DATE OF APPROVAL: V 1-16 oV RESOLUTION APPROVING FINAL PLAT FOR FORDHAM HILLS ESTATES SUBDIVISION WHEREAS, Fordham/JRL L.L.C., successor by assignment from Walter Rebenson of R &R Realty Development Corporation, hereinafter referred to as "the Petitioner," is the owner of a 52- acre parcel, hereinafter referred to as "the subject property," generally located on Main Street between McCarthy Point and Hirsekorn Ridge Subdivision in Lemont, Illinois and legally described in Exhibit "A" attached; and WHEREAS, the petitioner has prepared a Final Plat of Subdivision for the subject property, which is known as Fordham Hills Estates Subdivision; and WHEREAS the petitioner has submitted the Final Plat of Subdivision for 95 single - family detached residences to be known as Fordham Hills Estates Subdivision, attached hereto as Exhibit "B," and; WHEREAS, the Final Plat of Subdivision is in substantial conformance with the physical development policies and standards of the Village of Lemont. 11 NOW,'1HEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the Final Plat for Fordham Hills Estates Subdivision, which is attached hereto and made part hereof, is hereby approved subject to the following conditions and the terms and provisions of the annexation agreement authorized by Ordinance No. 0- 105 -99 : 1. Within 30 days of Village Board approval of the Final Plat, an irrevocable letter of credit in the amount of $3,468,869.00 shall be submitted by the petitioner. The Final Plat shall not be recorded prior to the submittal of said letter of credit. In the event that the cost of improving 4th street is increased as a result of the review comments of the Illinois Department of Transportation (IDOT), the petitioner shall submit an additional irrevocable letter of credit in an amount equal to 125% of said costs; 2. All signatures shall be executed on the plat prior to recordation; 3. Prior to recordation, a revised Final Plat shall be submitted with the following additions /corrections: a) the 25 -foot building line indicated on the northern property boundary abutting Main Street shall be removed; b) Lots 97 and 98 shall be labeled as "Open Space "; c) The cul -de -sac islands at Jaymia Court, Carley Court, Melshane Court and Senon Drive shall be deeded to the Village for ownership and maintenance responsibilities; and d) Lot 101 shall be relabeled to state "Dedicated to the Lemont TWP Park District; e) Stirrup Drive shall be changed to Stirrup Lane. 4. The Village shall accept maintenance and ownership of Lots 97, 98 & 99 with the following conditions: prior to any construction over or within the limits of the former landfill, a plan for maintenance, repair and limiting disturbance within the landfill shall be submitted to the Village for review and approval; b) a site - specific Health and Safety plan shall be developed that discusses appropriate construction worker safety precautions given targeted contaminants detected and the potential for methane gas hazards; c) any materials excavated from the site shall be handled in accordance with applicable federal and state regulations; d) methane concentrations shall be monitored during construction/utility installation activities and efforts shall be made to avoid creating a migratory pathway for the methane gas; e) construction within the former landfill shall be monitored on -site by an environmental consultant selected by the petitioner and approved by the Village. f) the petitioner will make a one -time contribution to the Village in the sum of $10,000 to defray maintenance costs for Lots 97, 98, 99 and 100.
