R-38-97 Authorizing Acquisition And Condemnation Of The Property Located At 410 Main StreetRESOLUTION NO. RESOLUTION AUTHORIZING ACQUISITION AND CONDEMNATION OF THE PROPERTY LOCATED AT 410 MAIN STREET WHEREAS, Paragraph 11 -61 -1 of the Illinois Municipal Code, 65 ILCS 5/11-61-1 (1994) grants the authority to municipalities to acquire property by condemnation for municipal purposes or for the public welfare; and WHEREAS, the Lemont Village Board has determined that it is necessary for the public welfare to construct an addition to the police station and municipal parking lot in the Village of Lemont; and WHEREAS, in order to accomplish the construction of said police station and municipal addition and parking lot, it is necessary for the Village to acquire fee simple title to the property with the mailing address of 410 Main Street and permanent index number of 22 -20- 420 -005, together with any and all improvements located on said property; and WHEREAS, the real property the Village is in need of acquiring is legally described in "Exhibit A ", attached hereto and incorporated herein by reference; and WHEREAS, the acquisition of fee simple title is necessary, convenient and desirable for the public welfare to construct an addition to the police station and municipal parking lot. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Cook, Will and DuPage Counties, Illinois, in exercise of the authority granted to it pursuant to Paragraph 11 -61 -1 of the Illinois Municipal Code, as follows: SECTION 1: The Village Attorney, John P. Antonopoulos, of the Village of Lemont is hereby authorized and directed to negotiate with the owner(s) of the subject property to determine a fair and reasonable price for compensation for the acquisition of the subject property. SECTION 2: If an agreement with respect to the compensation for the acquisition of the subject property cannot be reached in a timely manner, the Village Administrator is hereby authorized and directed to commence eminent domain proceedings to acquire the subject property. SECTION 3: This resolution shall be in full force and effect from and after its passage and approval as provided by law.
