RESOLUTION APPROVING A GRANT OF EASEMENT FOR DRAINAGE,
MAINTENANCE & CONSTRUCTION AT 401 LEMONT STREET
WHEREAS, the Village of Lemont has received a Grant of Easement for drainage,
maintenance and construction, attached as Exhibit 1 for property located at 401 Lemont Street;
and
WHEREAS, said Grant of Easement shall provide the Village of Lemont the authority to
install, construct, and maintain a drainage system as may be necessary.
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont that the Grant of Easement attached hereto be hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE,

RELEASE OF ALL CLAIMS
The undersigned, GEORGE CAVALENES and KATHLEEN CAVALENES, husband and
wife, hereby acknowledge receipt of the total sum of FOUR THOUSAND SIX HUNDRED THIRTY
SIX AND 01 /100 DOLLARS ($4,636.01) paid to the undersigned by the VILLAGE OF LEMONT,
hereinafter referred to as "Releasee ", and in consideration thereof, the undersigned hereby remise,
release and forever discharge the VILLAGE OF LEMONT, their agents, servants, employees,
officers, insurers, successors, and assigns, and each and every one of them, of and from all claims and
demands, including, but not limited to, claims for punitive damages, which the undersigned now have
or claim to have, or which may hereafter accrue against the said Releasee, arising or growing out of
any accident, casualty or event occurring at any time before the date hereof, including, without
limiting the generality of the foregoing, all claims and demands arising or growing out of an accident,
casualty or event which occurred on or about April 8, 1999, at or near the area of 401 Lemont Street,
Village of Lemont, County of Cook, State of Illinois, whereby the undersigned were injured in person
and/or property by reason of said incident which occurred on or about April 8, 1999.
The undersigned further agree to grant unto the VILLAGE OF LEMONT, a public utility
and drainage easement adjoining the east and north portion of their property as more particularly
described on the attached Plat of Easement.
The undersigned hereby agree to defend, protect, indemnify and save harmless the said
Releasee from any damage, settlement, costs or attorney's fees incurred, if any person, firm or
corporation shall assert or attempt any claim by reason of the foregoing matters.
The said Releasee has denied and still deny that they, are liable for the loss sustained by the
undersigned, and the amount paid by or on behalf of said Releasee is paid in settlement and
compromise of claims made by the undersigned, or on their behalf. No promise has been made to pay
any further or other sums or other consideration for this Release. As part of the consideration for
payment to the undersigned of the amount hereinabove mentioned, the undersigned hereby release
all claims, including all those for known and unknown, anticipated and unanticipated injuries and
damages.
The undersigned are of legal age and under no disability and have relied upon the advise and
representation of counsel of their own selection and have read and understand fully the above and
foregoing release and have been fully advised as to the legal effect thereof.

Dear Rose:
There is a vacated alley that exists south of Cass Street, east of Lemont Street. I need to
find out if the Village reserved the right for a drainage easement over this vacated alley. I
don't know when the alley was vacated. If you can find any information on this, it would be
greatly appreciated_ Otherwise, I have to do some type of Title search.
