RESOLUTION APPROVING FINAL PLAT OF SUBDIVISION
FOR GALLAGHER & HENRY'S COVINGTON KNOLLS
TOWNHOMES, UNIT TWO
WHEREAS, the petitioner is the owner of certain property consisting of approximately 7.48
acres generally located south of McCarthy Road in Lemont, Illinois and legally described in Exhibit
"A" attached; and
WHEREAS, the petitioner has prepared a Final Plat of Subdivision for the subject property,
which is known as "Covington Knolls Townhomes, Unit Two" ; and
WHEREAS the petitioner has submitted the Final Plat of Subdivision for a forty (40) unit
townhome subdivision to be known as "Covington Knolls Townhomes, Unit Two ", attached
hereto as Exhibit "B ", and;
WHEREAS, the Final Plat of Subdivision is in substantial conformance with the physical
development policies and standards of the Village of Lemont; and
WHEREAS, the Final Plat of Subdivision is in conformance with the Preliminary Plat of
Subdivision as approved by the Village Board on April 14, 1997.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Final Plat for "Covington Knolls Townhomes, Unit Two" , which is
attached hereto and made part hereof, is hereby approved subject to the conditions attached as
Exhibit "C" and with a Variance to the Subdivision Design Standards to allow the detention area to
be 12 feet in depth instead of the maximum allowable four (4) feet in depth.

CONDITIONS OF APPROVAL
The following items shall be added to and/or corrected on the Final Plat prior to recording:
a) all public utility and drainage easements shall be increased from 10 feet to 15 feet per Village
Ordinances, with the exception of those easements which would be adjacent to areas which may
have additional easement dedication through future phases of development;
b) a 20 -foot PUD easement shall be added within the Badger Pipeline Easement to allow a storm
sewer to remain in this area;
c) property PIN numbers;
d) the entity to send the next tax bill to;
e) the school district notification certificate /note shall be added to the Plat;
f) all areas noted as "Northern Illinois Gas" shall be changed to "NICOR ", and "Continental
Cablevision" shall be changed to "AT &T Cable Services ";
g) floodplain panel numbers to the engineer's certificate;
h) a signature on the owner's certificate;
I) a note stating "All future tax divisions for the townhouse units shall extend from the front of the
platted lot line to the rear of the platted lot line. No common areas shall be created within the
platted lots of record. "; and
j) a letter of approval for the proposed grading with the Park areas shall be submitted from the Park
District Engineer.
2) Seven (7) dead, and Eleven (11) partially dead trees shall be replaced along the south line of Old Derby
Estates no later than April 30 of 2000;
3) A parkway tree planting plan shall be submitted for approval prior to the recordation of the Plat;
4) Street Names shall be approved by the Lemont Fire Protection District;
5) The access easement area to the Park site shall be maintained by the townhome owners association, unless
the Lemont Park District agrees to maintain it.
6) The Village will take ownership of Lot 13 (Detention Lot) and will assume responsibility for maintenance
of the detention areas.

Dear Mr. Wang,
Per our meeting we wish to reconfirm our position with the revised
drainage calculations for the above referenced project. We have
reviewed the revised plan and calculations and find they are in general
conformance with our concerns. At the same time they may help the
adjacent Old Derby Estates that has been the Village's focus of
concern for many years.
We wish to reiterate that we are in support of this revised plan. It
shows that working together a solution can be attained that is amiable
to all. This solution should not decrease number of lots, affect the
park district's ball fields, nor increase flow rates to properties
downstream, and yet possibly assist in reducing flooding events for
existing residents. This solution is truly a win -win scenario.
Let me express our thanks to your department for listening to our
concerns and following this project to the present settlement.

Dear Scott,
We wish to confirm our conversation yesterday wherein we agreed that Gallagher
& Henry will deed to the Lemont Park District all of proposed Lot 146 in Covington
Knolls Unit 3 (the 3.3 acre; tract on 127th Street west of Covington Drive) without any
additional consideration, in even exchange for acreage at the east end of Covington
Knolls that was planned and approved for park use but now must be excavated for
additional storm water detention to replace depressional storage on the property in its
natural condition. The additional stoat water detention is among the improvements
planned for Covington Knolls Townhomes Unit 2 because IDDT made it a condition to
granting its permit for certain improvements in the McCarthy Road right of way,
including a street entrance to the development and left turn lanes. We will convey the lot
to the Park District promptly after securing final plat approval for Covington Knolls
Townhomes Unit 2.
The Village, in tuns, will not require Gallagher & Henry to waive the reversionary
residential use for Parcel 4 (the 3.3 acre and 7.7 acre tracts east and west of Covington
Drive on the north side of 127t Street) as a condition to securing final plat approval for
Covington Knolls Townhomes Unit 2.

Dear Bob,
Please be advised that we have reached agreement with the Village regarding
certain matters related to Covington Knolls Townhomes Unit 2, the substance of which
insofar as if affects the Park District is this. We will deed to the Park District the entire
3.3 acre tract on 127th Street, west of Covington Drive (Lot 146 in proposed Covington
Knolls Unit 3) without any additional consideration. Up to this point our agreement
with the Park District was that the Park District would compensate Gallagher & Henry to
the extent the lot exceeded in area the park acreage at the east end of the development
that is to be taken by Gallagher for additional storm water detention. Compensation for
the excess acreage is no longer necessary. We will deed the lot the Park District
promptly after securing final plat approval for Covington Knolls Townhomes Unit 2.
I remind you the Village has made written acceptance by the Park District of the
existing grading conditions on the 127th Street site a condition (among others) to
approving the final plat for Covington Knolls Townhomes and the foregoing exchange of
property. Would you please prepare a letter to that effect and forward same to the
attention of either the Vill age Manager or the Planning Director? Thank you.

CONDITIONS OF APPROVAL
1) The following items shall be added to and/or corrected on the Final Plat prior to recording:
a) all public utility and drainage easements shall be increased from 10 feet to 15 feet per Village
Ordinances, with the exception of those easements which would be adjacent to areas which may
have additional easement dedication through future phases of development;
b) a 20 -foot PUD easement shall be added within the Badger Pipeline Easement to allow a storm
sewer to remain in this area;
c) property PIN numbers;
d) the entity to send the next tax bill to;
e) the school district notification certificate /note shall be added to the Plat;
f) all areas noted as "Northern Illinois Gas" shall be changed to "NICOR ", and "Continental
Cablevision" shall be changed to "AT &T Cable Services ";
g) floodplain panel numbers to the engineer's certificate;
h) a signature on the owner's certificate;
I) a note stating "All future tax divisions for the townhouse units shall extend from the front of the
platted lot line to the rear of the platted lot line. No common areas shall be created within the
platted lots of record. "; and
j) a letter of approval for the proposed grading with the Park areas shall be submitted from the Park
District Engineer.
2) Seven (7) dead, and Eleven (11) partially dead trees shall be replaced along the south line of Old Derby
Estates no later than April 30 of 2000;
3) A parkway tree planting plan shall be submitted for approval prior to the recordation of the Plat;
4) Street Names shall be approved by the Lemont Fire Protection District;
5) The access easement area to the Park site shall be maintained by the townhome owners association, unless
the Lemont Park District agrees to maintain it.
6) The Village will take ownership of Lot 13 (Detention Lot) and will assume responsibility for maintenance
of the detention areas.

Per our meeting we wish to reconfirm our position with the revised
drainage calculations for the above referenced project. We have
reviewed the revised plan and calculations and find they are in general
conformance with our concerns. At the same time they may help the
adjacent Old Derby Estates that has been the Village's focus of
concern for many years.
We wish to reiterate that we are in support of this revised plan. It
shows that working together a solution can be attained that is amiable
to all. This solution should not decrease number of Tots, affect the
park district's ball fields, nor increase flow rates to properties
downstream, and yet possibly assist in reducing flooding events for
existing residents. This solution is truly a win -win scenario.
Let me express our thanks to your department for listening to our
concerns and following this project to the present settlement.

The outstanding hydraulic issues regarding Covington Knolls subdivision issued under
1D OT permit number 1- 94.0645 have been recnlved. Now we are awaiting only a
letter of local concurrence from Lemont Township. We will therefore proceed with a
view of Unit 2 of the subdivision_ In view cif the number of units prop. sod and the
potential for additional development to the east we feel a left turn lane is required on
McCarthy Road at the proposed aarton Drive. Kindly use the attached Figure 3 -226a
to design the appropriate left turn channelizativn for this access and resubmit three (3)
copies for our review.

We wish to confirm our conversation yesterday wherein we agreed that Gallagher
& Henry will deed to the Lemont Park District all of proposed Lot 146 in Covington
Knolls Unit 3 (the 3.3 acre tract on 127th Street west of Covington Drive) without any
additional consideration, in even exchange for acreage at the east end of Covington
Knolls that was planned and approved for park use but now must be excavated for
additional storm water detention to replace depressional storage on the property in its
natural condition. The additional storm water detention is among the improvements
planned for Covington Knolls Townhomes Unit 2 because IDOT made it a condition to
granting its permit for certain improvements in the McCarthy Road right of way,
including a street entrance to the development and left turn lanes. We will convey the lot
to the Park District promptly after securing final plat approval for Covington Knolls
Townhomes Unit 2.
The Village, in turn, will not require Gallagher & Henry to waive the reversionary
residential use for Parcel 4 (the 3.3 acre and 7.7 acre tracts east and west of Covington
Drive on the north side of 127t Street) as a condition to securing final plat approval for
Covington Knolls Townhomes Unit 2.

Please be advised that we have reached agreement with the Village regarding
certain matters related to Covington Knolls Townhomes Unit 2, the substance of which
insofar as if affects the Park District is this. We will deed to the Park District the entire
3.3 acre tract on 127th Street, west of Covington Drive (Lot 146 in proposed Covington
Knolls Unit 3) without any additional consideration. Up to this point our agreement
with the Park District was that the Park District would compensate Gallagher & Henry to
the extent the lot exceeded in area the park acreage at the east end of the development
that is to be taken by Gallagher for additional storm water detention. Compensation for
the excess acreage is no longer necessary. We will deed the lot the Park District
promptly after securing final plat approval for Covington Knolls Townhomes Unit 2_
I remind you the Village has made written acceptance by the Park District of the
existing grading conditions on the 127th Street site a condition (among others) to
approving the final plat for Covington Kno11s Townhomes and the foregoing exchange of
property. Would you please prepare a letter to that effect and forward same to the
attention of either the Village Manager or the Planning Director? Thank you.
