, and records relating to the Applicant's proposed use of funds, as
required by the regulations of the Secretary of HUD, and relating to the actual
use of funds under the Housing and Community Development Act of 1974,
as amended;
3. Provides for technical assistance to groups representative of persons of low
and moderate income that request such assistance in developing proposals
with the level and type of assistance to be determined by the Applicant;
4. Provides for public hearings to obtain citizen views and to respond to
proposals and questions at all stages of the community development
program, including at least the development of needs, the review of proposed
activities, and review of program performance, which hearings shall be held
after adequate notice, at times and locations convenient to potential or actual
beneficiaries, and with accommodation for the disabled;
5. Provides for a timely written answer to written complaints and grievances,
within 15 working days where practicable;

6. Identifies how the needs of non - English speaking residents will be met in the
case of public hearings where a significant number of non - English speaking
residents can be reasonably expected to participate.
D. It has developed a community development plan, for the period specified by Cook
County, that identifies community development and housing needs and specifies
both short- and Tong -term community development objectives that have been
developed in accordance with the primary objectives and requirements of the
Housing and Community Development Act of 1974, as amended.
1. It is following a current Consolidated Community Development Plan (CP)
which has been prepared by the County of Cook and which has been
approved by HUD pursuant to 24 CFR Part 91, and which meets the
requirements of Section 104(c)(1) of the Housing and Community
Development Act of 1974, as amended, and that any housing activities to be
assisted with CDBG funds will be consistent with the Consolidated Plan.
2. It has developed its application so as to give maximum feasible priority to
activities which benefit low- and moderate - income families, or aid in the
elimination of slums or blight.
3. It is following a current Consolidated Plan strategy which has been prepared
and approved by HUD in accordance with Section 105 of the Cranston
National Affordable Housing Act.
E. It has developed its program so as to give maximum feasible priority to activities
which benefit low- and moderate - income persons, or to aid in the elimination of slum
or blight.
F. It will minimize displacement of persons as a result of activities assisted with federal
funds for this federally- assisted program.
G. It will not attempt to recover any capital costs of public improvements assisted in
whole or part under Section 106 or with amounts resulting from a guarantee under
Section 108 of the Housing and Community Development Act of 1974, as
amended, by assessing any amount against properties owned and occupied by
persons of low and moderate income, including any fee charged or assessment
made as a condition of obtaining access to such public improvements unless (1)
funds received under Section 106 are used to pay the proportion of such fee or
assessment that relates to the capital cost of such public improvements that are
financed from revenue sources other than under Title I of the Act; or (2) for
purposes of assessing any amount against properties owned and occupied by
persons of moderate income, the Applicant certifies to the County that it lacks
sufficient funds received under Section 106 to comply with the requirements of
subparagraph (1).

H. Its chief executive officer, chief elected official, or other officer of the Applicant
approved by Cook County:
1. Agrees that County of Cook shall assume the status of a responsible Federal
official under the National Environmental Policy Act of 1969 and other
authorities as specified in 24 CFR 58.5; and
2. Is authorized and consents on behalf of the Applicant and himself /herself to
accept the jurisdiction of the Federal courts for the purpose of enforcement
of his /her responsibility of such an official.
i. The grant will be conducted and administered in compliance with the following
requirements:
1. The Applicant in its municipal operations and in the administration of this
Agreement will affirmatively further fair housing.
2. i. Title VI of the Civil Rights Act of 1964 (42 U.S.C. Section 2000d et
seq.) and implementing regulations issued at 24 CFR Part 1; and
ii. The Fair Housing Act (18 U.S.C. Section 3601, et seq.);
3. Title VIII of the Civil Rights Act of 1968 (Pub. L. 90 -284), as amended;
4. Section 109 of the Housing and Community Development Act of 1974, as
amended; and the regulations issued pursuant thereto, as amended;
5. Section 3 of the Housing and Urban Development Act of 1968, as amended;
6. Executive Order 11246, as amended by Executive Order 11375 and 12086,
and implementing regulations issues at 41 CFR Chapter 60, as amended;
7. Executive Order 11063, as amended by Executive Order 12259, and
implementing regulations at 24 CFR Part 107, as amended;
8. Section 504 of the Rehabilitation Act of 1973 (Pub. L. 93-112), as amended,
and implementing regulations issued at 24 CFR Part 8, as amended;
9. The Age Discrimination Act of 1975 (Pub. L. 94 -135), as amended, and
implementing regulations when published for effect;
10. It will comply with the acquisition and relocation requirements of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act of 1970, as
amended, as required under Section 570.606(b) and Federal implementing
regulations at 49 CFR 24; the requirements in Section 570.606(c) governing
the residential antidisplacement and relocation assistance plan under section

-104(d) of the Act (including a certification that the Applicant is following
such a plan); the relocation requirements of Section 570.606(c) governing
displacement subject to section 104(k) of the Act; and the relocation
requirements of Section 570.606(d) governing optional relocation assistance
under section 105(a)(11) of the Act;
11. The labor standards requirements as set forth in 24 CFR Section 570.603,
Subpart K and HUD regulations issued to implement such requirements, as
amended; including but not limited to Davis -Bacon (40 USC 27A - 276A -5),
as amended, and the Contract Work Hours and Safety Standards Act, as
amended, (40 USC 327 et. seq.);
12. Executive Order 11988 relating to the evaluation of flood hazards and
Executive Order 11288 relating to the prevention, control, and abatement of
water pollution;
13. The National Flood Insurance Program (Section 201 (d), 42 USC 4105 (d),
and the flood insurance purchase requirements of Section 102(a) of the Flood
Disaster Protection Act of 1973 (Pub. L. 93 -234, 42 USC 4012a); and
14. The regulations, policies, guidelines and requirements of 24 CFR Parts 570,
84 and 85 and OMB Circulars A -87, A -122, A -128, and A -133, as applicable,
as they relate to the acceptance and use of Federal funds under this
federally- assisted program, and as amended from time to time.
15. The Americans with Disabilities Act, as amended from time to time (42 USC
Section 12101,et. sea.)
J No member, officer or employee of the Applicant, or its designees or agents, no
member of the governing body of the Applicant, and no other official of such
Applicant who exercises any functions or responsibilities with respect to the
program during his /her tenure or for one year thereafter shall have any interest,
direct or indirect, in any contract or subcontract, or the process thereof, for work to
be performed in connection with the program assisted under the Grant, and that it
shall incorporate, or cause to be incorporated, in all such contracts or subcontracts
a provision prohibiting such interest pursuant to the purposes of this certification.
The Applicant and its officers, agents, and employees will comply with 24 CFR
Sections 85.36 and 570.611, as applicable.
K. No funds under this Agreement will be used for, or in aid, of any personal political
purpose, and it will comply with the provision of the Hatch Act which limits the
political activity of employees.
L. It will give HUD, the Comptroller General, and the County, or any authorized
representatives of each of them, access to and the right to examine all records,
books, papers, or documents related to the grant.

M. It will comply with the lead based paint requirements of 24 CFR Part 35 issued
pursuant to the Lead -based Paint Poisoning Prevention Act (42 U.S.C. 4821- 4846);
and, that its notification, inspection, testing and abatement procedures concerning
lead -based paint will comply with 24 CFR Section 570.608.
N. If a facility is developed as a result of the assisted activities, no unreasonable fee,
may be charged, for use of such facility, and such fee, if charged, must not have
the effect of precluding use by low and moderate income persons.
0. No CDBG funds will be used to employ, award contracts to, or otherwise engage
the services of, or fund any contract or subcontractor of recipient during any period
of debarment, suspension or placement on ineligibility status under the provisions of
24 CFR Part 24 or 24 CFR Sections 85.35 or 570.609, as applicable, and Executive
Order 11246, as amended by Executive Order 12086,
P. It will provide a copy of its audit to the County as a "Major" recipient under The
Single Audit Act of 1984, regardless of the amount of block grant funds received in
any one fiscal year.
Q. i. In accordance with Section 519 of Public Law 101 -144, (the 1990 HUD
Appropriations Act), the Applicant, if a municipality certifies that it has
adopted and is enforcing a policy prohibiting the use of excessive force by its
police department against any individuals engaged in nonviolent civil rights
demonstrations;
ii. The Applicant, if a municipality, certifies that it has a policy of enforcing
applicable state and local laws against physically barring entrance to or exit
from a facility or location which is the subject of such nonviolent civil rights
demonstrations within its jurisdictions;
R. The Applicant certifies to the best of its knowledge and belief, that:
(1) No Federal appropriated funds have been paid or will be paid, by or on behalf of
the Applicant, to any person for influencing or attempting to influence an officer or
employee of an agency, a Member of Congress, an officer or employee of Congress,
or an employee of a Member of Congress in connection with the awarding of any
Federal contract, the making of any Federal grant, the making of any Federal loan,
the entering into of any cooperative agreement, and the extension, continuation,
renewal, amendment, or modification of any Federal contract, grant, loan, or
cooperative agreement;
(2) If any funds other than Federal appropriated funds have been paid or will be aid
to any person for influencing or attempting to influence an officer or employee of
any agency, a Member of Congress, an officer or employee of Congress, or an
employee of a Member of Congress in connection with a Federal contract, grant,
loan, or cooperative agreement, the undersigned shall complete and submit Standard
Form -LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions;

(3) The Applicant shall require that the language of this certification be included in
the award documents for all subawards at all tiers (including subcontracts,
subgrants, and contracts under grants, loans, and cooperative agreements) and that
all subrecipients shall certify and disclose accordingly;
This certification is a material representation of fact upon which reliance was placed
when this application was made and considered. Submission of this certification is
a prerequisite for making or entering into a transaction pursuant to this application
as imposed by section 1352, title 31, U.S. Code. Any person who fails to file the
required certification shall be subject to a civil penalty of not less than $10,000 and
not more than $100,000 for each such failure;
S. The Applicant understands that, if it receives a grant, it will be required to comply
with both the Federal Drug Free Workplace Act, if applicable, and the Illinois Drug
Free Workplace Act.
T. The signature of the Chief Executive Officer, Chief Elected Official or designated
representative of the Applicant on the Application to which this Form D is attached
is a certification of the above assurances.

FAIR HOUSING ACTION PLAN INSTRUCTIONS
A. Section 104(b)(2) of the Housing and Community Development Act of 1974, as
amended, prohibits the U.S. Department of Housing and Urban Development (HUD)
from making a Community Development Block Grant unless the Grantee certifies to
the satisfaction of HUD that the grant will be conducted and administered in
conformity with the Civil Rights Act of 1968 (P.L. 90 -284). The 1968 Civil Rights
Act requires that HUD administer all housing and community development programs
in such a manner so as to affirmatively further fair housing.
B. On the basis of these two provisions of law, HUD requires that Cook County must
certify that it will comply with Title VIII of the Civil Rights Act of 1968,
administering all programs and activities relating to housing and community
development in a manner that affirmatively furthers fair housing.
C. In order to fulfill this certification, Cook County, and each applicant for Community
Development Grant funds must take actions each year to affirmatively further fair
housing. Examples of actions available to Subgrantees to fulfill this certification
include, but are not limited to, the followings
1. The enactment of a fair housing ordinance as an affirmative statement to
address fair housing violations. The Northeastern Illinois Planning Commission
(NIPC) has developed a model fair housing ordinance for guidance;
2. The creation of a human rights commission. NIPC has also developed a guide
for establishing a human relations /rights commission. Applicants may also
contact Cook County's Human Rights Commission for assistance;
3. The identification of local barriers to fair housing choices. These barriers are
actions, omissions, or decisions which have the effect of restricting available
housing choice because of race, color, religion, gender, disability, familial
status or national origin.
4. Outreach and counseling services to those racial groups underrepresented
within the jurisdiction, through advertising in minority media and contact with
minority civil rights, community and religious groups;
5. The provision of education programs on fair housing and human relations for
local real estate professionals, religious, civic and community leaders,
government employees and others;
6. Support and assistance to fair housing groups;
7. Organizing business, religious, civic, community, and political leaders to
support and act to further fair housing; and

8. Providing financial, legislative and other support to enable the provision of
affordable and low- income housing within the jurisdiction;
9. The use of HUD affirmative marketing plans;
10. The solicitation of banks and financial institutions for the development of
voluntary affirmative lending plans;
11. The encouragement of local builders, during the permit process, to provide
voluntary affirmative home marketing plans; and
12. The provision of local compliance and monitoring processes.
D. Each municipal Subgrantee's application submitted to Cook County must contain a
completed Fair Housing Action Plan Form setting out its Fair Housing Action Plan
(FHAP), describing the actions that will be taken by the Subgrantee to affirmatively
further fair housing. Any intergovernmental agency funded by Cook County must
submit an Action Plan from each of its participating municipalities, outlining specific
actions to be taken by each community. This Plan should include, but is not limited
to, one or more of the actions above. Each Subgrantee's Fair Housing Action Plan
must be included as Dart of the CDBG application. Cook County will review these
Plans for acceptability before a subgrantee's application for funds is approved. A
FHAP is required from the municipality in which the project site is located, and must
be certified by the governing body of that municipality before submission to Cook
County.
At a minimum the FHAP must have identifiable steps and actions set out in a
timetable and for which the applicant will be responsible during the CDBG Program
Year. FHAP performance will be reviewed by Cook County at the completion of the
Program Year with the submission of the Subgrantee Performance Report and
monitored throughout the year. If the Subgrantee has recently passed a Fair
Housing Ordinance, a certified copy must be submitted with the application. If the
Ordinance has been amended since the last CDBG application, a certified copy of
the amended ordinance must accompany the application. Subgrantees who require
technical assistance to complete the FHAP can contact the Cook County
Commission on Human Rights at (312) 603 -1100, Jennifer Vidis, Executive
Director.
E. All fair housing ordinances need to be updated to include "handicap" and "familial
status" on the list of impermissible bases for housing discrimination regarding Fair
Housing Amendments Act of 1988 ( "FHAA ") 42 USCA Section 3601 et. seq.
PLEASE NOTE: The definition of "handicap" includes persons who have tested HIV -
positive. It also includes people suffering from impairments as a result of prior use
or addiction to an illegal controlled substance.
(Unlike the ADA, the FHAP does not exempt religious organizations from its
accessibility requirements).

FAIR HOUSING ACHIEVEMENTS (PROGRAM YEAR 1999)
SUBGRANTEE: VILLAGE OF LEMONT
The Village of Lemont continues to uphold its Fair Housing Ordinance. which was
updated late in 1993 to include provisions recommended by the Northeastern
Illinois Planning Commission to protect the housing rights of the mentally
handicapped and families with children.
During the last program year, the Village advertised and promoted the Fair Housing
Ordinance. The Village promoted the Fair Housing Ordinance in the Village
Newsletter and also advertised on Mediaone Cable the Fair Housing Ordinance on
Channel 6, the local access cable channel for Lemont Township.
The Village has increased code enforcement activities significantly since 1994, when
first undertaken by the municipality. Through these efforts, the Village has been
able to identify several eligible participants for rehab assistance. The code
compliance efforts required no structures to be permanently evacuated during 1998
due to substandard living conditions and code violations. The Village continues to
work closely with Lemont Township and local church Rroups to find alternative
housing for residents when required. The Village has been working with residents
in obtaining CDBG assistance through Financial Community Development
Corporation to rehab the deficient structures to a habitable condition, thus retaining
affordable housing in the community.
During the previous program year. the Village headed a new committee to study
local housing situations with low to moderate income households. The group in the
future may also review problems relating to upholdingthe Fair Housing Ordinance.

Village Departments, including Community Development, Building, Public Works
and Police, the Lemont Fire Protection District, the Emergency Services and
Disaster Agency. the Lemont Park District, Lemont Township, and the local church
council.
The initial goal of this group would be to respond to situations where low and
moderate income households are displaced either by Acts of God or by involuntary
displacement due to unsafe housing conditions. This group would respond to such
actions by finding alternative housing, financial assistance and providing other aid
as necessary. Currently there is no official plan for these organizations to act for low
and moderate income housing situations. The ultimate goal is to have an integrated
crisis response team in place for such situations.

Another goal of this commission could be to review situations where the Fair
Housing Ordinance is violated or is not being upheld. Issues that may be reviewed
by this commission could include: 1) reviewing possible restrictions or barriers to
fair housing in the Village. 2) researching why few minorities live in the Village. and
3) respond to any complaints of violations of the Fair Housing Ordinance.
The Village has been actively involved in attending the SHIM group meetings since
the organization's creation. This group. as well as the PLOWS group. actively
supports fair and affordable housing for seniors of low and moderate income.
During 1998. the Village approved final plat approvals for a new. 43 unit senior
housing development in the downtown area. This development would provide for
lower than market rents and would be restricted to senior citizens and their spouses
only. Construction will begin in spring of 1999.
