RESOLUTION AUTHORIZING ADOPTION OF AN AGREEMENT
WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION
FOR THE MAINTENANCE OF SPECIAL PAVEMENT MARKINGS
ON STEPHEN STREET AT THE INTERSECTION OF THE IC RAILROAD
WHEREAS, the Illinois Department of Transportation and Village of Lemont have
committed resources to undertake improvements to Main Street; and
WHEREAS, the Illinois Department of Transportation has installed special pavement
markings at the railroad crossing adjacent to the intersection of Main Street and Stephen Street; and
WHEREAS, the State will maintain the pavement markings for a period of three (3) years
from the date of installation, with subsequent maintenance being the responsibility of the Village; and
WHEREAS, the Village concurs with terms of the agreement.
NOW,'1HEREFORE, BE IT RESOLVED by the President and Board of Trustees that the
attached Local Agency Agreement be approved.

AGREEMENT
This AGREEMENT is entered into by and between the STATE OF ILLINOIS,
acting by and through the Illinois Department of Transportation (the "STATE "),
and the COUNTY including it's ROAD DISTRICTS, CITY, TOWN, or VILLAGE
OF Ley---- , ILLINOIS (the "LOCAL AUTHORITY ").
WITNESSETH:
WHEREAS, the STATE desires to experiment with the SPECIAL PAVEMENT
MARKINGS shown on Exhibit 1 and listed in Exhibit 2, which exhibits are attached
hereto and incorporated herein by reference, on road or street approaches to
railroad grade crossings where the traffic signal for a subsequent STATE highway
and the railroad warning signal system are interconnected; and
WHEREAS, the LOCAL AUTHORITIES, in accordance with Section 11 -304 of
the Illinois Vehicle Code (625 ILCS 5/11 =304) have the responsibility and
authority to place and maintain traffic control devices upon highways and roads
under their jurisdiction; and
WHEREAS, the highway commissioner of each road district, in accordance with
Section 6- 201.16 of the Illinois Highway Code (605 ILCS 5/6- 201.16) has the
power and duty, subject to the written approval of the County Engineer or County
Superintendent of Highways, to place, erect and maintain on township or road
district roads, traffic control devices authorized by the Illinois Highway Code or
by the Illinois Vehicle Code (625 ILCS 5/ -100 et. seq.); and
WHEREAS, the STATE and the LOCAL AUTHORITIES are empowered by the
Illinois Highway Code to enter into cooperative agreements to provide for the
maintenance, administration, engineering, and improvement of any highway or
portion thereof; and
WHEREAS, an intergovernmental cooperative agreement is also an appropriate
method to achieve the purposes of the STATE and the LOCAL AUTHORITIES,
and such an agreement is authorized and encouraged by Article VII, Section 10
of the Constitution of 1970 and the "Intergovernmental Cooperation Act ";
NOW THEREFORE, in consideration of the premises and mutual covenants
contained herein, the parties hereto agree as follows:
1. The STATE shall install, at its expense, experimental SPECIAL PAVEMENT
MARKINGS at those locations listed in Exhibit 2, and maintain the same for a
period of not to exceed three years from the date of installation, except as
noted below.

2. The STATE shall maintain, at its expense, the experimental SPECIAL
PAVEMENT MARKINGS at those locations listed in Exhibit 2, for the length
of the experimentation period, or for not to exceed three years from the date
of installation, which ever occurs first.
3. The STATE shall remove, at its expense, the experimental SPECIAL
PAVEMENT MARKINGS at those locations listed in Exhibit 2, at the end of
the experimentation period, or at the end of three years from the date of
installation, which ever occurs first unless, at that time, said markings have
been approved by the Federal Highway Administration and are required by
the Illinois Manual on Uniform Traffic Control Devices.
4. The LOCAL AUTHORITY shall maintain, at its expense, the SPECIAL
PAVEMENT MARKINGS at those locations listed in Exhibit 2 beginning at
the end of the experimentation period, or at the end of three years from the
date of installation, which ever occurs first, if, at that time, said markings
have been approved by the Federal Highway Administration and are required
by the Illinois Manual on Uniform Traffic Control Devices.
This Agreement shall remain in effect for so long as the experimental SPECIAL
PAVEMENT MARKINGS covered by the terms of this Agreement, or any
Amendment hereto, remain in place, such effective term shall apply unless
otherwise agreed to in writing by the parties hereto.
The STATE's obligations hereunder shall be subject to termination and
cancellation in any year for which the General Assembly of the State of Illinois
fails to make an appropriation or reappropriation to pay such obligations, and the
STATE's obligations hereunder shall also be subject to termination and
cancellation at any time where there are not sufficient authorized funds lawfully
available to the STATE to meet any such obligations.
IN WITNESS WHEREOF, the STATE and the LOCAL AUTHORITY hereto have
caused this AGREEMENT to be made, effective and executed by their
respective duly authorized officials.

Note: 1. Distance to be shown on sign measured from a point
6 feet from the rail closest to the intersection to the stop
bar or crosswalk, which ever is closest, rounded down
to nearest 5 feet. Where there is no stop line, measure
to point where driver has a view of approaching traffic.
2. The clearance sign is also to be used as an interim
measure at locations with interconnected intersection
traffic signals where it is planned to change them to
near -side signals at a future time. In this case, the
distance to be shown on the sign Is measured from the
edge of the striped -out area Instead of 6 -feet from the
rail. The sign is to be removed when the near -side
signals are installed and the pavement markings
extended to the intersection.
