ATWITH THIS DOCUMENT RESOLUTION NO.ELLig DATE OF APPROVAL: January 12, 1998 RESOLUTION APPROVING PRELIMINARY AND FINAL PLAT FOR EAGLE CREST ESTATES SUBDIVISION, PHASE III WHEREAS, the petitioner is the owner of certain property consisting of approximately 4.35 acres generally located at 127th Street and Eagle Crest Drive in Lemont, Illinois and legally described in Exhibit "A" attached; and WHEREAS, the petitioner has prepared a Plat of Subdivision for the subject property, which is known as Eagle Crest Subdivision, Phase III; and WHEREAS the petitioner has submitted the Plat of Subdivision for five (5) lots, three (3) single family residential and two (2) commercial to be known as Eagle Crest Subdivision, Phase III, attached hereto as Exhibit "B ", and; WHEREAS, the Lemont Planning & Zoning Commission at its meeting of October 7, 1997, reviewed the Plat and recommended conditional approval of said Plat; and WHEREAS, the Plat of Subdivision is in substantial conformance with the physical development policies and standards of the Village of Lemont. NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the Plat for Eagle Crest Subdivision, Phase III, which is attached hereto and made part hereof, is hereby approved subject to the conditions attached hereto as Exhibit "C ". That Eagle Crest Subdivision, Phase III, shall substantially conform to the preliminary and final plats, attached hereto as Exhibit `B ", except as such plans may be changed to conform to the Village codes and ordinances; 2. A Cook County Highway Department permit is required for ingress/egress access on to 127th Street from lot 85; 3. The developer will contract out the services of a Landscape Consultant for the purposes of developing a suitable analysis, providing to the Village a detailed tree survey, preservation plan and construction management program, intended to maximize the number of trees to be saved and to prevent injury to the remaining trees during the construction period; and 4. A detailed tree survey shall be submitted, including size, health, type of specie and location of each tree on the site prior to recording of the Final Plat; and 5. As outlined under Village Ordinance, a tree preservation and replacement plan is required to be implemented for each lot prior to the issuance of a site development or building permit. As part of the plan, the identification of each tree to remain and protection techniques of the Critical Root Zone (CRZ) for each tree shall be completed by the developer and approved by the Village. The implementation of those techniques will be complete prior to the issuance of a site development or building permit; and Alternative locations for the access easement, parking areas and buildings proposed will be reviewed by the Village and the Landscape Consultant, in order to maximize the number of trees on the site. 7. A 50 -foot wide conservation easement shall be added to the southern 50 feet of Lots 84 and 85, which area will not be disturbed during construction. No improvements will be permitted within this conservation easement. This shall be added to the Plat prior to recording of same. CONSERVATION EASEMENT THE INDENTURE WITNESSETH, That WHEREAS, Emil Marske as sole beneficiary of Standard Bank and Trust Company of Hickory Hills, as Trustee under Trust Agreement dated February 14, 1989 and known as Trust Number 3707 (Grantor), is about to cause or authorize the existence and/or construction of certain Conservation Easement, and, WHEREAS, it is necessary for the Village of Lemont (Grantee) to obtain a perpetual easement, privilege, right and authority to the existence of and/or construction of said Conservation Easement upon, under and through the premises hereinafter described, as shown in cross hatch upon the exhibit hereto attached, and, WHEREAS, the undersigned Grantor is the owner in fee simple of the premises through which said Conservation Easement is to exist, and is willing to grant a perpetual easement upon, under and through said real estate for the purposes herein specified; NOW, THEREFORE, in consideration of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, and of the mutual covenants, conditions and agreements herein contained, Grantor, does hereby give, grant and convey to the Village of Lemont, the perpetual easement, privilege, right, access and authority to the existence of said Conservation Easement upon, under and through the premises owned by the undersigned Grantor set forth and described as follows, to -wit: THE SOUTH 50 FEET OF PARCEL A (COMMERCIAL) WHICH IS THE NORTH 359 FEET (EXCEPT THE EAST 140.42 FEET) OF LOT 71 OF EAGLE CREST ESTATES, UNIT NO. 1 (PLAT RECORDED ON May 18, 1990 AS DOCUMENT NO. Grantor hereby agrees that the Grantee shall have the right of access across said premises for the purpose of inspection and maintaining said conservation easement.. 3. The Grantee will indemnify, same harmless and defend the Grantor from any injury to persons or loss or damage to personal or real property which said Grantors may suffer, incur or sustain arising proximately from the actions of Grantee or its agents during the performance of work under this grant. Such indemnity and hold harmless is intended to apply only to damages or injuries suffered by Grantor from actions by Grantee or its agent as well as Grantor's liability for actions brought by third parties for damages or injuries arising from actions or failures to act by Grantee or its agents, and shall not apply to damages or injuries to third parties arising from Grantor's actions or failures to act. 4.
