AN ORDINANCE AMENDING TITLE 8, "HEALTH AND SAFETY" BY ADDING SECTION 8.33 "OUTDOOR STORAGE OF MATERIALS" TO THE VILLAGE CODE OF LEMONT, ILLINOIS BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Lemont, Cook, Will and DuPage Counties, Illinois, as follows: SECTION 1 That Title 8, "Health and Safety" be amended by adding Section 8.33, "Outdoor Storage of Materials" to read as follows: 8.33: OUTDOOR STORAGE OF MATERIALS: (A) The storage of combustible or explosive materials within the Village limits is hereby regulated in accordance with the terms of this Ordinance. (B) Unless otherwise allowed under this Ordinance, the outdoor storage of combustible material is hereby regulated as follows: 1. No stockpile of combustible materials shall exceed 1 foot in height per 4,000 square feet of lot area, with a maximum height of fifty (50) feet. 2. No stockpile or stockpiles shall collectively exceed a land coverage ratio of 50% of the land area allocated to a particular lessee or owner of the land as applicable. 3. No stockpile may be located closer than 20 feet to a property line or public or private roadway. 4. Multiple stockpiles shall be separated by an aisle at least 20 foot wide that is passable by motor vehicles or emergency equipment. When required by the Village to avoid stockpile spillover onto access aisles and adjacent properties, stockpiles shall have containment devices installed. 5. No stockpile shall be located closer than 500 feet to a residential use or residential or public land zoning district. (C) This section does not prohibit the storage and maintenance on a continuing basis of an outdoor commercial stockpile of mulch and similar lumber products for resale provided that: (D) (E) 1. All regulations in paragraph (B) above are met. 2. The operator of such stockpile shall monitor it with temperature probes reaching the interior of the stockpile. 3. The stockpile shall be rotated on a regular basis, not less than bimonthly. 4. There shall be two (2) water pumps on site with hoses reaching the entire stockpile and with access to freely available water sufficient to wet down the entire stockpile. 5. The operator of such stockpile shall maintain working fire extinguishers on all of such operator's major equipment operating on or near such stockpile. 6. The operator of such stockpile shall be in compliance with National Fire Protection Association Code Section 46 (NFPA) in all material respects. Combustible materials include paper, lumber, boxes, trash, refuse, auto fluff, auto shredder residue, timber, coal, mulch and similar materials that are burnable at ordinary incinerator temperatures. This section shall not prohibit the outdoor storage in a residential district for not more than one year of lumber, firewood or other materials for consumption on the premises where stored provided that the amount of such materials does not exceed 10 cubic yards and 8 feet in height. SECTION 2 That the penalty clause adopted for the enforcement of this ordinance is Section 1.28.010 which reads as follows: 1.28.010 PENALTY: Pursuant to Chapter 65 ILCS, Illinois Compiled Statutes, 5/1 -2 -1, a violation of any of the provisions of this code shall be a misdemeanor and shall be punishable by a fine of not more than Seven Hundred Fifty Dollars ($750.00) or by imprisonment for a period of not more than six months or both such fine and imprisonment. SECTION 3 If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance. SECTION 4 All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed insofar as they conflict herewith. SECTION 5 This ordinance shall be in full force and effect on June 1, 1998, after passage, approval and publication. This ordinance is authorized to be published in pamphlet form. Any materials presently being stored in violation of this ordinance shall be removed on or before December 1, 1998. This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form.
