WHEREAS, the Village of Lemont and Lemont High School District 210 are entering into an "Agreement for school Liaison Officer "; and Whereas, the Village of Lemont (a Municipal Corporation of Illinois) and Lemont High School District 210 (herein after "School District ") agree the initiation of the school Liaison Officer Program is desirable. NOW THEREFORE, SO IT BE RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THAT THE ATTACHED INTERGOVERNMENTAL AGREEMENT BE APPROVED. SMOLLEN, Village Clerk Approved to Form: JOHN ANTONOPOULOS, Village Attorney INTERGOVERNMENTAL AGREEMENT FOR LEMONT HIGH SCHOOL DISTRICT 210 SCHOOL LIAISON OFFICER WHEREAS, the Village of Lemont and Lemont High School District 210 are entering into an "Agreement for School Liaison Officer"; and WHEREAS, the Village of Lemont (a municipal corporation of Illinois) and Lemont High School District 210 (hereinafter "School District ") agree that the initiation of the School Liaison Officer Program is desirable. NOW, THEREFORE IN CONSIDERATION OF THE FOREGOING, the "Agreement for School Liaison Officer", and the covenants hereinafter set forth, the parties agree to the Agreement for School Liaison Officer, dated December 13, 1999, as follows: Paragraph 1. That the parties hereto recognize the need for the supplying of a regular sworn Lemont Officer as a School Liaison Officer at Lemont High School during normal school hours, and the Village hereby agrees to supply to the School District an officer employed by the Village of Lemont Police Department to fulfill the requirements and job description of "School Liaison Officer ", meeting the requirements and to provide the fulfillment of the duties described in job description attached hereto. Paragraph 2. The School Liaison Officer shall serve at Lemont High School on days of regular school attendance during the hours in which the school is open, but at all times shall remain an employee of the Village of Lemont Police Department and subject to call to other duties by the Lemont Police Department as the Village or its Chief of Police shall determine. For purposes of reimbursement to the Village, the number of days per week the School Liaison Officer will be on duty at the high school will be determined by enrollment according to the following schedule. At its own expense, the Village, or its Chief of Police, may assign the School Liaison Officer to serve at Lemont High School for time in addition to the following schedule: School Enrollment Number of Days Assigned 800 2 900 2.5 1000 3 1150 3.5 1300 4 1450 4.5 1600 5 Paragraph 3.1. The School Liaison Officer's wages and all other benefits shall be paid by the Village, and the Village shall advise the School District as to the amount of the wages of the School Liaison Officer due and payable to the School Liaison Officer on account of the School Liaison Officer's employment with the Village as identified in this Agreement. 1 Paragraph 3.2. The School District agrees to reimburse and pay the Village fifty (50) percent of the wages paid to the School Liaison Officer for the agreed upon hours spent at Lemont High School during normal school hours. The Village shall invoice the School District the amount determined on a biweekly basis, and the School District shall pay that invoice in accordance with State law. Paragraph 3.3. The Village of Lemont shall protect, defend, indemnify and hold the School District harmless from any employment claims brought by or against the School Liaison Officer including, but not limited to, suits or administrative actions charging discrimination, civil rights violations, noncompliance with employment statutes, worker's compensation, improper salary withholding, improper overtime reimbursement, improper income tax withholding and any claims involving property damage or personal injury. It is the parties' specific understanding and intent that the School Liaison Officer be an employee of the Village. Paragraph 4. During vacation periods when the School is closed, the School Liaison Officer shall be available solely for such Village duties as shall be prescribed by the Lemont Police Department. Paragraph 5. That all other terms and conditions as set forth in this Intergovernmental Agreement for a Lemont High School District 210 Liaison Officer dated December 13, 1999, shall remain in full force and effect until either the Village Board or the Lemont High School District 210 Board of Education officially votes to eliminate this Agreement with a one (1) month advanced termination notice. This Agreement shall go into effect upon its approval by both the Village Board and the School Board. General: The Police Liaison Officer's position is held by a sworn police officer. The purpose of the position is as follows: 1. Provide the Lemont Police Department and Lemont High School officials with a direct line of communication and resource for dealing with problems of mutual concern. 2. Provide instruction in drug responsibility, substance abuse, or other agreed upon curriculum. The Police Liaison Officer must maintain a delicate balance between the aspects of social service counseling and law enforcement principles. Uppermost in the Liaison Officer's mind should be the fact that youthful offenders shall not be handled as criminals, but rather as individuals in need of counseling. B. Duties: The Police Liaison Officer's functions may vary, but generally the officer's duties shall be as follows: The Police Liaison Officer shall be governed by the Police Department's Rules and Regulations, and shall adhere to said Rules. In addition, the Liaison Officer shall be responsive to the administrative policies as set down by the District 210 School Administration. If a conflict arises, such conflict must be rectified through the Police Department and School District Administrative Offices. C. Duty Hours: The Liaison Officer shall report to the High School on normal school days at 0745 hours. The job description and assignment calls for occasional attendance at extracurricular activities. Scheduling for said assignments shall be accomplished in advance, and any overtime compensation shall be accomplished by the School District. 1 D. Position Responsibilities: The Liaison Officer shall be responsible for the proper handling of all law enforcement tasks that may occur at the High School. The tasks shall be (but not limited to): 1. Building security; 2. Law enforcement; 3. Report processing; 4. Parking and traffic enforcement; 5. Youth — police relations; 6. Special details; 7. Police development. E. Communications: The Liaison Officer must inform both the school administration and the Police Department of his /her whereabouts, if his /her duties preclude his /her being in the School District. In addition, while within the school, the Liaison Officer should advise clerical personnel of his /her whereabouts so he /she can be contacted at a moment's notice. F. Duty Station: The Liaison Officer's duty station is the High School. The High School Administration shall provide administrative services and office space. The Liaison Officer shall remain on school property unless his /her official duties dictate leaving same. If the Liaison Officer must leave his /her duty station, the Police Department and High School Administration must be properly informed. G. Personal Demeanor: The Liaison Officer shall, at all times, present a professional image. The Police Liaison Officer shall be an armed position. H. Vacation: The Liaison Office shall schedule his /her vacation during nonschool periods. 1. Non - school Period Duty Assignments: The Liaison Officer shall report to the Lemont Police Department for duty assignments during non - school periods. Duty assignments during said periods will be made in consideration with the needs of the department by the Chief of Police. 2
