(:)---6 AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS LEMONT SENIOR HOUSING CENTER ( North of Main Street, east of Holmes Street - Murry Property) WHEREAS, The Stough Group, hereinafter referred to as "the Petitioner ", is the owner of an approximately 5.0 +1- acre parcel, hereinafter referred to as "the subject property ", located at 801 Main Street, Lemont, Illinois and legally described in Exhibit A; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a Zoning Map Amendment from Lemont M -1 Manufacturing District to Village of Lemont R -3 Single - family Detached Residence District with a Planned Development Approval and Variances; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on January 6, 1998 for approval of a Zoning Map Amendment with Planned Development and Variances; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved a Zoning Map Amendment with Planned Unit Development and variances; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Zoning Map Amendment with Planned Unit Development and Variances as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: 2 98196001 P•] ,_..f 1� rG �. v SECTION 1: Planned Unit Development Approval. That a Planned Unit Development be and is hereby approved and granted to allow the Owner or successors or assigns, (collectively referred to as the "Owner ") to construct a Planned Unit Development upon the subject property legally described above pursuant to Owners Preliminary Plans attached hereto as Exhibit B and subject to the following conditions: 1. The Subdivision and Planned Development agreement shall substantially conform to the Site Plan, attached hereto as Exhibit `B ", and the Building Elevation Drawings attached hereto as Exhibit "C ", except as such plans may be changed to conform to the Village codes and ordinances and the conditions below; The Site Plan may be amended to reduce the number of dwelling units or to reduce any Variance upon review and approval by the Village Board and passage of a Resolution adopting the changes; 2. Approval shall be subject to the property maintaining two (2) access points to a public roadway or the improvement of a temporary emergency access to be used as a second access point until the property to the east is developed, subject to the driveway meeting minimum Village standards for a private drive; 3. The property shall be used only for a private senior housing development with accessory uses for a maintenance facility with a community center and coach house. Said development shall utilize funds or tax credits from Cook County and the Illinois Housing Development Authority. If the ownership structure or use should change from exclusive possession, or a private senior housing complex, to another form of ownership or financing arrangement, amendments shall be required to the Planned Development Ordinance; 4. If parking should become deficient for the residents of the Lemont Senior Housing Development or the Village of Lemont, upon Staff's review, the Developer shall provide additional parking on site to meet the needs of the Residents and the Village; 5. A Tree preservation and Replacement Plan is required. In additional, the petitioner is responsible for the previous owner;'s commitment to replace trees that were removed as part of the fill permit issued; 6. Engineering plans shall be approved by the Village Engineer prior to issuance of site development or building permits; 3 • 981 196001 p,ag„ 10 7. Vacation of platted roadways for the subject site shall be done prior to issuance of building permits. No roadway vacations should be permitted outside the subject property; 8. In accordance to Section XII -L, item 3, a, of the Zoning Ordinance (Planned Development) the Planning and Zoning Commission recommends an increase in density not to exceed 5% of the total development; 9. Sidewalks and Parkway Trees shall be incorporated in the Concept Plan, as required by Village Ordinance; 10. The petitioner is required to apply for and receive a site development permit for any filling as part of the project; 11. All soil borings shall be reviewed and approved by the Village Engineer prior to a Site Development permit being issued; 12. The building on the southeastern section of the subject property shall be required to meet a minimum rear yard setback of 20 feet from the railroad right -of -way. 13. The petitioner shall vacate and deed to the Village a 55 foot wide strip of land adjacent to the I &M Canal along the north end of the property. 14. A resubdivision of the land will be required prior to issuance of building permits. SECTION 2: Zoning District Change. The subject property described above be and the same is hereby rezoned from M -1 Manufacturing District to Village of Lemont R -3 Single - family Detached Residence District. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. 4 98196001 SECTION 3: Variances. The following variances from the Lemont Zoning Ordinance are incorporated into this Planned Development Ordinance: 1. To permit a total of 63 parking spaces serving the 45 units, in lieu of a minimum of 90 spaces required, pursuant to Section X- 12.a.3. of the Lemont Zoning Ordinance. 2. Variations to permit buildings north of the roadway to allow front yard setbacks to be 20 feet instead of the required 25 feet, side yard setback to be 25 feet instead of the required 30 feet and rear yard setacks to be five (5) feet instead of the required 30 feet, pursuant to Section VII.G.7 and 8 of the Lemont Zoning Ordinance. 3. Variations to permit buildings south of the roadway to allow front yard setbacks to be 20 feet instead of the required 25 feet, and rear yard setbacks to be 20 feet instead of the required 30 feet, pursuant to Section VII.G. 7. and 8. of the Lemont Zoning Ordinance. 4. A variance to permit a 50 foot right -of -way width, in lieu of the minimum of 66 feet, pursuant to Section 2, Street and Alleys, 2.02 B. To the Lemont Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements. 5.
