AN ORDINANCE AMENDING ORDINANCE NO. 0 -16-97
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that
Ordinance No. 0 -16 -97 be amended as follows:
0 -16-97 - ORDINANCE APPROVING A 5% MUNICIPAL TELECOMMUNICATIONS
TAX
SECTION THREE is hereby amended to read as follows:
"SECTION THREE - Units of local governmental and school districts located
within the corporate boundaries of the Village of Lemont shall be exempted from
the collection of the municipal telecommunications tax established by the adoption
of this Ordinance."
SECTION FOUR is hereby amended to read as follows:
SECTION FOUR - That this Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law, and
shall be applicable to gross receipts actually paid to the taxpayer for services billed
on or after the 1st day of July, 1997.
SECTION A(1) of Exhibit A to is hereby amended by adding the following as a final sentence
to the definition of "Gross Receipts ":
"The term `gross receipts' shall not include that portion of the consideration
received for distributing, supplying, furnishing, or selling gas or electricity to, or
for the transmission of messages for, school districts or units of local
government".
If SECTION THREE of Ordinance No. 0 -16 -97 or SECTION THREE of this Ordinance
or the application thereof is held unconstitutional or otherwise invalid, the amount of tax due as
consequence of such holding shall be limited to the amount that the taxpayer is authorized to
charge and collect from such school districts and units of local government pursuant to the
provision of Section 9 -221 of the Public Utilities Act or any successor thereto.
That this Ordinance shall be in full force and effect from and after its passage, approval
and publication in the manner provided by law.
All Ordinances or parts of Ordinances in conflict herewith shall be and the same are
hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance
and cause the same to be published in pamphlet form.
